Please enter a judgment of non pros in favor of Defendant, Alexander Spring Rehab, and against Plaintiff, Gregory B. Abeln, for failure to file a Complaint in a timely manner. 2, On January 18, 2007, a Rule to File Complaint was filed with the Prothonotary in the above-referenced matter. A copy of the Rule to File Complaint is attached hereto as Exhibit "A." 3, Pursuant to the Rule to File Complaint, Plaintiff had twenty (20) days in which to file a Complaint. The twenty (20) days elapsed on February 19, 2007. 4, Thereafter, a Notice of Praecipe to Enter Judgment of Non Pros was served upon Plaintiff by FedEx priority overnight mail on March 2, 2007, more than 10 days before this Praecipe was filed. 5. A copy of the Notice of Praecipe to Enter Judgment of Non Pros is attached hereto as Exhibit "8," A Certification of Service of the Notice is attached hereto as Exhibit "C." Pursuant to the Notice and the Certification, Plaintiff had ten (10) days in which to file a Complaint. The ten (10) days has elapsed.
