WHEREAS, DAVID PHAP NGUYEN and LAP THI NGUYEN, his wife, of Hamilton
Street, Carlisle, Cumberland County, Pennsylvania, have executed a contract with S&A Custom
Built Homes, of Cumberland County, Pennsylvania, for the erection of a residential dwelling
upon a tract of land situate in the Carlisle Borough, Cumberland County, Pennsylvania, more
padicularly described in the deed of The H. Blaine Nelson Estate, granted and conveyed to
DAVID PHAP NGUYEN and LAP THI NGUYEN, dated August 31,2001, and recorded in the
Office of the Recorder of Deeds for Cumberland County, Pennsylvania in Deed Book ,
Page , and being a vacant lot on Hamilton Street, Carlisle, Pennsylvania.
NOW, August 31, 2001, at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said Owners to the said
Contractor to commence work on said building, or to purchase materials for the same in
consideration of the making of the said contract with the said Contractor and the further
consideration of the sum of One and no/100 ($1.00) Dollar to Contractor paid by said Owners, it
is agreed that no lien shall be filed against the building by the contractor, or any subcontractor,
nor by any of the material men or workmen or any other person for any labor or materials
purchased or extra labor or materials purchased for the erection of said building, the right to file
such liens being expressly waived.
