GAINES AUTO TRANSPORT, and COULSON'S TOWING, Defendants. CIVIL ACTION - LAW COMPLAINT AND NOW comes Van Trans, Inc. d/b/a Empire Auto Sales, by and through its attorneys, Smigel, Anderson & Sacks, LLP, to make the following Complaint against E.C. Gaines Auto Transport and Coulson's Towing: A. The Parties 1. Plaintiff Van Trans, Inc. d/b/a Empire Auto Sales ("Empire") is a New Jersey business with a principal place of business located at 285 Rt. 46 E, Little Ferry, NJ 07643. 2. Defendant E.C. Gaines Auto Transport ("E.C. Gaines") is an unregistered Pennsylvania proprietorship with a principal place of business located at 7500 Carlisle Pike, York Springs, P A 17372. 3. On information and belief, E. C. Gaines Auto Transport is owned and operated by Defendants Hugh Jones and Audra Jones (collectively "The Joneses") and Everett Gaines. 4. Defendant Coulson's Towing is an unregistered Pennsylvania business with a principal place of business located at 12 Capital Hill Road, Dillsburg, P A 17109. 5. Empire Auto Sales is and was at all times mentioned in this Complaint in the business of selling vehicles. 6. E.C. Gaines Auto Transport, Everett Gaines, Hugh Jones and Audra Jones are and were at all times mentioned in this Complaint in the business of transporting vehicles. 7. Coulson's Towing is and was at all times mentioned in this Complaint in the business of towing and storing vehicles. B. Jurisdiction 8. This Honorable Court has jurisdiction over the parties and subject matter of this case. 9. Pursuant to Pennsylvania Rule of Civil Procedure 1006, venue is proper in Cumberland County as the transactions and/or occurrences out of which the cause of action arose took place in Cumberland County. C. Factual Backeround 10. In December 2005, Empire, through its President Daniel Lacey, hired E.C. Gaines and the Joneses to transport a number of vehicles that Empire had purchased in Pennsylvania. 11. E.C. Gaines and the Joneses were to transport the vehicles from the PADE Auto Auction in York, PA to Empire's location in Little Ferry, NJ. 12. One of the vehicles was a 1997 Nissan Maxima, NJ VIN No. JNICA21DOVT823303 ("the Nissan Maxima"), which is owned by Empire and titled in the name of Van Trans, Inc., Empire's parent company. A true and correct copy ofthe vehicle's title is attached hereto as "Exhibit I." 13. E.C. Gaines and the Joneses intentionally refused to and failed to deliver the Nissan Maxima from York, PA to Little Ferry, NJ. 2 1- 14. Instead, E.C. Gaines, the Joneses, and Coulson's Towing made an agreement among themselves to keep Empire's Nissan Maxima for their own use without the permission of or consent by Empire. 15. E.C. Gaines, the Joneses, and Coulson's Towing all have knowledge that the Nissan Maxima is titled in the name of Empire and owned by Empire and that they have no right of possession to the vehicle. 16. To this date, despite repeated demands, E.C. Gaines, the Joneses, and Coulson's Towing have refused to deliver or turn over the Nissan Maxima to Empire. COUNT I Conversion Van Trans, Inc. d/b/a Empire Auto Sales vs. Hugh Jones, Audra Jones, and Everett Gaines d/b/a E. C. Gaines Auto Transport 17. Each and every preceding paragraph is hereby incorporated by reference as if the same were more fully set forth herein. 18. The Joneses and E.C. Gaines, by engaging in the conduct described above, has converted, attained, and misused Empire's property for their own use and benefit. 19. The conduct of the Joneses and E.C. Gaines is willful, wanton, intentional and unprivileged and is causing harm and monetary damages to Empire. 20. As a result of the actions of the Joneses and E.C. Gaines, Empire suffered damages in the form of the loss of the value of the Nissan Maxima; loss of use of the Nissan Maxima; loss of profits from the anticipated sale of the Nissan Maxima; time and expense; attorneys fees; and costs of suit. 3 WHEREFORE, Plaintiff Empire Auto Sales respectfully requests this Honorable Court to enter judgment against Defendants Hugh Jones, Audra Jones, and Everett Gaines d/b/a E.C. Gaines Auto Transport in the amount of at least $10,000.00, together with lawful interest thereon, costs of suit and any other relief that the court may deem necessary or appropriate. COUNT II Conversion Van Trans, Inc. d/b/a Empire Auto Sales VS. Coulson's Towing 21. Each and every preceding paragraph is hereby incorporated by reference as if the same were more fully set forth herein. 22. Coulson's and E.C. Gaines have conspired and acted together to deprive Empire of the use and value of its vehicle. 23. Coulson's Towing, by engaging in the conduct described above, has converted, attained, and misused Empire's property for their own use and benefit. 24. The conduct of Coulson's Towing was willful, wanton, intentional and unprivileged and is causing harm and monetary damages to Empire. 25. As a result of the actions of Coulson's Towing, Empire suffered damages in the form of the loss of the value of the Nissan Maxima; loss of use of the Nissan Maxima; loss of profits from the anticipated sale of the Nissan Maxima; time and expense; attorneys fees; and costs of suit.
