FRANCISCO t/d/b/a BEAUTY AND THE BEACH, Defendants COMPLAINT IN CONFESSION OF JUDGMENT Plaintiff files this Complaint pursuant to Pa.R.C.P. 2951 (b) for judgment by confession and avers the following: 1. Plaintiff, Sadler Health Center Corporation, is a Pennsylvania non-profit, non-stock corporation with a business address at 100 North Hanover Street, Carlisle, Cumberland County, Pennsylvania, 17013. 2. Defendants, James Rosario a/k/a James B. Rosario and Donna Rosario a/k/aDonna K. Francisco, are individuals trading and doing business as Beauty and the Beach, a hair and tanning business with an address of 50 West Louther Street, Carlisle, Cumberland County, Pennsylvania, 17013. 3. Attached as Exhibit "A" is a true and correct copy of the original instrument authorizing confession duly executed by James Rosario and Donna Rosario, as individuals, trading and doing business as, Beauty and the Beach (herein, the "Lease"). Attached as Exhibit "B" is an affidavit verifying that this is a true and correct copy of the Lease. Verification by affidavit is expressly permitted by Paragraph 21 (d) of the Lease. 4. Donna Rosario is also known as Donna K. Francisco. 5. Judgment is not being entered by confession against a natural person in connection with a consumer credit transaction. 6. The original lease between Defendants and Phillips Real Estate Investment Partnership was assigned to Plaintiff on May 2,2003, upon Plaintiffs acquisition of the premises occupied by the Defendants under the Lease. 7. Judgment has not been entered in any jurisdiction on the attached instrument authorizing confession. 8. According to Paragraph 20( a) ofthe attached instrument, it is an Event of Default for the Tenantto fail to pay any basic rent and for such a failure to continue for five (5) days after notice to Tenant of such failure. 9. Notice of Defendants' failure to pay basic rent was sent to Defendants on Friday, October 13, 2006. 10. Defendants' failure to pay the basic rent has continued since notice of such failure was sent. 11. Paragraph 21 ( e) of the attached instrument permits Plaintiffto confess judgment against Defendants for basic rent. 12. Paragraph 21 (e) of the attached instrument requires Defendants to pay all unpaid basic rent along with costs of the suit and an attorneys' commission often percent (10%) for collection. 13. Consequently, Defendants are liable to Plaintiff as follows: Unpaid basic rent: January 2006 $788.00 April 2006 $788.00 July 2006 $788.00 September 2006 $788.00 October 2006 $788.00 10% Attorney's Commission $394.00 Total $4,334.00 WHEREFORE, Plaintiff demands judgment in the sum of$4,334.00 plus costs of the suit as authorized in the Lease between Plaintiff and Defendants, and interest.
