ORDER
AND NOW, this l~ (t day of f.jf)\J . ,2006, upon
consideration of the foregoing petition, it is ordered that the petitioner distribute
the property of decedent under section 3102 of the Probate, Estate and
Fiduciaries Code as follows:
Since the cash assets of decedent's estate have been applied against the
costs of her funeral, as directed by decedent's will, with a balance
remaining due to reimburse petitioner, Catherine M. Kimmel, for such
expenses paid by petitioner from her own funds, which is the only unpaid
claim against the estate, the remaining assets of the estate shall all be
distributed to petitioner, Catherine M. Kimmel, as reimbursement for such
expenses, such assets being thirty-three (33) shares of stock held in
decedent's name, in The May Department Stores Company (Certificate
Nos. M191249 (10 shares), M249684 (1 share), M332151 (11 shares),
and 440309 (11 shares), which distribution petitioner has agreed to accept
as payment in full on her reimbursement claim.
This decree of distribution shall constitute sufficient authority to all transfer
agents, registrars and others dealing with the property of the estate to recognize
the persons named as entitled to receive such property without administration,
and shall in all respects have the same effect as a decree of distribution after an
accounting by a personal representative.
