Vazquez, of 95 Orient Way 45D, Rutherford, NJ 07070, party of the first part (hereinafter called Owner), and George Ward, of 4-B Jefferson Lane, Whiting, NJ, 08759, party of the second part (hereinafter called Contractor). WEHREAS, the said parties have by a duly executed Agreement under seal, dated I entered into a written contract for the construction an completion of a single-family dwelling located at 1402 Longs Gap Road, Carlisle, Pennsylvania. AND NOW, comes Laura Vazquez, by and through her attorneys, MARTSON LAW OFFICES, and files the following Preliminary Objections to the Mechanics' Lien Claim filed in the above-captioned matter by George Ward: Defendant, Laura Vazquez, is an adult individual residing at 95 Orient Way, Apartment 5D, Rutherford, New Jersey. 2. Claimant G&W Builders & Contracting is a construction and contracting business which conducts business at 4-B Jefferson Lane, Whiting, NJ 08759. 3. Claimant George Ward is a contractor who was employed by G&W Builders & Contracting during the construction of Defendant's residence. 4. On or about September 1, 2005, Defendant accepted a proposal ("Contract") from Claimants for the construction and completion of a residence located at 1402 Longs Gap Road, Carlisle, Cumberland County, Pennsylvania. A copy of the Contract is attached hereto and incorporated as Exhibit "A." 5. On or about October 19, 2005, Defendant and Claimant Ward, as the Contractor for G&W Builders & Contracting, entered into a Stipulation Against Liens. The Stipulation Against Liens was filed at Docket No. 05-5473 on or about October 20, 2005. A copy of the Stipulation Against Liens is attached hereto and incorporated as Exhibit "B." 6. Pursuant to the terms of the Stipulation Against Liens, Defendant and Claimant Ward agreed that no lien would be filed against the residence either by the Contractor or by any sub- contractor. 7. Due to the executed and filed Stipulation Against Liens, Claimants' Mechanics' Lien Claim has been made against property which is exempt or immune from lien. 8. Claimants' Mechanics' Lien Claim fails to conform to the requirements of Section 502(a)(2) of the Mechanics' Lien Law of 1963, 49 P.S. § 1502(a)(2), in that no written notice of the filing of the Mechanics' Lien Claim was timely served upon Plaintiff. 9. Claimants' Mechanics' Lien Claim fails to conform to the requirements of Section 502(a) of the Mechanics' Lien Law of 1963, 49 P.S. § 1502(a)(2), in that no affidavit of service of notice upon Defendant was timely filed by Claimants. 10. As a result of Claimant's Mechanics' Lien, Defendant has suffered, and continues to suffer, difficulty in obtaining financing for the completion of her residence. WHEREFORE, Defendant respectfully requests this Honorable Court sustain these Preliminary Objections and order that the Claimants' Mechanics' Lien Claim be stricken.
