APPEAL FROM SUSPENSION OF OPERATOR'S PRIVILEGE
AND NOW comes the Appellant, Peter F. Jensen, Sr., by and through his attorney, Karl E.
Rominger, Esquire, and avers the following:
1. Appellant resides at 8 South Madder Drive, Mechanicsburg, Pennsylvania 17055.
2. Appellant received Notice dated October 17,2006, stating as authorized by Section
1532C of the Pennsylvania Vehicle Code, as a result of conviction on September 7, 2006, of
violating Section 13A30 of the Controlled Substance, Drug, Device and Cosmetic Act, on September
30,2005, his driving privilege was being suspended for a period of one year, effective November 21,
2006, at 12:01 a.m. A copy is attached hereto as Exhibit "A".
3. Suspension is improper in that the charges arose from Defendant's possession of
marijuana for personal medical use, which he uses to treat severe arthritic pain.
4. The imposition of a suspension is a punitive measure collateral to the criminal
conviction.
5. This right to use effective medicines and herbs to treat oneself implicates petitioner's
rights under the United State Constitution, including his privacy rights in his person, much the same
as a pregnant woman has the right to abort her fetus under the First Amendment.
6. The Courts should now, as part of our evolving standards of decency, recognize an
absolute right in the individual to mitigate physical pain, by any means.
7. There was no evidence to suggest that marijuana affected his ability to drive.
WHEREFORE, your Appellant respectfully requests this Honorable Court
schedule an evidentiary hearing on the matter and in the meantime to grant a Supersedeas
pursuant to the Vehicle Code.
