As of the date of this Complaint, the remaining balance due, owing and unpaid on Defendant's credit card account as a result of the charges made by said Defendant and/or any authorized users is the sum of $11,477.99. This account was created through a phone application. 4. At all relevant times material hereba, Defendant has been regular user of said charge card for the purchase of products, goods and/or for obtaining services. 5. Defendant received monthly statements which accurately state all purchases and payments made during the month, interest charges imposed on the unpaid balance, and the amount due, until February 2006. After February 2006, statements have not been sent to Defendant. 6. As of February 2006, the fast date that the Defendant received a statement from the Plaintiff, the remaining balance due, owing and unpaid on Defendant's credit account, as a result of charges made by Defendant is the sum of $9,404.18. 7. Since obtaining a credit card through the Plaintiff in October 2002, the Defendant made regular and timely payments until the past year. Defendant is agreeable to pay the aforementioned sum that is owed to Plaintiff, but is no longer able to pay the pre-agreed to monthly payments. 8. The amount in controversy is within the jurisdictional amount requiring compulsory arbitration. 9. The Defendant has legally ganged her name to AMY E.H. BELL. On or about November 17, 2006, Plaintiff filed a Complaint against Defendant seeking to recover monies due Plaintiff for charges incurred from an open end credit account.
