The Petition of Jam s D. Hughes, Esquire attorney on behalf of Colin Douglas McRae
and Nancy Louise McRae J ison states that:
1. Petitioners e the children of Helen P. McRae ("Decedent) who died on
September 8 2006, a resident of Carlisle, Cumberland County, Pennsylvania.
2. Decedent w s a widow whose sole heirs are Petitioners.
3. On Decemb r 7, 1992, Decedent executed a Last Will and Testament, a copy of
which is atta hed as Exhibit "A" wherein she named Petitioners as Co-Executors
and named titioners as equal beneficiaries of Decedent's estate.
4. The Last Wi I and Testament was prepared by Decedent's attorney, R. Martin
Reiley, Esqu re and was witnessed by that attorney as well as another employee of
his office an duly notarized by a Notary Public in for the Commonwealth of
Pennsylvani .
5. Following e ecution of the Will by Decedent, the Last Will and Testament was
photocopied and one copy was placed in the attorney's files and two photocopies
were deliver d to Petitioner, Colin D. McRae along with a transmittal letter from
the attorney ho prepared the Last Will and Testament.
6. The original ast Will & Testament was given to the Decedent, but it has not been
located amo g her personal effects.
WHEREFORE, Pet" ioners respectfully request that a citation be issued to show cause
why a photocopy of the Wil dated December 7, 1992, of Helen Pence Rae, Deceased, should
not be admitted to probate s if it were the original.

County, Pennsylv nia, (220 East Penn Street, Bedford, Pennsylvania,
15522), do hereb, make, publish and declare this to be my Last Will
and Testament, a d hereby make null and void any and all Wills or
s of a similar nature in writing heretqfore made

by me.

eclare that I am a widow and that I have two
children, viz., .olin Douglas McRae of 890 South Bronson Avenue,
Los Angeles, Cal'fornia, 90005, and Nancy Louise McRae Jamison, of
301 Walnut Street, Boiling Springs, Pennsylvania, 17007-0518 who
are hereinafter eferred to as "my Children".
SECOND.
1 irect that my funeral expenses and just debts be
paid as soon as onvenient after my decease.
THIRD.
Under the provisions of the trust agreement
hereinafter described,
I
possess a
testamentary
power
of
appointment by i'rtue whereof I am entitled to dispose 'of trust
property held f r my benefit at the time of my death. The trust
agreement to w ich reference is made herein is described as
follows:
"Funded Convertible Living Trust (Revocable)" dated May 20,
1971, entered
to between Zoe B. Carver, as Trustor, and The
Hay 20, 1971",
by that certain instrument termed "Second
Valley National ank of Arizona, a national banking association as

July 13, 1972.

By various assignments and transfers, First Fidelity Bank of

07041, is now acting as Trustee.
Pursuant to said Trust and with
the intent of fu ly exercising the said pOlver of appointment, I
direct that upon my death all property whether real, personal or
mixed shall be given, devised and bequeath, transferred and
distributed unto my Children equally, absolutely and in fee.
FOURTH. I g.ve, devise and bequeath all of my Estate whether
real, personal or mixed or whatsoever kind and wheresoever situate
unto my Children, share and share alike, absolutely and in fee.
FIFTH. 1 no inate, constitute and appoint my Children as the
Executors of this Will. Neither shall be required to give bond or
other surety sha 1 be required.
