CIVIL ACTION COMPLAINT
I. Plaintiff is an individual residing at the above-stated address.
2. Defendant is an individual residing at the above-stated address.
3. Plaintiff hired the Defendant to perform contracting work at the Plaintiffs
property located at 1225 Prairie Drive, Chambersburg, Pennsylvania.
4. The Defendant agreed to insulate a wall as part of his services.
5. The Defendant failed to insulate the kitchen wall.
6. On or about December 7, 2005, the Plaintiffs pipe froze causing damage
set forth more fully hereinafter.
7. The Negligence and carelessness of the Defendant consisted of but not
limited to the following:
a. Failing to use due care in performing contracting services at the
Plaintiff's property;
b. Failing to use due care in insulating a wall at the Plaintiffs property;
and
c. Failing to use due care in informing the Plaintiff that he would
insulate a wall when he failed to do so.
8. As a result of the aforesaid negligence and carelessness, a pipe froze at
Plaintiffs property causing the damages including but not limited to the damages set
forth in the documents attached hereto, made part of, and referred to as Exhibit "A".
WHEREFORE, Plaintiff, Pamela Schroff demands judgment against Scott
Vaillancourt in the sum of $6,459.85 together with interest from October 8,2005 and
costs of suit.
COUNT II
PLAINTIFF v. SCOTT VAILLANCOURT
9. Plaintiff incorporates be reference Paragraphs I through 8 as though each
and every allegation set forth and at length.
10. The Defendant failed to perform the work in a good an workmanlike
manner.
II. The Defendant breached his Agreement to perform insulation.
12. As a result of the aforesaid breach, Plaintiffs sustained damages set forth in
Count I hereof which are incorporated by reference herein.
WHEREFORE, Plaintiff, Pamela Schroff demands judgment against Scott
Vaillancourt in the sum of $6,459.85 together with interest from October 8,2005 and
costs of suit.
