O THOMAS J. CARRiCATO & SONS, BUILDERS, INC., a Pennsylvania : Corporation, : Contractor : WHEREAS, RUSSEL S. SWANGER, JR. and JODY L. SWANGER, husband and wife, of 835 Clubhouse Drive, Mechanicsburg, Cumberland County, Pennsylvania 17050 (herein together called "Owner" }, are about to execute contemporaneously herewith, a contract, with THOMAS J. CARRICATO & SONS, BUILDERS, INC., a Pennsylvania Corporation, with principal offices at 50 Lester Road, Harrisburg, Dauphin County, Pennsylvania 17113-1901 (herein called "Contractor" , for the erection of a two story residential building upon a lot of land situate: ALL THAT CERTAIN lot of land situate in the Township of Silver Spring, County of Cumberland and Commonwealth of Pennsylvania, more particularly identified and described as Lot No. 30, as shown on a certain plan of lots entitled ~ Final Subdivision of Enchanted Hills" as recorded in the Office of the Recorder of Deeds in and for Cumberland County, Pennsylvania in Plan Book 76, Page 37. BEING ALSO IDENTIFIED AS Cumberland County Tax Parcel 38-13-0985-127, and being commonly known and numbered as Keystone Drive, Mechanicsburg, Pennsylvania 17055. No. BEING THE SAME PREMISES which Greater Keystone Properties, Inc., a Pennsylvania corporation, by its Deed dated September 25, 2001 and recorded on October 3, 2001 in Cumberland County Deed Book 248,Page 3205, granted and conveyed unto Russel S. Swanger, Jr. and Jody L. Swanger, husband and wife, Owner herein. NOW, June 4, 2002, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or to purchase materials for the same, in consideration of the making of the said contract with Contractor and the further consideration of One and 00/100 ($1.00) Dollar, to Contractor paid by Owner, it is agreed that no lien shall be filed against the above described premises and the building and improvements to be erected thereon, by Contractor, or any subcontractor, or by any of the materialmen or workmen, or any other person for any labor provided or materials purchased, or for extra labor provided or materials purchased for the erection of said building and improvements, the right to file such liens being expressly waived.
