TIDAY BUILD , INC., Contractor, ALI ARSHIAN and AZAM BALAN ARSHIAN, husband and wife, hereinafter referred to as Owner, whereby the former undertook and agreed to erect and construct a single family dwelling on that certain lot of ground situate in Hampden Township, Cumberland County, Pennsylvania, more particularly described in the attached Exhibit "A". also referred to as 510 Jacob Lane, Mechanicsburg, Pennsylvania. NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for and in consideration of the sum of ($1.00) Dollar to FRED A. TIDAY BUILDERS, INC., in hand paid by Owner, the receipt whereof is hereby acknowledged' and the further consideration mentioned in the agreement aforesaid, for themselves and their subcontractors, and all parties acting through or under them, covenant and agree that no mechanic's liens or claims shall be filed or maintained by them or any of them against the said buildings and the lot of ground appurtenant thereto for or on account of any work done or materials furnished by them or any of them under said contract or otherwise, for, towards, in, or about the erection and construction of the said buildings on the lot above described, and the said Contractor, for themselves, their subcontractors and others under them hereby expressly waive and relinquish the right to have, file, and maintain any mechanic's liens or claims against the said buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an independent covenant. EXHIBIT "A" ALL THAT CERTAIN piece, parcel or lot of land, together with improvements, situated in Hampden Township, Cumberland County, Pennsylvania, and bounded and described as follows: BEGINNING at a point on the Southern right-of-way line of Jacob Lane (50.00 feet wide), said point being located at the Northeastern corner of Lot No. 217; thence along said right-of-way line South 86 degrees 59 minutes 07 seconds East, for a distance of 59.23 feet, to a point on the arc of a circle curving to the right, having a radius of 150.00 feet, and an arc length of 42.75 feet, to a point at the Northwestern corner of Lot No. 219; 'thence along the Western boundary line of Lot No. 219, South 22 degrees 36 minutes 36 seconds West, for a distance of 125.00 feet, tO a point in line of Lot No. 220; thence along said Lot No. 220 and partially along Lot No. 221, South 83 degrees 02 minutes 34 seconds West, for a distance of 98.09 feet, to a point at the Southeastern corner of Lot No. 217; thence 'along the Eastern bouh~ary line of Lot No. 217, North 17 degrees 45 minutes 46 seconds East, for a distance of 146.82 feet, to a point and the place of BEGINNING. CONTAINING approximately 12,914.00 square feet of land, has an address of 510 Jacob Lane, Mechanicsburg, Pennsylvania 17055, andi is known and numbered as Lot No. 218 on the Final Subdivision Plan for Good Hope Farms South - Phase VII, which is recorded in Cumberland County in Plan Book 83, Page 64. UNDER AND SUBJECT TO any and.all covenants, conditions, reservations, restrictions, agreements, easements, and rights-of-way of record. BEING PART OF THE SAME PREMISES which The McNaughton Company, a Pennsylvania corporation, by their deed to be recorded simultaneously herewith, in the Office of the Recorder of Deeds of Cumberland County, granted and conveyed unto Ali Arshian and Azam Balan Arshian.
