VANVOORHEES, DECEASED NO. 21-2006-0887 AFFIDAVIT f(~~ ~ Stephen VanVoorhees, being first duly sworn, deposes and says, as follows: 1. Jeffrey R. Boswell, Esquire, is counsel to the Estate of Fred L. VanVoorhees and its Executor, Robert Frederick VanVoorhees, as set forth in the Petition for Letters Testamentary filed October 10,2006. 2. Attorney Boswell reviewed Fred L. VanVoorhees' most recent account statements to determine the gross value of the decedent's intangible assets. 3. Attorney Boswell determined, according to those statements, that the decedent's bank accounts total $8,802.11, and his investment accounts total $267,865.79, for a sum total of $276,667.90. 4. Since filing an Affidavit, dated October 18, 2006, Attorney Boswell requested specific information concerning the decedent's investment accounts. 5. According to written information provided by (the decedent's investment advisor) Michael George Papson, Ameriprise Financial Services ("Ameriprise"), 4661 Trindle Road, Camp Hill, PA 17011-5603, he determined that the date of death value of decedent's accounts total $268,663.64, comprised of different investments, as follows: (a) Two (2) IRAs, total value - $7,771.71 - beneficiaries designated for each account; (b) Three (3) annuities, total value - $180,551.03 - beneficiaries designated for each account; and (c) SPS Advantage One investment account, value - $80,339.90 - registered with "TOO ownership," so on the death of the owner, the account registered "Transfer On Death" passes to the named beneficiaries. 6. Attorney Boswell is now informed that for every account, Fred L. VanVoorhees made the beneficiary designation: "Primary Beneficiary: 1000/0 Lawful children in equal shares, if a child is deceased, his or her share to be paid to his or her estate. " 7. Based on information now received from Michael George Papson, Ameriprise Financial Services, Attorney Boswell determined that the asserts listed in this Affidavit will be distributed by Ameriprise directly to decedent's children, so the assets will not become part of the estate for distribution from the estate. 8. As per paragraph TENTH of decedent's Last Will and Testament, the decedent nominated, constituted, and appointed Robert Frederick VanVoorhees to be the Executor, as set forth in the Petition for Letters Testamentary previously filed. 9. As per paragraph TENTH of decedent's Last Will and Testament, the ~~ decedent nominated, constituted, and apPointed. Stephen VanVoorhees as the Successor Executor. , . 10. The decedent is survived by four (4) children, including Robert Frederick VanVoorhees, a resident of Maryland, and Frank Stephen VanVoorhees, a resident of Adams County, Pennsylvania. 11. Frank Stephen VanVoorhees avers that he will maintain the personal property within his custody and control within Pennsylvania, including bank accounts, refunds, and household contents of approximately $40,000, with the permission to do so granted by his brothers and sister. 12. Frank Stephen VanVoorhees requests issuance of Letters of Administration, C.T.A., be granted and issued by the Register of Wills upon Robert Frederick VanVoorhees and Frank Stephen VanVoorhees, to serve as Co-Administrators, C.T.A. 13. The Register of Wills previously required a Surety Bond, because the individual personal representative, Robert Frederick VanVoorhees, is not a resident of the Commonwealth of Pennsylvania. 14. The Probate, Estates, and Fiduciaries Code provides at S 3174(b) that no bond shall be required of an individual personal representative when such personal representative is a resident of the Commonwealth and when the personal representative, who is a resident of the Commonwealth, will serve with a resident co- personal representative who has averred that all assets will remain in the custody and control of the resident co-personal representative. ~A~W Frank tephen VanVoorhees
