It has come to my attention as solicitor for the Office of the Register of Wills and Clerk
of the Orphans' Court in and for Cumberland County, Pennsylvania, that the above estate
has failed to file a report of the status of administration as required by Pennsylvania
Orphans' Court Rule 6.12.
Subsection (f) of Rule 6.12 requires that the Register of Wills notify the Court in the
event the personal representative or counsel fails to file this notice after (10) days written
notice thereof. You have already received written notice of this delinquency by the

KNOW ALL MEN BY THESE PRESENTS, that WHEREAS Ross Smiley;l~te of Bast
Pennsboro Township, Cumberland County, Pennsylvania, deceased, died intestate on November

24, 1993;
WHEREAS, Letters of Administration on the estate of decedent were duly issued by the
Register of Wills of Cumberland County and granted to Don Smiley, hereinafter called Personal
Representative;
WHEREAS, the Personal Representative has gathered the assets of the estate of the
decedent, and the assets consist ofreal and personal property to a total value of$64,539.65 as set
forth in Exhibit A, which is a statement of account of the said Personal Representative, and
which is attached hereto and made a part hereof and marked Exhibit A;
WHEREAS, the balance for distribution as shown in the statement marked Exhibit A has
been distributed as herein indicated in accordance with the intestacy laws of the Commonwealth
of Pennsylvania;
NOW, THEREFORE, KNOW YE, that we, Donald Smiley, Craig Smiley and Donald
Smiley, Executor of the Estate of Doris Smiley, being the beneficiaries and heirs of the decedent,
and being those persons entitled to inherit under the intestacy laws of the Commonwealth of
Pennsylvania, do hereby acknowledge that we have this day had and received from the Personal
Representative, in full satisfaction and payment, all sum or sums of money, legacies, bequests
and devices as are given, devised and bequeathed to us, which amounts we have received this

the statement attached hereto and marked Exhibit A. At his request, Craig Smiley's share of the
estate is being distributed to his attorney, Shane Kope, Esquire;
AND, we do hereby stipulate that in order to avoid the expense and time involved in the
filing of a formal account and schedule of distribution, we agree that no account is necessary;
and we do hereby consent to distribution being made without the filing of an account and
schedule of distribution, the same to be with the same force and effect as if it had been filed and
confirmed by the Orphans' Court Division of the COllrt of Common Pleas, Cumberland County.
THEREFORE, we and each of us do hereby remise, release, quit claim and forever
discharge the Personal Representative, Donald Smiley, and Marielle F. Hazen, Esquire, their
heirs, executors, administrators and assigns, of and from the estate and from all actions, suits,
payment, accounts, reckoning, claims and demands whatsoever for or by reason thereof, or for
any other use, matter, cause or thing whatsoever touching upon the estate of the decedent; and
each of us do further hereby covenant and agree that should any liability come due to the estate
of the decedent after the signing of this agreement, each of us do hereby covenant and agree with
each other and the Personal Representative that we will contribute pro rata our share of the estate
to satisfy any and all claims, demands, suits or causes of action which may be successfully
prosecuted against the estate or the Personal Representative after the signing, sealing and
delivery of this Family Settlement Agreement and Final Release.
