COMPLAINT
1. The Plaintiff Carman L. Shalan is an adult individual with an address of
298 Lembeck Avenue, Jersey City, NJ 07302.
2. The Defendnat Jennifer Lynne Erdman is an adult individual with an
address of 1100 Yverdon Drive, #B-4, Camp Hill, Pennsylvania 17011.
3. At all times releveant herein the Plani5tff was the operator of a certain
1991 Dodge Caravan.
4. At all times relevant herein, the Defendnat Jennifer Lynne Erdman was
the operator of a certain 194 Saturn.
5. On December 24, 1999 at or about 8:05 p.m., the Plaintiff was lawfully
operating her vehicle on the 200 block of Gettysburg Pike, Upper Allen
Township, Cumberland County, Commonwealth of Pennsylvania.
6. On the same date and time, the Defendant was operating her vehicle
and pulled out from a parking lot directly in front of the Plaintiff's vehicle and
collision between the two vehicle occurred.
7. The aforesaid collision came about solely because of the carelessness,
recklessness and negligence of the Defendant in that:
a.) she failed to yield the right of way to the Plaintiffs vehicle that was
lawfully proceeding on the aforesaid road;
b.) failed to see the Plaintiffs vehicle approaching;
c.) failed to avoid striking the Plaintiffs vehicle;
d.) struck the Plaintiffs vehicle.
e,) after failing to yield the right of way to the Plaintiffs oncoming vehicle
she pulled out of the parking lot directly into the path of the Plaintiffs
vehicle.
8. Solely as a result of the Defendant's carelessness, recklessness and
negligence, the Plaintiff suffered severe and sundry injuries ot her person.
9. solely as a result of the carelessness, recklessness and negligence of
the Defendant, the Plaintiff is entitled to the following past and future elements of
damage:
a.) medical expenses;
b.) lost wages and impairment of economic horizons;
c.) pain and suffering;
d.) emotional distress;
e.) other elements of damage recoverable under the law of the
Commonwealth of Pennsylvania.
WHEREFORE, the Plaintiff demands judgment in her favor and against
the Defendant ins an amount in excess of the amount for mandatory referral to
arbitration.

MOTION FOR LEAVE OF COURT TO CLOSE PLEADINGS
AND PROCEED WITH CIVIL ACTION
Defendant Jennifer Lynne Erdman, through her attorneys, Brigid Q. Alford, Esquire and
Boswell, Tintner, Piccola & Wickersham, presents the following Motion for Leave of Court to Close
Pleadings and Proceed with Civil Action, as follows:
1. This case stems from a December 24, 1999, motor vehicle accident from which
Plaintiff claims to have suffered damages
2. On or about June 10,2002, Plaintiff initiated this case by filing a Writ of Summons
in this Court. A true and correct copy of Plaintiff s Writ of Summons is attached hereto as Exhibit
A.
3. On or about July 1, 2002, Defendant filed a Praecipe for Rule to File Complaint. A
true and correct copy Defendant's Rule to File Complaint is attached hereto as Exhibit B.
4. On July 12, 2002, Plaintiff s counsel informed Defendant's counsel that the Plaintiff
had filed bankruptcy in the Bankruptcy Court for the District of New Jersey and that the Automatic
Stay prevented further proceedings in the instant civil action. A true and correct copy of Plaintiff s
counsel's correspondence is attached hereto as Exhibit C.
5. On July 22,2002, Defendant's counsel informed Plaintiffs counsel that the
Bankruptcy Court had discharged Plaintiff s bankruptcy case as a no-asset case, as of December 10,
2001. A true and correct copy of Defendant' s counsel's correspondence is attached hereto as Exhibit
D.
6. On July 29,2002, Plaintiff filed her Complaint, a true and correct copy of which is
attached hereto as Exhibit E, and in which Complaint Plaintiff alleges the accident at issue to have
occurred on December 24, 1999.
7. Subsequently, Plaintiffs counsel re-asserted to defense counsel that Plaintiffs
bankruptcy case was still pending, and served as a statutory impediment to any further action being
taken to advance the case at bar.
8. As a result of the representations of Plaintiff s counsel of record in this case
regarding the bankruptcy action, Defendant has been stayed from filing her Answer and New Matter
to the Complaint, and otherwise advancing her defense in this case.
9. Defendant's counsel thereafter endeavored to elicit written confirmation from
Plaintiffs Pennsylvania personal injury counsel, from Plaintiffs New Jersey bankruptcy counsel,
from the United States Bankruptcy Trustee, and from the United States Bankruptcy Court for the

District of New Jersey to establish whether or not the bankruptcy case had been discharged, or was
still open.
10. The only responses received to the requests enumerated in Paragraph 8, above, were
in the form of certified copies of the Docket Entries and Order of Discharge from the aforesaid
Bankruptcy Court establishing, to wit:
(a) That on October 10, 2001, the Chapter 7 Trustee filed a
Report of No Distribution regarding Plaintiffs bankruptcy
proceeding; and
(b) That on December 10,2001, the United States Bankruptcy
Court for the District of New Jersey entered an Order of
Discharge; and
(c) That on January 17,2002, the United States Bankruptcy Court
for the District of New Jersey entered a Final Decree, closing
the Plaintiff s bankruptcy proceeding.
These certified records are attached hereto as Exhibits F and G.
11. Defendant believes, and therefore avers, that Plaintiff s bankruptcy case is closed and
the automatic stay is no longer in effect.
12. Plaintiff continues to maintain that the Automatic Stay is still in effect, thereby
preventing further action in the instant lawsuit.
13. On October 22,2002, Defendant's counsel again requested that Plaintiffs counsel
provide any documentation that he may have supporting his assertion that the Automatic Stay is still
in effect. Plaintiffs counsel's letter of October 22,2002, is attached hereto as Exhibit H.
14. Plaintiff has provided no such documentation.

15. Plaintiffs unsupported oral assertion that the Automatic Stay is still in effect is in
direct conflict with the certified docket entries in Plaintiffs bankruptcy proceeding. See Exhibit D.
16. Defendant seeks an Order permitting her to commence discovery and for leave of
court to proceed with the instant civil case so that she may file her Answer and New Matter and
otherwise advance her defense..
WHEREFORE, Defendant Jennifer Lynne Erdman respe:ctfullyrequests that this Honorable
Court grant her Motion for Leave of Court to Close Pleadings and Proceed with Civil Action.

State Bankruptcy Court for the District of New Jersey, your client received her discharge on
December 10,2001, as a no asset case, prior to the expiration ofthe statute oflimitations applicable
to the motor vehicle accident at issue. Interestingly, she did not disclose the existence of her then-
pending claim against my client as an unliquidated asset of her estate.
In any event, the automatic stay ceased to be in effect as of December 10 oflast year. Please
file a timely response to the Rule to File Complaint or, in the alternative, withdraw the suit
altogether.

1. The Plaintiff Carman L. Shalan is an adult individual with an address of
298 Lembeck Avenue, Jersey City, NJ 07302.
2. The Defendnat Jennifer Lynne Erdman is an adult individual with an
address of 1100 Yverdon Drive, #B-4, Camp Hill, Pennsylvania 17011.
3. At all times releveant herein the Plani5tff was the operator of a certain
1991 Dodge Caravan.
4. At all times relevant herein, the Defendnat Jennifer Lynne Erdman was
the operator of a certain 194 Saturn.
5. On December 24, 1999 at or about 8:05 p.m., the Plaintiff was lawfully
operating her vehicle on the 200 block of Gettysburg Pike, Upper Allen
Township, Cumberland County, Commonwealth of Pennsylvania.
6. On the same date and time, the Defendant was operating her vehicle
and pulled out from a parking lot directly in front of the Plaintiffs vehicle and
collision between the two vehicle occurred.
7. The aforesaid collision came about solely because of the carelessness,
recklessness and negligence of the Defendant in that:
a.) she failed to yield the right of way to the Plaintiffs vehicle that was
lawfully proceeding on the aforesaid road;
b.) failed to see the Plaintiffs vehicle approachin!;:J;
c.) failed to avoid striking the Plaintiffs vehicle;
d,) struck the Plaintiffs vehicle.
e.) after failing to yield the right of way to the Plaintiffs oncoming vehicle
she pulled out of the parking lot directly into the path of the Plaintiffs
vehicle.
8. Solely as a result of the Defendant's carelessness, recklessness and
negligence, the Plaintiff suffered severe and sundry injuries ot her person.
9. solely as a result of the carelessness, recklessness and negligence of
the Defendant, the Plaintiff is entitled to the following past and future elements of
damage:
a.) medical expenses;
b.) lost wages and impairment of economic horizons;
c.) pain and suffering;
d.) emotional distress;
e.) other elements of damage recoverable under the law of the
Commonwealth of Pennsylvania.
WHEREFORE, the Plaintiff demands judgment in her favor and against
the Defendant ins an amount in excess of the amount for mandatory referral to
arbitration.

Dear David:
When I last wrote you in July concerning the status of this case, I told you that Attorney
Kartzman, the Trustee assigned to Ms. Shalan's bankruptcy, had informed us that the bankruptcy
matter was still open, notwithstanding the docket entries reflecting discharge of the case in
December, 2001. In due course, I have asked both the Trustee and Attorney Low to provide me with
some type of written verification confirming this fact. They have not responded.
Additionally, I have now obtained certified copies of both the Docket Entries from Ms.
Shalan's bankruptcy action and her December 10, 2001 Discharge from the United States
Bankruptcy Court for the District of New Jersey. Certified as of September 10, 2002, these
documents confirm that, in fact, a Report of No Distribution was filed on October 10,2001, that the
Discharge Order was entered on December 10, 2001, and that the Final Decree was entered on
January 17, 2002.
Recognizing that the New Jersey Trustee oversees literally thousands of bankruptcy cases,
I am now inclined to believe that he was simply mistaken about the status of Ms. Shalan's case, and
that the Discharge Order is valid. As a result, I see no reason why we cannot proceed with the
Cumberland County case at hand.

WITH NEW MATTER
Pursuant to Pa.R.C.P. No. 1019, and this Court's Order of November 7,2002, Defendant
Jennifer L. Erdman, by her attorneys, Brigid Q. Alford, Esquire and Boswell, Tintner, Piccola &
Wickersham, answers Plaintiffs Complaint, as follows:
I. Defendant is without knowledge or infonnation sufficient to fonn a belief as to the
truth ofthe avennents in Paragraph 1 ofthe Complaint; the same are therefore denied.
2 Admitted.
3. Admitted.
4. Admitted, with the clarification that Defendant's vehicle was a 1994 Saturn.
5. Admitted only that Plaintiffwas operating her vehicle in the 200 block ofGettysburg
Pike, Upper Allen Township, Cumberland County on or about 8:05 p.m. on December 24, 1999; the
allegations as to lawful operation set forth conclusions of law to which no response is required.
6. Admitted only the Defendant was operating her vehicle and commenced an exit from
a parking lot on the same date and time, at which time a collision between her vehicle and Plaintiff s
vehicle occurred; the balance of Paragraph 6 is denied.
7. Paragraph 7 sets forth a conclusion oflaw to which no response is required. To the
extent a response is deemed required, Defendant:
(a) denies that she failed to yield the right of way to the
Plaintiffs vehicle;
(b) denies that she failed to see the Plaintiffs vehicle
approaching;
( c) denies that she failed to avoid striking the Plaintiff s vehicle,
to the extent that such averment implies any liability on the
part of the Defendant;
(d) denies that she struck the Plaintiffs vehicle, to the extent that
such averment implies liability on the part of the Defendant;
(e) denies that she failed to yield the right of way to the
Plaintiffs oncoming vehicle and that she pulled out of the
parking lot directly into the path ofthe Plaintiffs vehicle.
8. The allegations as to carelessness, recklessness and negligence set forth conclusions
of law to which no response is required. As to the allegations of injury and damage, Defendant is
without knowledge or information sufficient to form a belief as to the truth ofthose averments; the
same are therefore denied.

without knowledge or information sufficient to form a belief as to the truth of those averments; the
same are therefore denied.
WHEREFORE, Defendant Erdman demands judgment be entered in her favor and against
the Plaintiff.
NEW MATTER
10. Defendant incorporates herein by reference her answers as set forth in Paragraphs 1
through 9, above.
11. Plaintiff's Complaint fails to set forth a claim upon which relief can be granted.
12. Plaintiff initiated this action by filing a Praecipe for Writ of Summons on June 10,
2002.
13. The applicable statute oflimitations bars Plaintiff's claims.
14. Pennsylvania's comparative negligence statute and/or the doctrine of contributory
negligence bars, restricts or diminishes Plaintiff's claims.
15. Plaintiff's injuries and losses, if any, were caused by the actions and/or omissions of
persons other than Defendant.
16. On August 31, 2001, subsequent to the date of the accident at issue, Plaintiff filed a
Petition for Relief under Chapter 7 of the United States Bankruptcy Code in the United States
Bankruptcy Court for the District of New Jersey, at Docket # 01-39839. True and correct copies of
the Plaintiff's Chapter 7 Petition for Relief, with attached schedules, and the Docket Entries from

her bankruptcy action, are attached hereto, made part hereof, and identified as Exhibits A and B,
respecti vely.
17. At no time between the date ofthe accident and the date on which she filed her
Petition for Relief in Bankruptcy did Plaintiff commence litigation against Defendant on a cause of
action relating to the accident at issue.
18. Within Schedule B of her Bankruptcy Petition, Plaintiff identifies her purported tort
claim against Defendant Erdman as an asset of her bankruptcy estate, and lists the date ofthe alleged
tort on the same schedule.
19. At no time during the course of Plaintiff s bankruptcy proceeding did Plaintiff, or the
United States Bankruptcy Trustee assigned to her case, commence litigation against Defendant on
a cause of action relating to the accident at issue.
20. On October 10,2001, the Trustee filed a Report of No Distribution (No Asset
Report) in the Plaintiffs bankruptcy action.
21. At no time between the filing of the Report of No Distribution and the expiration of
the applicable statute oflimitations did Plaintiff or the United States Bankruptcy Trustee commence
litigation against Defendant on a cause of action relating to the accident at issue.
22. On December 10, 2001, the United States Bankruptcy Court for the District of New
Jersey entered an Order of Discharge in Bankruptcy in the Plaintiffs bankruptcy case.
23. At no time between the entry ofthe Order of Discharge and the expiration of the
applicable statute of limitations did Plaintiff or the United States Bankruptcy Trustee commence
litigation against Defendant on a cause of action relating to the accident at issue.

24. On January 17, 2002, the United States Bankruptcy Court for the District of New
Jersey issued its Final Decree, formally closing Plaintiff's bankruptcy case.
25. At no time prior to the issuance of the Final Decree did Plaintiff or the United States
Bankruptcy Trustee commence litigation against Defendant on a cause of action relating to the
accident at issue.
26. Plaintiff's claims are barred, restricted or diminished as a result of her discharge in
bankruptcy.
27. Plaintiff's causes of action are barred, restricted or diminished by the provisions of
Pennsylvania's Motor Vehicle Financial Responsibility Law and/or Plaintiff's policy of automobile
Insurance.
WHEREFORE, Defendant Erdman demands judgment be entered in her favor and against
the Plaintiff.

the bankruptcy law extended the statute of limitations for a period of six months.
That extension eliminated the Pennsylvania statute of limitations as a defense
because the Plaintiff commenced her case within the aforesaid time period.

paragraphs 14 -15 of the Defendant's New Matter are conclusions of law to

17 - 26. Denied as alleged. The Plaintiff avers to the contrary that the
record speaks for itself and that no reply is required under the Pennsylvania
Rules of Civil Procedure and strict proof thereof is demanded at time of trial.
Under the bankruptcy laws, as the Defendant admits, her claim against the
above Defendant was an asset of her estate. Consequently, the bankruptcy laws
governed the above action on the basis of federal preE!mption. The extension for
initiation of suits under the bankruptcy laws therefore made the Plaintiff's case's
initiation timely and not barred by the Pennsylvania statue of limitations.

Pursuant to Pa.R.c.P. 1035.2, Defendant, Jennifer Lynne Erdman, by her attorneys, Brigid
Q. Alford, Esquire, and Boswell, Tintner, Piccola & Wickersham, presents her Motion for Summary
Judgment as follows:
1. This case arises from a December 24, 1999 motor vehicle accident from which
Plaintiff claims to have suffered damages.
2. On August 31, 2001, Plaintiff filed a Chapter 7 Bankruptcy proceeding in the United
States Bankruptcy Court for the District of New Jersey, at Docket # 01-39839.
3. On October 10, 2001, the Trustee filed a Report of No Distribution (No Asset
Report) in the Plaintiffs bankruptcy action.
4. On December 10,2001, the United States Bankruptcy Court for the District of New
Jersey entered an Order of Discharge in Bankruptcy in the Plaintiffs bankruptcy case.
5. On June 10,2002, Plaintiff initiated this case by filing a Writ of Summons in this
Court.
6. On July 29,2002, Plaintiff filed her Complaint against Defendant in the Cumberland
County Court of Common Pleas.
7. In Paragraph 5 of her Complaint, Plaintiff alleges that the motor vehicle accident
occurred on December 24, 1999.
8. Counsel for Defendant thereafter filed a Motion for Leave of Court to Close
Proceedings and Proceed with Civil Action, which motion the Court granted by Order dated
November 7, 2002. True and correct copies of Defendant's motion, and the Court's Order, are
attached hereto as Exhibits A and B, respectfully.
9. On November 14, 2002, Defendant filed her Answer and New Matter to the
Complaint, along with the appropriate Notice to Plead, denying the material allegations of the
Complaint and asserting as to New Matter the affirmative defense of the Statute of Limitations. A
true and correct copy of Defendant's Answer and New Matter is attached hereto as Exhibit C.
10. In Paragraph 5 of her Answer and New Matter, Defendant admits that the accident
occurred on December 14, 1999.
II. On December 3, 2002, Plaintiff filed her Reply to Defendant's New Matter. A true
and correct copy of Plaintiffs Answer to New Matter is attached hereto as Exhibit D.
12. In Paragraph 12 of Plaintiffs Answer to New Matter, Plaintiff admits that she
commenced the within action on June 10, 2002, by filing a Prael~ipe for Writ of Summons.

13. Plaintiffs claim is based in negligence, which is subject to a two-year statute of
limitations. 42 Pa.C.S.A. 9 5524(3).
14. Plaintiff commenced the instant litigation against Defendant on June 10,2002, more
than two years after the occurrence of the alleged negligent act.
15. Federal bankruptcy laws do not toll the statute oflimitations as it relates to the
Debtor/Plaintiff in this case.
16. The pleadings in this matter are closed; there is no genuine issue of material fact, and
the matter is ripe for the entry of summary judgment in Defendlmt's favor as a matter oflaw.
WHEREFORE, Defendant Jennifer Lynne Erdman respectfully requests that this Honorable

Defendant Jennifer Lynne Erdman, through her attorneys, Brigid Q. Alford, Esquire and

Pleadings and Proceed with Civil Action, as follows:
1. This case stems from a December 24, 1999, motor vehicle accident from which
Plaintiff claims to have suffered damages
2. On or about June 10, 2002, Plaintiff initiated this case by filing a Writ of Summons
in this Court. A true and correct copy of Plaintiffs Writ of Summons is attached hereto as Exhibit
A.
3. On or about July 1, 2002, Defendant filed a Praecipe for Rule to File Complaint. A
true and cOrrect copy Defendant's Rule to File Complaint is attached hereto as Exhibit B.

4. On July 12, 2002, Plaintiffs counsel informed Defendant's counsel that the Plaintiff
had filed bankruptcy in the Bankruptcy Court for the District of New Jersey and that the Automatic
Stay prevented further proceedings in the instant civil action. A true and correct copy of Plaintiffs
counsel's correspondence is attached hereto as Exhibit C.
5. On July 22,2002, Defendant's counsel informed Plaintiffs counsel that the
Bankruptcy Court had discharged Plaintiff s bankruptcy case as a. no-asset case, as of December 10,
2001. A true and correct copy of Defendant' s counsel's correspondence is attached hereto as Exhibit
D.
6. On July 29,2002, Plaintiff filed her Complaint, a. true and correct copy of which is
attached hereto as Exhibit E, and in which Complaint Plaintiff alleges the accident at issue to have
occurred on December 24, 1999.
7. Subsequently, Plaintiffs counsel re-asserted to d,~fense counsel that Plaintiffs
bankruptcy case was still pending, and served as a statutory impediment to any further action being
taken to advance the case at bar,
8. As a result of the representations of Plaintiffs counsel of record in this case
regarding the bankruptcy action, Defendant has been stayed from filing her Answer and New Matter
to the Complaint, and otherwise advancing her defense in this case.
9. Defendant's counsel thereafter endeavored to elicit written confirmation from
Plaintiffs Pennsylvania personal injury counsel, from Plaintiffs New Jersey bankruptcy counsel,
from the United States Bankruptcy Trustee, and from the United States Bankruptcy Court for the

District of New Jersey to establish whether or not the bankruptcy case had been discharged, or was
still open.
10. The only responses received to the requests enumerated in Paragraph 8, above, were
in the form of certified copies of the Docket Entries and Order of Discharge from the aforesaid
Bankruptcy Court establishing, to wit:
(a) That on October 10, 2001, the Chapter 7 Trustee filed a
Report of No Distribution regarding Plaintiffs bankruptcy
proceeding; and
(b) That on December 10, 2001, the United States Bankruptcy
Court for the District of New Jersey entered an Order of
Discharge; and
(c) That on January 17,2002, the United States Bankruptcy Court
for the District of New Jersey entered a Final Decree, closing
the Plaintiffs bankruptcy proceeding.
These certified records are attached hereto as Exhibits F and G.
11. Defendant believes, and therefore avers, that Plaintiff s bankruptcy case is closed and
the automatic stay is no longer in effect.
12. Plaintiff continues to maintain that the Automatic: Stay is still in effect, thereby
preventing further action in the instant lawsuit.
13. On October 22,2002, Defendant's counsel again requested that Plaintiffs counsel
provide any documentation that he may have supporting his assertion that the Automatic Stay is still
in effect. Plaintiffs counsel's letter of October 22, 2002, is attached hereto as Exhibit H.
14. Plaintiff has provided no such documentation.

15. Plaintiffs unsupported oral assertion that the Automatic Stay is still in effect is in
direct conflict with the certified docket entries in Plaintiff s bankruptcy proceeding. See Exhibit D.
16. Defendant seeks an Order permitting her to commence discovery and for leave of

otherwise advance her defense..

1, The Plaintiff Carman L. Shalan is an adult individual with an address of
298 Lembeck Avenue, Jersey City, NJ 07302.
2. The Defendnat Jennifer Lynne Erdman is an adult individual with an
address of 1100 Yverdon Drive, #8-4, Camp Hill, Pennsylvania 17011.
3. At all times releveant herein the Plani5tff was the operator of a certain
1991 Dodge Caravan,
4. At all times relevant herein, the Defendnat Jennifer Lynne Erdman was
the operator of a certain 194 Saturn.
5. On December 24,1999 at or about 8:05 p.m., the Plaintiff was lawfully
operating her vehicle on the 200 block of Gettysburg Pike, Upper Allen
Township, Cumberland County, Commonwealth of Pennsylvania.
6. On the same date and time, the Defendant was operating her vehicle
and pulled out from a parking lot directly in front of the 1=>laintiffs vehicle and
collision between the two vehicle occurred.

7. The aforesaid collision came about solely because of the carelessness,
recklessness and negligence of th~ Defendant in that:

a.) she failed to yield the right of way to the Plaintiff's vehicle that was
lawfully proceeding on the aforesaid road;

e.) after failing to yield the right of way to the Plaintiiffs oncoming vehicle
she pulled out of the parking lot directly into the pat:h of the Plaintiffs
vehicle.
8. Solely as a result of the Defendant's carelessness, recklessness and
negligence, the Plaintiff suffered severe and sundry injuriEls ot her person.
9. solely as a result of the carelessness, recklessness and negligence of
the Defendant, the Plaintiff is entitled to the following past: and future elements of
damage:

Dear David:
When I last wrote you in July concerning the status of this case, I told you that Attorney
Kartzman, the Trustee assigned to Ms. Shalan's bankruptcy, had informed us that the bankruptcy
matter was still open, notwithstanding the docket enpi.es reflecting discharge of the case in
December, 2001. In due course, I have asked both the Trustee and Attorney Low to provide me with
some type of written verification confirming this fact. They have not responded.
Additionally, I have now obtained certified copies of both the Docket Entries from Ms.
Shalan's bankruptcy action and her December 10, 2001 Discharge from the United States
Bankruptcy Court for the District of New Jersey. Certi:5.ed as of September 10, 2002, these
documents confirm that, in fact, a Report of No Distribution was filed on October 10,2001, that the
Discharge Order was entered on December 10, 2001, and that the Final Decree was entered on
January 17,2002.
Recognizing that the New Jersey Trustee oversees literally thousands of bankruptcy cases,
I am now inclined to believe that he was simply mistaken about the status of Ms. Shalan's case, and
that the Discharge Order is valid. As a result, I see no reason why we cannot proceed with the
Cumberland County case at hand.

Pursuant to Pa.R.C.P. No. 1019, and this Court's Order of November 7, 2002, Defendant

Wickersham, answers Plaintiffs Complaint, as follows:
1. Defendant is without knowledge or information sufficient to form a belief as to the
truth of the averments in Paragraph 1 of the Complaint; the samf: are therefore denied.

5. Admitted only that Plaintiff was operating her vehicle in the 200 block of Gettysburg
Pike, Upper Allen Township, Cumberland County on or about 8 :05 p.m. on December 24, 1999; the
allegations as to lawful operation set forth conclusions oflaw to which no response is required.
6. Admitted only the Defendant was operating her vehicle and commenced an exit from
a parking lot on the same date and time, at which time a collision between her vehicle and Plaintiff s
vehicle occurred; the balance of Paragraph 6 is denied.
7. Paragraph 7 sets forth a conclusion oflaw to whi(:h no response is required. To the
extent a response is deemed required, Defendant:
(a) denies that she failed to yield the right of way to the
Plaintiffs vehicle;
(b) denies that she failed to see the Plaintiffs vehicle
approaching;
(c) denies that she failed to avoid striking the Plaintiff s vehicle,
to the extent that such averment implies :my liability on the
part of the Defendant;
(d) denies that she struck the Plaintiff s vehicle, to the extent that
such averment implies liability on the part of the Defendant;
(e) denies that she failed to yield the right of way to the
Plaintiff's oncoming vehicle and that she pulled out of the
parking lot directly into the path of the Plaintiffs vehicle.
8. The allegations as to carelessness, recklessness and negligence set forth conclusions
oflaw to which no response is required. As to the allegations ofinjury and damage, Defendant is
without knowledge or information sufficient to form a belief as to the truth of those averments; the
same are therefore denied.

NEW MATTER
10. Defendant incorporates herein by reference her answers as set forth in Paragraphs 1
through 9, above.
11. Plaintiff s Complaint fails to set forth a claim upon which relief can be granted.
12. Plaintiff initiated this action by filing a Praecipe for Writ of Summons on June 10,
2002.
13. The applicable statute of limitations bars Plaintiff's claims.
14. Pennsylvania's comparative negligence statute and/or ,the doctrine of contributory
negligence bars, restricts or diminishes Plaintiff s claims.
15. Plaintiff s injuries and losses, if any, were caused by the actions and/or omissions of
persons other than Defendant.
16. On August 31, 2001, subsequent to the date of the accident at issue, Plaintiff filed a
Petition for Relief under Chapter 7 of the United States Bankruptcy Code in the United States
Bankruptcy Court for the District ofN ew Jersey, at Docket # 01..39839. True and correct copies of
the Plaintiffs Chapter 7 Petition for Relief, with attached schedules, and the Docket Entries from

her bankruptcy action, are attached hereto, made part hereof, and identified as Exhibits A and B,
respectively.
17. At no time between the date of the accident and the date on which she filed her
Petition for Relief in Bankruptcy did Plaintiff commence litigation against Defendant on a cause of
action relating to the accident at issue.
18. Within Schedule B of her Bankruptcy Petition, Pla.intiff identifies her purported tort
claim against Defendant Erdman as an asset of her bankruptcy esta.te, and lists the date of the alleged
tort on the same schedule.
19. At no time during the course of Plaintiff s bankruptcy proceeding did Plaintiff, or the
United States Bankruptcy Trustee assigned to her case, commence litigation against Defendant on
a cause of action relating to the accident at issue.
20. On October 10, 2001, the Trustee filed a Report of No Distribution (No Asset
Report) in the Plaintiffs bankruptcy action.
21. At no time between the filing of the Report of No Distribution and the expiration of
the applicable statute oflimitations did Plaintiff or the United States Bankruptcy Trustee commence
litigation against Defendant on a cause of action relating to the accident at issue.
22. On December 10, 2001, the United States Bankruptcy Court for the District of New
Jersey entered an Order of Discharge in Bankruptcy in the Plaintiffs bankruptcy case.
23. At no time between the entry of the Order ofDisc:harge and the expiration of the
applicable statute of limitations did Plaintiff or the United States Bankruptcy Trustee commence
litigation against Defendant on a cause of action relating to the accident at issue.

24. On January 17, 2002, the United States Bankruptcy Court for the District of New
Jersey issued its Final Decree, formally closing Plaintiffs bankruptcy case.
25. At no time prior to the issuance of the Final Decree did Plaintiff or the United States
Bankruptcy Trustee commence litigation against Defendant on a cause of action relating to the
accident at issue.
26. Plaintiffs claims are barred, restricted or diminished as a result of her discharge in
bankruptcy.
27. Plaintiffs causes of action are barred, restricted or diminished by the provisions of
Pennsylvania's Motor Vehicle Financial Responsibility Law and/or Plaintiff s policy of automobile
insurance.
WHEREFORE, Defendant Erdman demands judgment he entered in her favor and against
the Plaintiff.

Under the bankruptcy laws, as the Defendant admits, her claim against the
above Defendant was an asset of her estate. Consequently, the bankruptcy laws
governed the above action on the basis of federal preemption. The extension for
initiation of suits under the bankruptcy laws therefore made the Plaintiff's case's
initiation timely and not barred by the Pennsylvania statue of limitations.

In this negligence action for personal injuries and property damage arising out of
an automobile accident, the court currently has before it for disposition Defendant's
Motion for Summary Judgment. Defendant argues, that the statute of limitations
applicable to Plaintiffs claims ran prior to the commencement of the action, while

Plaintiff.
F or the reasons stated in this opinion, Defendant's motion will be granted.
STATEMENT OF FACTS
This case stems from an automobile accident that occurred on December 24, 1999,
in the 200 block of Gettysburg Pike, Upper Allen Township, Cumberland County,
Pennsylvania. 1 On August 31, 2001, Plaintiff filed a Petition for Relief under Chapter 7
of the United States Bankruptcy Code in the United States Bankruptcy Court for the
District of New Jersey.2 The Bankruptcy Court, according to Defendant and certified
court documents submitted by Defendant, entered an Order of Discharge in Bankruptcy
in Plaintiff s case on December 10, 2001.3

Plaintiff commenced the present action on June ,1 0, 2002, by filing a Praecipe for
Writ of Summons.4 Plaintiffs Complaint was filed on July 29, 2002.5 Defendant's
Answer to Complaint with New Matter, raising the issue of the statute of limitations, was
filed on November 14, 2002.6 Plaintiffs Reply to the Defendant's New Matter was filed
on December 3, 2002, asserting that the statute of limitations was extended because
Plaintiff had filed for bankruptcy. 7
Defendant filed a Motion for Leave of Court To Close Pleadings and Proceed with
Civil Action on November 7, 2002.8 This motion was granted by the Honorable George
E. Hoffer, President Judge of this Court, in an order dated November 7, 2002.9
Defendant then filed a Motion for Summary Judgment on December 12, 2002,
which is currently before the Court for disposition. 10 'Defendant argues that the action
should be dismissed because the statute of limitations had run prior to the commencement
of the action, II Plaintiff did not file an answer to this motion. However, in her brief
Plaintiff argues that the statute of limitations had not run because the period within which
a complaint could be filed by Plaintiff, a debtor in bankruptcy, was extended by 11
U.S.C, 108(a).12 Both parties submitted briefs to the court and oral argument was held on
February 12,2003.

Statement of Law
Pennsylvania law provides, in pertinent part, as follows with respect to limitations
of actions:
The following actions and proceedings must be commenced within two
years:
(2) An action to recover damages for injuries to the person. . . .
(3) An action for taking, detaining or injuring personal property. . . ,
Act of Ju!. 9, 1976, P.L. 586, ~ 2, as amended, 42 Pa. C.S.A. ~ 5524 (West Supp. 2002).
United States Bankruptcy law provides, in relevant part, as follows:
(a) If applicable nonbankruptcy law. . . fixes a period within which the
debtor may commence an action, and such period has not expired before the
date of the filing of the petition, the trustee may commence such action
only before the later of:
(1) the end of such period, including any suspension of such period
occurring on or after the commencement of the case; or
(2) two years after the order for relief.
11 U.S,C, 108(a),
The Pennsylvania Commonwealth Court has held that, "by its clear terms, Section
108's extension of time is applicable only to the trustee, not the debtor [in bankruptcy]."
Solar Construction Company, Inc, v, Department of General Services, 105 Pa. Commw,
609,615,525 A.2d 28,31 (1985) (emphasis in the original),
On a summary judgment motion, the non-moving party "may not rest upon the
mere allegations or denials of the pleadings but must file a response within thirty days
after service of the motion" that identifies:
(1) one or more issues of fact arising from evidence in the record
controverting the evidence cited in support of the motion or from a
challenge to the credibility of one or more witnesses testitying in support of
the motion, or
3
(2) evidence in the record establishing the facts essential to the cause of
action or defense which the motion cites as not having being produced.
Pa. R.C.P. 1035.3(a)
"Summary judgment may be entered against a party who does not respond." Pa.
R.C.P, 1035.3(d).
Application of Law to Facts
The Plaintiff, as a debtor and not a trustee in bankruptcy, can not benefit from the
extension of time provided by 11 D.S.C. 108(a). Solar Construction Company, Inc, v.
Department of General Services, 105 Pa. Commw, 609, 615, 525 A,2d 28,31 (1985); 11
D.S.C. 108(a). Accordingly, because there is no applicable extension of time under
federal bankruptcy law, the normal limitation period of two years on the current action
controls. See 42 Pa. C.S,A. 9 5524. The accident which gave rise to the instant action
occurred on December 24, 1999, and Plaintiffs Praecipe for Writ of Summons was filed
on June 10, 2002, or almost two and one-half years after the accident. Therefore, the
statute of limitations bars this action and the following order will be entered:
