THIS AGREEMENT made the ..ffO~day of_~_~t~.e,f_ 2002, by and between
RO___Y SHEAFFER. ROY SHEAFFER D_RYW_AL_L (hereinafter referred to as "CONTRACTOR,,),
and ROGER RUSSELL (hereinafter referred to as "OWNER"). The OWNER is acting as his own
General Contractor concerning the hereinafter referred to property, and the OWNER AND
CONTRACTOR have entered into an agreement (herein "AGREEMENT,,) whereby the
CONTRACTOR undertook and agreed to do the following work:
.~H~ on the erection and construction or repair and/or renovation of the building of
OWNER's, which is situated on that certain lot of ground owned by OWNER and situate in Penn
Township, Cumberland County, Pennsylvania, which is more particularly described in Deed dated
February 12, 2002, and recorded in the office of the Recorder of Deeds in and for Cumberland
County, Pennsylvania, in Deed Book 250, Page 1803.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the CONTRACTOR,
for and in consideration of the sum of(S1.00) Dollar to CONTRACTOR in hand paid by OWNER,
the receipt whereof is hereby acknowledged, and the further consideration mentioned in the above
referred to Agreement between the parties, for CONTRACTOR and all of CONTRACTOR,s
subcontzactors (and all parties acting through or under them), covenants and agrees that no
mechanic's liens or claims shall be filed or maintained by it or them or any of them against the
building(s) and the lot of ground upon which the building is situated (as referred to above) for or on
account of any work done or materials fun'fished by them or any of them under the Agreement or
otherwise, for, towards, in, or about the repair or renovation or erection and construction of the
building(s) on the lot referred to above, and the CONTRACTOR, for themselves, their
subcontractors and others under them, hereby expressly waive and relinquish the fight to have, file,
and maintain any mechanic's liens or claims against the buildings or lot, and agree that this
instrument, waiving the right of lien, shall be an independent covenant.
