PETITION FOR DETERMINATION OF TITLE OF REAL ESTATE
Petitioners, Edward C. Leithead, Mary C. Leithead, and Phyllis L. Martin, by their
attorneys, Broujos & Gilroy, P.C., set forth the following:
1.
Petitioner Edward C. Leithead is an adult individual residing at 133 Fairmont Avenue,
Chatham, NY 07928-1835.
2.
Petitioner Mary C. Leithead is an adult individual residing at 221 South College
Street, Carlisle, P A 17013.

The above referenced Veronica M. Leithead, Decedent, died on February 7, 1964.

The Decedent died a widow survived by her three children, the Petitioners herein.

The Decedent's Will listed that the three Petitioners would share equally in the
Decedent's estate (see copy of the Will attached hereto and marked as Exhibit A).

At the time of the Decedent's death, the Decedent owned real estate located within
the Borough of Carlisle, Cumberland County, Pennsylvania, at 221 South College
Street, Carlisle, P A (hereinafter referred to as the "Real Estate").

The real estate was listed as an asset of the Decedent on the Pennsylvania
Inheritance Tax Return filed (a copy of which is attached hereto and marked as
Exhibit B) and appropriate inheritance taxes were paid on the real estate. Said
filings were made at File No. 2093 and Tax Book No.7, Page 54-36.

Subsequent to the filing of a Pennsylvania Inheritance Tax Return, no further
action was taken in connection with the Decedent's estate and the Real Estate
remains titled in the Decedent's name.

All three Petitioners claim an equal interest in the Real Estate as the three
beneficiaries pursuant to the Will.

Petitioners file this Petition pursuant to 20 Pa.C.S.A. ~3546 which allows the Court
to make a determination concerning the title to a Decedent's interest in real estate.

The undersigned attorney has performed a title search on the property and can
certify to the Court as follows:
A. Title to the Real Estate still remains in the name of Veronica M. Leithead
B. There are no liens or encumbrances on the Real Estate except an old
mortgage from 1993 in the amount of $2,000.00 which Petitioners are
confident has been paid but remains unsatisfied. Petitioners may initiate
a Quiet Title action relative to that mortgage to clear the title if required.
C. Real estate taxes for the Real Estate are current

20 Pa.C.S.A. ~3546 allows the Court to issue a decree adjudging title to the Real
Estate, after which a notice would be given "to creditors and other parties in interest"
as the Court shall direct.

The Petitioners are not aware of any creditors of the Decedent, nor are Petitioners
aware of any other parties of interest.
15.
Petitioner Mary C. Leithead has resided in the Real Estate since her Mother's death
until the current time.
WHEREFORE, the Petitioners request your Honorable Court to enter a Decree
determining the title to the Real Estate subject to the advertisement provisions as set
forth in 20 Pa.C.S.A. ~3546.

ESTATE OF VERONICA M. LEITHEAD
Notice is hereby given that Veronica M. Leithead (Decedent) died on February 7,
1964 at which time she was seized of real estate located within the Borough of Carlisle at
221 South College Street, Carlisle, P A. A petition has been filed by the Decendent's three
children, Edward C. Leithead, Mary C. Leithead, and Phyllis L. Martin (the Petitioners),
seeking a decree adjudging that the title to the real estate shall be in their names.
The Orphans' Court Division of the Court of Common Pleas of Cumberland
County at docket number has issued an Order the day of
, 2006 granting the relief requested by the Petitioners and adjudging that
the real estate at 221 South College Street, Carlisle, P A shall he titled in the name of
Edward C. Leithead, Mary C. Leithead, and Phyllis L. Martin.
Any interested party or creditor who desires to file an exception to this decree must
file it within three months from the date of said Order being the _ day of _, 2006.
Exceptions must be filed with the Orphans' Court Division of the Court of Common Pleas
of Cumberland County at Docket No. _ _ and must filed in writing with a copy sent
to the undersigned attorney.
If no exceptions are filed, the Court will confirm absolutely that the title to the real
estate shall be in the names of the Petitioners.
