RECEIPT AND RELEASE AGREEMENT
WHEREAS, Jean G. Hocker died testate on December 05,2005; and
vnIEREAS, Ben Hocker \,vas appointed as Executor under the Will of Jean G. Hocker dated
August 15, 1995, and Letters Testamentary were granted to Ben Hocker on December 15, 2005 by
the Register of Wills of Cumberland County, Pennsylvania; and
WHEREAS, Paragraph 2 of the Will of Jean G. Hocker states:
"1 direct that all the rest, residue and remainder of my estate be divided into 3 equal shares,
one such share to my son Ben Hocker, of Minnetonka, Minnesota or his issue per stirpes; one such
share to my daughter, Sally J. Aigner of Arlington Heights, Illinois, or her issue, per stirpes: and one
such share to my sister, Clara Joan Herman, of Hershey, Pennsylvania, or her issue, per stirpes. "
WHEREAS, BEN HOCKER, has the opportunity to examine the accounting of the
Executor and hereby waives any right to demand the filing of a formal court accounting by Ben
Hocker and approves the acts and transactions of the Executor in the administration of the Estate;
and
WHEREAS, it is the desire of the parties hereto that final distribution of the balance of
principal and income be made without the formality of the filing of an accounting in the above-
referenced Court, or any other court having jurisdiction the Executor previously having made an
Advance Distribution to each beneficiary named above; and
WHEREAS, Ben Hocker is willing to make such distribution upon receipt of the Release and
indemnification provided for in this Agreement.
NOW THEREFORE, KNOW ALL MEN BY THESE PRESENTS that the undersigned
does hereby request Ben Hocker to make final distribution of the balance of the Estate without the
filing of an accounting for audit and approval by the court having jurisdiction. The undersigned, in
consideration of the payment and delivery to her/him of the following:
To BEN HOCKER, the following amount:
Cash in the total amount of$5,495.98.
the receipt of which is hereby aclmowledged, for herselflhimself, herlhis heirs, personal
representatives, successors and assigns does remise, release, quit-claim and forever discharge Ben
Hocker, individually, and as Executor aforesaid; his successors and assigns, of and from all actions,
suits, payments, accounts, claims and demands whatsoever or by reason thereof, and from any suit,
payment, claim or liability arising from the administration of the Estate, and hereby agrees that any
court having jurisdiction may by its decree discharge Ben Hocker as Executor.
The undersigned further agrees to indemnify arid hold harmless Ben Hocker from and against
any and all claims, loss, liability or damage which he may suffer or to which helshe may be subjected
by reason of the settlement of the account and the distribution of assets of the said Estate without
approval of the court having jurisdiction. In consideration of the distribution to the undersigned of
the property described above, the undersigned agrees to pay Ben Hocker any amount up to the value
of the property which the undersigned received from the Executor as hislher bequest that may be
necessary in the future to discharge any liabilities of the Estate.
The undersigned further declares that it is hislher intention to be legally bound by the
execution of this Agreement and to bind hislher heirs, personal representatives, successors and
aSSIgns.
