[72 P.S. ~9116 (a) (1.1) (ii)]. The statute does not exemot a transfer to a surviving spouse from tax, and the statutory requirements for disclosure of assets and
filing a tax return are still applicable even if the surviving spouse is the only beneficiary.
For dates of death on or after July 1, 2000:
The tax rate imposed on the net value of transfers from a deceased child twenty-one years of age or younger at death to or for the use of a natural parent, an
adoptive parent, or a stepparent of the child is zero (0) percent [72 P.S. ~9116(a)(1.2)].
The tax rate imposed on the net value of transfers to or for the use of the decedent's lineal beneficiaries is four and one-half (4.5) percent, except as noted in
72 P.S. ~9116(1.2) [72 P.S. ~9116(a)(1)].
The tax rate imposed on the net value oftransfers to or for the use of the decedent's siblings is twelve (12) percent [72 P.S. ~9116(a)(1.3)]. A sibling is defined, under
Section 9102, as an individual who has at least one parent in common with the decedent, whether by blood or adoption.

JAMES T. BAUGHMAN
I, JAMES T. BAUGHMAN, of Mechanicsburg, Cumberland County,
Pennsylvania, being of sound and disposing mind, memory and
understanding, do hereby make, publish and declare this as and
for my Last Will and Testament, hereby revoking all other Wills
Codicils heretofore made by me.
FIRST
I direct the payment of my just debts and e~penses of my
illness and funeral from my estate as soon after my death as
conveniently may be done.
SECOND
give, devise and bequeath all the rest, residue and
remainder of my estate to BARBARA J. BAUGHMAN, absolutely and in
fee simple if she survives me by thirty (30) days.
THIRD
In the event that BARBARA J. BAUGHMAN fails to survive me by
thirty (30) days, then I give, devise and bequeath all the rest,
residue and remainder of my estate in equal shares unto my
nephew, PETER C. BAUGHMAN and my neice, ALLISON S. McKINSTRY, per
SAIDIS, GUIDO
&~LAND stirpes, provided, that if said beneficiaries have not attained

OH&k.~. the age of eighteen (18) years, then I give, devise and bequeath
my entire estate together with any other property which may be
added, unto WILLIAM G. BAUGHMAN, IN TRUST, upon the following
terms and conditions:

(A) To hold, manage, invest and reinvest the principal
so received, and accumulation of income thereon, and to use,
pay and apply the income and principal or so much thereof as
in Trustee's sole discretion may be necessary for the
maintenance, support, medical expenses and education of said
beneficiaries whether the same be born before or after the
signing of these presents.
(B) The payments authorized by this trust shall be
without any regard to equality of distribution among my
beneficiaries and without further responsibility to
beneficiaries or to any person taking care of said
beneficiaries. Said payments may be made by my trustee
~ directly to said beneficiaries, or such of them as my be, in
~ the sole opinion of trustee, of such age and ability to
~andle properly the funds so paid, or may be made directly
to the person having custody and care of any of said
beneficiaries, or may be made directly to any institution
entitled to such payment by reason of services rendered or
to be rendered to any of said beneficiaries.
(c) The amount to be paid for the benefit of any of my
beneficiaries shall be determined from time to time by the

need of each beneficiary, and the amounts and times of said
payments shall be determined by such need, provided that
payments be made at least monthly.
(0) All payments of principal and income hereby given
shall be free from anticipation, assignment, pledge or

obligations of beneficiaries, and shall not be subject to
any execution or attachment.
(E) All principal and accumulated income, not so
applied, shall be distributed as follows:
(1) When the oldest beneficiary attains the age
of eighteen (18) years, one-half of the principal and
accumulated income of said trust shall be distributed
to the oldest beneficiary;
(2) When the youngest beneficiary attains the age
of eighteen (18) years he shall receive the balance of
the principal and accumulated income.
FOURTH
that any and all inheritance, estate, and transfer
imposed upon my estate passing under this will or otherwise
be paid out of the principal of my residuary estate.
FIFTH
n addition to the powers conferred by law, I authorize any
personal representative acting under this instrument, in her
absolute discretion:
A. To retain in the form received, or to sell
either at public or private sale any real or personal

property;
B. To exercise any options to subscribe for
stocks, bonds, or other investments.
c. To join in any plan of lease, mortgage,
consolidation, exchange, reorganization or foreclosure

of any corporation in which my estate or any trust may
hold stocks, bonds or other securities;
D. To sell, transfer, convey, mortgage, pledge,
lease or exchange any property, real or personal, which
at any time may form part of my estate, for the payment
of debts or taxes, or for any purpose of administration
or distribution, for such prices and upon such terms
as my personal representative, in her sole discretion,
may deem wise, and to execute and deliver deeds of
conveyance or transfer thereof;
E. To make settlements and compromises on such
terms as my personal representative in her sole
discretion may deem wise without the necessity of
obtaining any court approval thereof;
F. To make distribution hereunder either in cash
or kind, as my personal representative in her discretion
may deem wise.
SIXTH
I do hereby nominate, constitute and appoint BARBARA J.
BAUGHMAN, to act as Executrix, of this my Last Will and
Testament. Provided, however, that if she is unwilling or unable
