WORMAN, Defendant : IN DIVORCE COMPLAINT IN DIVORCE UNDER SECTION 3301(c) OR SECTION 3301(d) OF THE DIVORCE CODE AND NOW comes the above Plaintiff, Sara L. Worman, by her attorney, Cara A. Boyanowski, Esquire, and seeks to obtain a decree in divorce from the above-named Defendant, upon the grounds hereinafter set forth: COUNT I DIVORCE 1. The Plaintiff, Sara L. Worman, is an adult individual who resides at 522 Springhouse Road, Camp Hill, Cumberland County, Pennsylvania 17011. 2. The Defendant, Jared N. Worman, is an adult individual who resides at 206-R Spring Lane, Enola, Cumberland County, Pennsylvania 17025. 3. The Plaintiff has been a bona fide resident of the Commonwealth ofPennsy1vania for at least six (6) months immediately prior to the filing of this Complaint. 4. The Plaintiff and Defendant were married on June 25, 1960, in Harrisburg, Dauphin County, Pennsylvania. 5. The Plaintiff and Defendant are both citizens of the United States of America. 6. Plaintiff filed a complaint in divorce against Defendant at Cumberland County Court of Common Pleas docket number 01-7083. This action was terminated and purged from the docket on November 14, 2005. Defendant filed a complaint in divorce against Plaintiff at Dauphin County Court of Common Pleas docket number 5544-CV-2001-DV. This action was withdrawn by Defendant in February 2002. 7. Plaintiff avers that there are no children born of the marriage under the age of eighteen years. 8. The Plaintiff and the Defendant are not members of the Armed Services of the United States or any of its allies. 9. Plaintiff has been advised of the availability of counseling and that she may have the right to request that the Court require the parties to participate in counseling. She has declined counseling. 10. The causes of action and sections of Divorce Code under which Plaintiff is proceeding are: A. Section 3301(c). The marriage of the parties is irretrievably broken. After ninety (90) days have elapsed from the date of the filing of this Complaint, Plaintiff intends to file an Affidavit consenting to a divorce. Plaintiff believes that Defendant may also file such an Affidavit. B. Section 3301(d). The marriage of the parties is irretrievably broken. The Plaintiff and Defendant separated in July 2000. WHEREFORE, the Plaintiff prays your Honorable Court to enter a Decree in Divorce from the bonds of matrimony. COUNT II EQUITABLE DISTRIBUTION II. Paragraphs 1 through 10 of the Divorce Complaint are incorporated herein by reference as though set forth in full. 12. Plaintiff and Defendant have acquired property, both real and personal, from the date of their marriage, June 25, 2960, until the date of their separation, July 2000. 13. Plaintiffand Defendant have been unable to agree as to an equitable division of said property. WHEREFORE, Plaintiff requests your Honorable Court to equitably divide all marital property . COUNT III ALIMONY 14. Paragraphs 1 through 10 of the Divorce Complaint are incorporated herein by reference as though set forth in full. 15. Plaintifflacks sufficient property to provide for her reasonable means and is unable to support herself through appropriate employment. 16. Plaintiff requires reasonable support to adequately maintain herself in accordance with the standard of living established during the marriage. WHEREFORE, Plaintiff requests your Honorable Court to enter an award of alimony in her favor. COUNT IV ALIMONY PENDENTE LITE, COUNSEL FEES, COSTS AND EXPENSES 17. Paragraphs 1 through 10 of the Divorce Complaint are incorporated herein by reference as though set forth in full. 18. Defendant receives employment wages through Land Rover, as a courier, and has assets that have not yet been ascertained. 19. Plaintiff has employed counsel, but is unable to pay the necessary and reasonable attorney's fees for said counsel. 20. Plaintiff is unable to sustain herself during the course of this litigation. WHEREFORE, Plaintiff requests your Honorable Court to enter an award of Alimony Pendente Lite, interim counsel fees, costs and expenses, until final hearing and thereupon award such additional counsel fees, costs and expenses as deemed appropriate. . . . Washington Mutual Loan No. 8013105641: $11,707.15 as of 11/1/06. Wife pays this loan. 2. Sovereign Bank Loan No. 6819007914: $30,302.07 as of 10/11106. Husband satisfies one-half of this home equity loan, i.e., $168.00. Wife resides in the Marital Residence. There was an understanding between the parties and Wife's mother that Wife's mother would sell her own real property, located in Harrisburg, Pennsylvania, and provide those funds to Husband and Wife, and then reside in the Marital Residence 4 . . MARITAL ASSETS as a 1/3 owner. Specifically, Wife's mother sold her real property in 1974, receiving $15,000.00. She provided this money, along with another $5,000.00 (3/1974) to Husband to purchase the Marital Residence. She also expended the sum of$14,444.00 to renovate and remodel the existing kitchen of the Marital Residence in June 1980. Since the date of the separation, she has contributed approximately $3,150.00 to the upkeep and maintenance of the Marital Residence. Retirement Assets Raymond James Retirement Account TBD Husband withdrew Account No. 73500402 approximately $6,000.00 from (Husband) this account in April 2002, specifically against the Court Order dated January 4, 2002. Wesley Oler, Jr., directing that the parties should not proceed at the divorce action pending in dauphin county. It is specifically denied that Judge 0ler's Order directed Defendant to withdraw the Divorce action in Dauphin County. 10. Denied. It is specifically denied that Defendant deliberately failed to abide by the directives of the February 26, 2002 Order of Court. By way of further answer, Defendant did not proceed on Dauphin County Court of Common Pleas Divorce .. Action docketed at number 5544 CV 2001, until after the Cumberland County case was dismissed due to inactivity. 11. Admitted in part; denied in part. It is admitted that both Plaintiff and Defendant both currently reside in Cumberland County. It is denied that the Court of Common Pleas of Cumberland County is the forum most convenient to hear the testimony of this case. By way of further explanation, Defendant resided in Dauphin County at the time he filed a Complaint in Divorce in Dauphin County. Currently, Plaintiff resides in Camp Hill, Defendant resides in Enola, undersigned counsel's office is located in Camp Hill, and Plaintiffs counsel is located in Harrisburg. Therefore, both parties residences and both parties' attorneys' offices are located closer to the Dauphin County Courthouse in Harrisburg than to the Cumberland County Courthouse in Carlisle. Dauphin County is the most convenient forum for everyone involved. It is obvious that Plaintiff is not seeking the most convenient forum, but is instead seeking the forum with the most favorable position regarding alimony. Plaintiffs forum shopping should not be supported by the Court. WHEREFORE, Defendant respectfully requests this honorable court to grant his Petition to Stay Complaint. .. Worman, Defendant, hereinafter referred to as "Husband," currently residing at 206-R Spring Lane, Enola, Cumberland County, Pennsylvania, 17025. 2. Respondent is Sara L. Worman, Plaintiff, hereinafter referred to as "Wife," currently residing at 522 Springhouse Road, Camp Hill, Cumberland County, Pennsylvania, 17025. 3. Husband filed a Complaint in Divorce in Dauphin County at docket no. 5544 CV 2001, on November 21, 2001. Said action is still pending and a Petition for Appointment of Master has been filed. At the time of filing, Husband was residing in Dauphin County. 4. Wife filed a subsequent Complaint in Divorce on December 18, 2006 in Cumberland County at the above term and docket number. 5. Husband filed a Petition to Stay Complaint in Divorce pursuant to Pa.R.C.P. 1920.6 on January 23,2007. 6. Wife filed an Answer to Husband's Petition to Stay Complaint in Divorce with New Matter on February 13, 2007. 7. Husband filed an Answer to Plaintiffs New Matter on March 9,2007 8. On March 21, 2007, the Honorable Edgar B. Bayley issued an Order denying Husband's Petition to Stay Complaint, said Order is attached hereto as Exhibit "A." 9. Husband is requesting reconsideration for the following reasons: a. The Court did not address application of Pennsylvania Rule of Civil Procedure 1920.6(b) regarding Multiple Actions, which states, "If a second action is brought in another county more than ninety days after service ofthe complaint in the first action, the second action shall be stayed until the conclusion of the first action." b. It is believed the Court may not have realized that Wife's instant action was brought over five (5) years after service of the Complaint in the action filed by Husband in Dauphin County. Therefore, Rule 1920.6(b) requires the instant action to be stayed. c. In a letter dated March 26,2007, E. Robert Elicker, IT, who was appointed divorce master on March 21, 2007, has suggested that due to his personal contact with the parties that "perhaps it is in everyone's best interest that [he] recuse [himself]." Said letter is attached hereto as Exhibit "B." There are no such issues regarding the case pending in Dauphin County. 10. Counsel for Plaintiff does not concur regarding this Request. Wesley Oler, Jr., J., on February 26,2002, "that the parties shall not proceed at the divorce action now pending in Dauphin County at no. 5544 CV. 2001 OV., be [sic] withdrawn and that the pending action in Cumberland County be the basis for jurisdiction in this divorce proceeding." We mistakenly attributed that order to the within divorce action at 06-7166 Civil Term, when in fact it was entered in a divorce action filed by wife against husband at 01-7083 Civil Term. On November 14, 2005, that divorce action was terminated with prejudice in accordance with Pa. Rule of Civil Procedure 230.2. Judge Oler's order was entered pursuant to Pa. Rule of Civil Procedure 1920.6(a). Relief under that Rule is limited to a stay of the first divorce complaint which was filed in Dauphin County. That action has not been withdrawn and the failure to comply with Judge Oler's order does not change that fact.
