WHEREAS, F & M Trust Company of 20 South Main Street, Chambersburg, Pennsylvania 17201,
is about to enter into a contract with R. S. Mowery & Sons, Inc., of 1000 Bent Creek Boulevard,
Mechanicsburg, Pennsylvania 17050, for the construction of Tenant Fit-Out Improvements for a
Branch Bank in Building #5 at Carlisle Crossings, 214A Westminster Drive, South Middleton
Township, Carlisle, Pennsylvania 17013.
NOW, December 15, 2006, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said F & M Trust Company to the said
R. S. Mowery & Sons, Inc., to commence work on the said building, or purchase materials for the
same in consideration of the making of the said contract with R. S. Mowery & Sons, Inc., and the
further consideration of One Dollar to R. S. Mowery & Sons, Inc., paid by F & M Trust Company,
it is agreed that no lien shall be filed against the building or property by the contractor, nor any
subcontractor, nor by any of the material men or workmen nor any other person for any labor, or
materials purchased, or extra labor or materials purchased for the completion of said building, the
right to file such liens being expressly waived.
