1. Plaintiffs are JeffLong and Linda Long, husband and wife, who reside at 9002 Kingswood
Road, Southport, FL32409.
2. In addition to the Plaintiffs, Jeff and Linda Long, the child which is the subject of this
Complaint, Robi Annette Romo, reside together at the above address.
3. Robi Annette Romo was born in Carlisle, Cumberland County, Pennsylvania on
September 2,1997, to Defendant Eloria Annette Romo DeWalt and Robert Andrew Gause. Said Robert
Andrew Gause is deceased. The present and all past addresses (since the birth of Robi) for Eloria Annette
Romo DeWalt are unknown.
4. Robi Annette Romo was abandoned since around the age oftwo (2) to the custody ofher
grandmother (Defendant's mother) Donna A. Trutt, and her husband, Robert Trutt, Jr., who reside at 151
North Middleton Road, Carlisle, Cumberland County, Pennsylvania 17013.
5. On Apri128, 2004, Donna and Robert Trutt received a Power of Attorney with regard to
Robi from Robi's mother, Defendant, a copy of which is attached hereto as Exhibit "A."
6. No custody actions or court orders of anykind have been filed with regard to Robi Annette
Romo.
7. Robert A. Trutt, Jr. and Donna A. Trutt reside at 151 North Middleton Road, Carlisle,
Cumberland County, Pennsylvania 17013, with the following:

8. Robi Annette Romo have resided with Robert and Donna A. Trutt since around the age
of two (2) and until Christmas 2006.
9. Robert and Donna Trutt are unable to continue to take care of Robi due to family conflicts
and economic reasons.
10. Plaintiffs are Robi's great-aunt and uncle and are willing to care for her; in fact, they are
the only family members willing and able to care for her.
11. Defendant has given birth to five children, all of whom have been abandoned, as follows:
a. Coda Romo, age 13, presently in placement by the Juvenile Court;
b. Robi Romo, age 9, the subject of this action;
c. Esai DeWalt, age 7, who resides with her grandparents, William and Nancy
DeWalt, in Carlisle, Pennsylvania;
d. Isabel Romo, age 3, who resides with her grandparents, Robert and Donna Trutt;
and
e. Natalia Romo, age 2, who resides with her aunt, Dominique Govea,130 Porter
Street, Carlisle, Pennsylvania.
12. Defendant's whereabouts have been unknown for some time. Her mother, Donna A. Trutt,
who joins in this action in support ofPlaintiffs, hears from her episodically, perhaps annually. Donna A.
Trutt last heard from her daughter, Defendant in this action, in June 2006, when Defendant called to say
that she had just returned from Mexico and was living somewhere in California.
13. Upon reasonable investigation, the present whereabouts of Defendant, Eloria Annette
Romo DeWalt, cannot be determined.
14. Robi Annette Romo also expresses a desire to be removed from the Trutt household and
to live with Jeffand Linda Long; in fact, she is currently living with Jeffand Linda Long. It is necessary that
a custody order ratify this arrangement so that Jeff and Linda Long have the proper authority to provide
for Robi's education, health care, etc.
WHEREFORE, Plaintiffs request Your Honorable Court to issue an Order granting them sole legal
and physical custody of Robi Annette Romo, born September 2, 1997.

Long, have agreed to be the custodians ofRobi. I am in agreement with this and Believe it to be in Robi's

it is hereby directed that parties and their respective counsel appear before Jacqueline M. Verney, Esq. , the conciliator,
at 4th Floor, Cumberland County Courthouse, Carlisle on Tuesday, February 06, 2007 at 9:30 AM
for a Pre-Hearing Custody Conference. At such conference, an effort will be made to resolve the issues in dispute; or
if this cannot be accomplished, to define and narrow the issues to be heard by the court, and to enter into a temporary

authorizing them to make all decisions regarding the child. The maternal grandparents
transferred custody of the child to the plaintiffs on Christmas Day, 2006. The
grandparents, the great aunt and uncle and the child want the child to remain in the
custody of great aunt and uncle.

PETITION FOR MODIFICATION OF CUSTODY
AND NOW, comes Petitioners, Donna Trutt and Bob Trutt, by and through their
counsel, Jane Adams, Esquire, and petitions the Court as follows:
1. Donna Trutt and Bob Trutt, Petitioners, (hereinafter referred to as
"Petitioners"), joined in the above-captioned matter, pursuant to the custody complaint
filed on or about December 29, 2006. They currently live at 1738 McClure's Gap Road,
Carlisle, Pa. 17015.
2. Plaintiffs are Jeff Long and Linda Long (hereinafter referred to as"Plaintiffs"),
who currently live at 20942 Three Notch Road, Lexington Park, Maryland, 20653.
3. Pursuant to the prior Order in this case, (a copy of which is attached as
Exhibit A), Plaintiffs had sole legal and physical custody of Robi Annette Romo, born
September 2, 1997.
4. Defendant, Eloria Annette Romo Dewalt, (hereinafter referred to as "Mother")
is the Natural Mother of the child. She is currently incarcerated at the Smith
Correctional Facility in Banning, California.
5. Plaintiffs have indicated that they can no longer care for the child.
6. Plaintiffs and Petitioners agree that it would be in the best interest of the child
to reside with Petitioners, Donna and Bob Trutt, who can provide her a loving and
stable home.
7. Petitioners are maternal grandmother and step-grandfather of the child and
have custody of the child's half-sibling, namely, Isabel Romo (born 6/1/2003) pursuant
to Court Order.
8. It is not known whether Mother would consent to this stipulation, as she is
currently incarcerated and contact with her has been limited.
9. It is believed that Mother will be released from the correctional facility in July,
however, it believed that Mother will not be able to provide an adequate home for the
child immediately after her release.
10. Petitioners are requesting that the current custody Order be modified to
provide that they have physical and legal custody of the child. (A copy of the
agreement between Plaintiffs and Petitioners is attached as Exhibit B).
11. It would be in the best interest of the child to modify this Order because a
substantial change of circumstances has occurred and the prior agreement and Order
does not adequately provide for the child.
12. It is believed and averred that the best interest and permanent welfare of the
child will be promoted by changes proposed in this custody petition because the
modification will ensure the child's well being.
WHEREFORE, Plaintiff requests the court to set a conciliation date to examine
issues regarding custody of the child.

Pa.C.S. §5309, Donna and Bob Trutt shall be entitled to all records and information
pertaining to the child, including, but not limited to, medical, dental, religious, or school
records.
2. Donna Trutt and Bob Trutt shall have sole physical custody of'Robi Annette
Romo, born September 2, 1997. Jeff and Linda Long and Eloria Annette Romo
Dewalt shall have visitation with the child as agreed.
3. The parties request that the terms of this agreement be incorporated into a
court Order.

to the plaintiffs, the child's great aunt and uncle. The great aunt and uncle have relocated
to Maryland and can no longer care for the child. They have signed a stipulation agreeing
that the maternal grandparents should have sole legal and sole physical custody of the
child. The maternal grandparents have custody of a half sibling and are willing to accept
sole legal and sole physical custody of the child.
2. The parties present agreed to an Order in the form as attached.
