Wright ("Petitioners"), by and through their counsel, Rhoads & Sinon LLP, and hereby petition this Court to permit the filing under seal of the Pennsylvania Inheritance Tax Return of the Estate ofChevez A. Wright with the Office of the Register of Wills of Cumberland County and to order the sealing of all records related thereto. In support thereof, Petitioners state as follows: 1. Petitioners were the parents of Chevez A. Wright, who passed away on December 17,2003. 3. Petitioners filed a wrongful death suit against UGI Utilities, Inc. as well as a survival action against UGI Utilities, Inc. on behalf of Chevez A. Wright, No. 04-1183. 4. The wrongful death suit and the survival action were settled pursuant to a "Settlement and Confidentiality Agreement and General Release" (the "Agreement'') executed by James Brian Wright and Amy Wright, individually and as Administrators of the Estate of Chavez A. Wright, and UGI Utilities, Inc. on November 30, 2005. 5. Under Paragraph 12 of the Agreement, the parties to the Agreement are precluded from revealing any of the terms of the Settlement Agreement and Release. Paragraph 12 of the Agreement reads in full as follows: ''The Parties mutually agree that neither they nor their attorneys nor their representatives shall reveal to anyone (other than may be mutually agreed to in writing, or as required by a pertinent rule of civil procedure, or in response to a court order), any of the terms of this Settlement Agreement and Release or any of the amounts, numbers or terms of conditions of any sums payable to Plaintiffs hereunder, except as required by existing statutes and/or governing laws." 6. Judge Guido placed the placed the pleadings and records pertaining to the civil action under seal. 7. Pursuant to Section 2136 of the Inheritance and Estate Tax Act, 72 P.S. ~2136, Petitioners, as Co-Administrators of the Estate ofChevez A. Wright, are responsible for the filing of the Pennsylvania Inheritance Tax Return for the Estate. 8. Notwithstanding that no tax is due on the assets received by the Estate, the Department of Revenue has asked that an information return be filed for the Estate. " 9. Petitioners desire to comply with the statutory obligation to file a Pennsylvania Inheritance Tax Return, but do not want to violate the terms of the Agreement. 10. Accordingly, Petitioners desire that the Pennsylvania Inheritance Tax Return of the Estate of Chevez A. Wright be filed under seal with the Office of the Register of Wills of Cumberland County, and that the Inheritance Tax Return, and all records pertaining thereto, be sealed from public record. WHEREFORE, Petitioners respectfully request that the Court issue an Order that the filing of the Pennsylvania Inheritance Tax Return for the Estate of Chevez A.
