FINAL DISTRIBUTION FAMILY AGREEMENT
THIS AGREEMENT is by and between Wilbert E. Wertz, Jr., individually and as Executor
of the Estate of Virginia L. Wertz, Deceased, David C. Miller, Jr., Esquire, Counsel for the Estate,
Norman E. Wertz of New Cumberland, Pennsylvania, as heir of the Estate, Linda K. Bender ofY ork
Haven, Pennsylvania, as heir of the Estate, Joanne 1. Eagan of Wilmington, Delaware, as heir of the
Estate, Debra A. Scott of Lewisberry, Pennsylvania, as heir of the Estate, and Wilbert E. Wertz, Jr.
of Middletown, Pennsylvania, as heir of the Estate.
WHEREAS, Virginia L. Wertz, who resided at 145 15th Street, New Cumberland,
Cumberland County, Pennsylvania, 17070, died on April 20, 2005, with a Will, and whose Estate
was opened on June 3, 2005, at the above number and term; and
WHEREAS, Wilbert E. Wertz, Jr. has been appointed Executor of the Estate of Virginia L.
Wertz, Deceased; and
WHEREAS, the parties in interest for purposes of distribution of the Estate of Virginia L.
Wertz, Deceased, are:
(1) Norman E. Wertz, Son, and
(2) Linda K. Bender, Daughter, and
(3) Joanne 1. Eagan, Daughter, and
(4) Debra A. Scott, Daughter, and
(5) Wilbert E. Wertz, Jr., Son; and
WHEREAS, each of the above identified parties is entitled to a one-fifth (1/5) distributive
share of the residuary estate; and
WHEREAS, it is the desire of the parties to this Agreement that final distribution of this
Estate be accomplished without formal accounting to the Orphans' Court Division of the Court of
Common Pleas, Cumberland County, Pennsylvania; and _" ,:j8

A. Distribution in kind:
Personal Property - $437.00 to Norman E. Wertz, Linda K. Bender, Joanne
1. Eagan, Debra A. Scott, and Wilbert E. Wertz, Jr., for a total distribution of
$2,185.00.
B. August 18, 2006 - Partial Distribution - $13,000.00 cash paid to Norman E.
Wertz, Linda K. Bender, Joanne 1. Eagan, Debra A. Scott, and Wilbert E.
Wertz, Jr., for a total distribution of $65,000.00.
C. December 1,2006 - Final Distribution - $3,241.93 cash paid to Norman E.
Wertz; $3,241.92 cash paid to Joanne 1. Eagan, Debra A. Scott and Wilbert
E. Wertz, Jr.; for a total distribution of $12,967.69. Linda K. Bender
acknowledges that she received a $1,000.00 loan that needs to be repaid to
the Estate before final distribution. Linda K. Bender owes the Estate
$1,000.00 and her final distribution is reduced to $2,241.93. The total ofthe
final distribution is $15,209.62.
WHEREAS, the parties to this Agreement each acknowledge the proposed schedule of
distribution as stated above; and
WHEREAS, Norman E. Wertz, as a party to this Agreement, does acknowledge to have
received from the Executor the sum of Sixteen Thousand Six Hundred Seventy-Eight and 93/100
Dollars ($16,678.93); and, Joanne 1. Eagan, Debra A. Scott and Wilbert E. Wertz, Jr., as parties to
this Agreement do acknowledge to have received from the Executor the sum of Sixteen Thousand
Six Hundred Seventy-Eight and 92/1 00 Dollars ($16,678.92) each, as distributions evidenced by the
signatures of the parties on this Agreement. Linda K. Bender, as a party to this Agreement, does
acknowledge to have received from the Executor the sum of Fifteen Thousand Six Hundred Seventy-
Eight and 93/100 Dollars ($15,678.93), as distributions evidenced by her signature on this
Agreement.
NOW, THEREFORE, WITNESSETH, in consideration of the mutual promises, covenants
and agreements recited herein the parties do agree as follows:
1. Each of the parties to this Agreement as heirs does hereby release and forever
discharge David C. Miller, Jr., Esquire, Counsel for the Estate of Virginia L. Wertz,
and Wilbert E. Wertz, Jr., Executor, from any and all liability which may from time
to time arise in connection with services rendered as Counsel to the Estate and as
Executor of the Estate of Virginia L. Wertz, Deceased. The parties do further agree
to indemnify and hold harmless said Counsel to the Estate and Executor of the Estate
of Virginia L. Wertz, Deceased, from any and all liability which may arise against the
Estate from creditors or claimants.
2. Each of the parties does hereby acknowledge receipt of the cash assets described
above, and a full accounting of the estate assets attached to this Agreement as Exhibit
"A", Summary of Account.

3. Each party to this Agreement acknowledges that this Agreement shall be indexed and
recorded in the Estate proceedings and that the terms hereof shall be binding upon
his or her respective heirs, successors, administrators, and assigns.
4. This Agreement shall be governed by the laws of the Commonwealth of
Pennsylvania.
