COMPLAINT
The Plaintiff, FIRST NATIONAL BANK OF OMAHA, by its attorneys, KODAK &
IMBLUM, P.C., brings this action of Assumpsit against the Defendant to recover the sum
of FOUR THOUSAND EIGHT HUNDRED SIXTY DOLLARS AND NINETY-SEVEN CENTS
($4,860.97) along with interest thereon at the rate of 14.90% as set forth herein, upon a
cause of action of which the following is a statement:
1. The Plaintiff, FIRST NATIONAL BANK OF OMAHA, is a National Banking
Association organized and existing under the laws of the state of Nebraska, having
mailing address of Post Office Box 2951, Omaha, Nebraska, 68103-2951.
2. The Defendant, CLYDE R. LEBO, is an adult individual residing at 84 Kutz Road,
Carlisle, Cumberland County, Pennsylvania 17013.
3. Defendant did apply for a Visa Account with Plaintiff, which Visa Account was
opened on or about November 10, 2005. Upon receipt and use of said card
Defendant did agree to abide by Plaintiffs terms and conditions for the card as set
forth on Plaintiff's Cardmember Agreement, attached hereto, marked Exhibit "A"

and made a part hereof.
4. Defendant did, at various times, in various places, and for various amounts, avail
himself of using the card for credit, thereby creating a balance due and owing in the
amount of Four Thousand Fifty Dollars and Eighty-One Cents ($4,050.81), as set
forth on Plaintiff's September 11, 2006 Statement attached hereto, marked as
Exhibit "B" and made a part hereof.
5. The prices charged for said goods, wares, merchandise, services, and/or labor
which Defendant charged on said card were just and reasonable, were the legal and
market prices therefor and were the prices which the Defendant promised and
agreed to pay.
6. Due to the default of Defendant, and pursuant to the terms and conditions of the
Cardmember Agreement executed by Defendant hereto attached, marked Exhibit
"A" and made a part hereof, attorney's fees in the total amount of Eight Hundred
Ten Dollars and Sixteen Cents ($810.16) have been added to said account.
7. Plaintiff frequently demanded payment from Defendant of said amount due and
owing as aforesaid, but Defendant refused and neglected and still refuses and
neglects to pay said amount of any part thereof.

WHEREFORE, Plaintiff brings this suit to recover from Defendants the sum of
FOUR THOUSAND EIGHT HUNDRED SIXTY DOLLARS AND NINETY-SEVEN CENTS
($4,860.97) along with interest thereon at the rate of 14.90% as set forth herein.
