CO) -- rn 1--- c....--j 1. THE PARTIES 1. Petitioner is an adult individual currently residing 94- 843 A wanei Street, Waipahu, Hawaii 96797-3109, and is the son of the decedent as defined below. 2. Petitioner's father, Frank Freeman Davenport, Jr., was a resident of Cumberland County and died in 1969 (the "Decedenf') and the trust was funded shortly thereafter, specifically October 17, 1969. 3. The Decedent has four (4) children, namely, your Petitioner herewith, Frank F. Davenport, III, Deborah Davenport, Ramsey B. Davenport and David Davenport. 4. Wachovia Bank, NA (hereinafter "Respondent'') is a banking institution with offices in Harrisburg, Pennsylvania currently serves as Trustee of "Trust B" as defined below. 5. The Respondent probated the Will of the Decedent dated October 13, 1952 (a true and correct copy of the probated Will is attached hereto as Exhibit "A")(the "Wil"). 6. The Will names Central Trust Company of Harrisburg, Pennsylvania as Trustee and the Respondent is the successor Trustee after a series of mergers and acquisitions within the banking industry. 7. The Will as per Article II of the Will creates a residuary share called "Trust B" (funded October 17, 1969) which benefits the Decedent's spouse (specifically Suzanne B. Davenport) during her lifetime and the children of the Decedent (which includes the Petitioner hereof) (herein "Trust B"). JURISDICTION 8. The Court has jurisdiction over this matter pursuant to 20 Pa. Cons. Stat. ~711 which provides that this Honorable Court shall have jurisdiction over all matters pertaining to accountings by personal representatives. 9. 20 Pa. Cons. Stat. ~3501 provides that all inventory and accounts shall be filed in the county where the Principal resides (herein the "Accounting"). 10. Petitioner has standing to file this petition as an intestate heir of the Decedent and as beneficiary under ''Trust B". FACTS AND ALLEGATIONS 11. Petitioner avers that Respondent may have not been cautious or prudent in its actions as fiduciary under ''Trust B" and is therefore desirous of procuring the Accounting. 12. After a series of informal discussions with the Respondent with regards to procuring an Accounting informally of "Trust B", the Petitioner is left with no alternatives other than seek an Accounting from this Honorable Court. 13. The Respondent's actions as fiduciary have been cavalier and disingenuous repeatedly ignoring the Petitioner's request for an Accounting of ''Trust B". 14. The Respondent may not have adhered to the Prudent Investor Rule as further codified in 20 Pa. Cons. Stat. ~7201. 15. Petitioner has never received any distributions from "Trust B". 16. The Petitioner, and other potential beneficiaries of ''Trust B" (namely the Decedent's children), will be prejudiced if Respondent does not produce the records, file an inventory and provide an Accounting as per 20 Pa. Cons. Stat. ~3501. RELIEF WHEREFORE, Petitioner respectfully requests that: 17. The Court order Respondent to prepare and file with this Honorable Court an Accounting for its actions completed as fiduciary from inception until the date hereof in a form that satisfies the requirements of the Probate Code and the Fiduciary Accounting standards in the form as presented in Cumberland County O.C. Rule 6.1; 18. Respondent not dispose of any assets and must account for any and all assets that it has procured or are in its possession belonging to "Trust B"; 19. Respondent produce the entire file and any copies of all documents in his possession relating to the Decedent's estate not limited to all prior tax returns (including those filed by the Respondent after the death of the Decedent) any and all records of all brokerage accounts, deeds and mortgages associated therewith and other ancillary financial information without limitation intended; and 20.
