STIPULATION AGAINST LIENS
-
THIS AGREEMENT made this 3e:l.> day O~f'v~2007, by and between
D. CULL V, INC., D/8/ A C Be C CONSTRUCTION, A Pennsylv nia Corporation,
hereinafter referred to as Contractor,
AND
ALBERT J. LUGO AND LINDA M. LUGO, husband and wife hereinafter referred to
as Owner, whereby the contractor undertook and agreed to erected and
construct a dwelling on the certain lot of ground situate in Dickinson Township,
Cumberland County, Commonwealth of Pennsylvania, known as Lot 7
Stonehouse Road, Carlisle, Cumberland County, Pennsylvania.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor,
for an in consideration of the sum of ($1.00) Dollar to Contractor in hand paid by
Owner, the receipt whereof is hereby acknowledged, and the further
consideration mentioned in the agreement aforesaid, for itself, himself or
themselves and its, his or their subcontractors, and all parties acting through or
under them, covenant and agree that no mechanic's liens or claims shall be
filed or maintained by them or any of them against the said buildings and the lot
of ground appurtenant thereto for or on account of any work done or materials
furnished by them or any of them under said contract or otherwise, for, towards,
in, or about the erection and construction of the said buildings on the lot above
described, and the said Contractor, for itself, himself or themselves, its, his or their
subcontractors and others under them, hereby expressly waive and relinquish
the right to have, file, and maintain any mechanic's liens or claims against the
said buildings or any of them, and agree that this instrument waiving the right of
lien, shall be an independent covenant.

of D. Dully, Inc. d/b/a C & C Construction and that he as such Secretary being
authorized to do so, executed the foregoing instrument for the purposes therein
contained by signing the name of the said Corporation by himself as such
Secretary.

ALL the following described real estate, lying and being situate in Dickinson Township,
Cumberland County, Commonwealth of Pennsylvania, bounded and limited as follows:
BEGINNING at a mag nail in Stone House Road (T -545) along Lot No.3 on the plan of lots
hereinafter referred to and at corner of lands now or formerly of Clarence W. Collier;
thence along the latter, through an iron pin on line, North 55 degrees 37 minutes 14 seconds
East, 377.70 feet to an iron pin along lands now or formerly of Ronald E. Shughart; thence
by the latter and lands now or formerly of John R. McKeehan, South 50 degrees 09 minutes
04 seconds East, 835.45 feet to an iron pin along the latter at corner of Lot NO.8; thence by
the latter, South 66 degrees 01 minute 12 seconds West, through an iron pin on line, 739.98
feet to a mag nail at corner of same in Stone House Road (T -545); thence in Stone House
Road (T-545), North 23 degrees 58 minutes 48 seconds West, through two (2) mag nails on
line, 681.61 feet to a mag nail in Stone House Road (T-545) along Lot No. 14, the Place of
BEGINNING.
BEING Lot No.7 on a final subdivision plan entitled "South Fields", prepared for Tom
Mongold, by Dennis E. Black Engineering, Incorporated dated 9/8/06 with revisions, which,
together with the necessary municipal approvals, is recorded in Cumberland County Plan
Book 93, Page 90.
