COMPLAINT
AND NOW this2.vf> day of January 2007, comes the Plaintiff by and
through his attorney Diveglia and Kaylor, P.C., who file this Complaint on his
behalf and he avers in support thereof as follows:
1. The Plaintiff, Maurice Vianey, is an adult individual who resides at
302 N. Baltimore Avenue, Apt #1, Mt. Holly Springs, PA 17065.
2. The Defendant, Cathy L. Morrison, is an adult individual who resides
at 11 West Butler Street, Mt. Holly Springs, Cumberland County, Pennsylvania,
17065.
3. On September 7, 2006, at approximately 5:00 a.m., Plaintiff, Maurice
Vianey, was a passenger in the motor vehicle operated by the Defendant, Cathy
Morrison, with said vehicle traveling in a southernly direction on Route 220
and was approaching one tenth of a mile south of the intersecting Route 1243,
Henry County Virginia.
4. At the above said time and place, Defendant operated the motor
vehicle in a negligent and reckless manner leaving the roadway, rolling over in
the process and causing severe injuries to the Plaintiff.

5. As a result of the collision caused by the negligence of the Defendant
to be described or more fully subsequently, Plaintiff incurred fractures of Tll
and T12, and the distal phalanx of the great toe of the right foot.
6. As a result of the above described injuries, Plaintiff incurred surgery
and was required to undergo multiple laminectomies from TI0 to L2 with
fusion and graphing.
7. Subsequent to surgery and as a result thereof Plaintiff acquired an
infectious process known as MRSA which he continues to suffer from and may
continue so into the foreseeable future.
8. As a result of the above described injury, surgery, and subsequent
infectious process, Plaintiff has incurred severe pain and mental distress.
9. Plaintiff will continue to have additional treatment into the foreseeable
future.
10. As a result of the above described injuries, Plaintiff was fully
disabled from any source or form of employment and will continue to be
disabled into the foreseeable future, if not permanently.
11. As a result of the above described injuries and treatment Plaintiff
has incurred uncompensated medical expenses.
12. The above described injuries and losses were the result of the
negligence of the Defendant who negligence consisted of the following:
a) She drove her vehicle in a reckless manner allowing it to
leave the roadway and thereby roll over and cause injuries to
Plain tiff.
b) She was inattentive in her driving and thereby the vehicle
did not remain on the roadway but went off to the berm
resulting in the crash sequence described previously.
c) She failed to observe where she was going.
d) She failed to maintain control over her vehicle.
WHEREFORE, Plaintiff demands judgement against the Defendant for
the sum in excess of the jurisdictional limits of Arbitration of Cumberland
County together with interest and costs.

gathered by my counsel in the preparation of the lawsuit. I have read the
Complaint to the extent that it is based upon information which I have given to
my counsel, it is true and correct to the best of my knowledge, information and

counsel in making this verification. This statement and verification are made
subject to the penalties of Pa.C.S. ~4904 relating to unsworn falsification to
authorities, which provides that if I make knowingly false averments, I may be
subject to criminal penalties.
