child. The parties also reported that Children's Bervlces had 1I0t dOlle anythlnq to
Investigate the accusationu 01 abuse agalnut the lather which the Mother clallls the
child has lIade to her. Proll what eaeb 01 the parties could tell III!, It does not appear
that the child and the parties will qet any real relief 11'011 Children's Bervlees.
The accusations In the case are very serlouu and If any of the~ are true, this
child Is In a very dangerous situation with either parent. To 'lIve her sOlie
protectloll, the parties agreed to have the child consult. with an Indf'lpendent
psychOlogist. The order provides that the parties will cooperate In arranging that,
will provide all InlorMatlon requested by the psychologist, and provide SOMe method of
paYllent at least for the Initial six IIOnths, Hopefully the psychologist will develop a
. relationship with the child which will enable her to discuss these Matter/; freely and,
perhaps, the puychologlBt can qot to the bottOM of these accusations.
With the entry of the enclosed order, It Is not necessary to sehedule a hearing at
: this tllle. Hopefully the psychologist can reach 80llle conclusions that will help the
parties extricate the child frolll whatever situation Is exp081ng her to the abuse or
causing her to luke theRe accuRatlons. If not, the psychologist's Inforllatlon will be

2. Pending further order of this Court, priMary physical cuutody at the said
child shall remain wi th her mother, the Defendant, Rosa Soler. Pending further order
at this Court, the child's father, the Plaintiff, Dennis Bankes, shall have temporary
custody of the child as (allows:
A. Alternating weekends from Friday at ~:OO p.M. until Sunday
at 6:00 p..., commencing on Friday, February 25, 1994.
B. During the time that the child is with the father for
periOdS of temporary custody, the child shall be 8upervised by the
tather's wile, Sharon Bankes, and will not be alone with the
father. We add this stipulation or restrietlon not based upon any
finding of faet, but based upon the alJreelllent of the parties
pending further order of court.
3. The parties have agreed that an appropriate agency will conduct a home study
of each of their residences. Aceordlngly, we hereby direct that Family Services of
I York will conduet a hOllle study of the father's resilience and subMit a written report to
father's attorney, who will then provide a copy to the mother's attorney. The father

ORDER OF COURT
AND NOW, thia 9th day of June, 199~, upon
consideration of the Plaintiff's complaint for cU8tody with
respect to the parties' child, Danielle R. Bankes, and following
a hearing, pursuant to an agreement reached by the parties with
the assistance of counsel and dictated in open court in ths
pre.enoe of counsel and the partieD, it is ordered and directed
as follows:
1. The parties shall share legal custody of
Danielle R. Bankes.
2. Mother shall retain primary physical custody
of Danielle R. Bankes with the following rights of temporary
physical custody being granted to the father:
(a) Alternating weekends, beginning Friday at
5:00 p.m. and continuing to Sunday at 6:00 p.m. The rotation
presently in effect will remain in effect.
(b) Alternating holidays, those holiday.
being New Year'. Day, Memorial Day, Fourth of July, Labor Day,
and Thanksgiving from 9:00 a.m. to 9:00 p.m. The first holiday
ot the tather shall be July 4th, 1995.
(c) On .ach Mother's Day, the mother shall
have temporary physical custody, which shall supers.de all othsr
rights of oustody, from 9:00 a.m. to 9100 p.m. On Father's Day,
father shall have temporary physioal custody, which shall
supersede all other rights of custody, from 9100 a.m. to 9100
p.m. Each Christmas, the father shall have temporary physical
custody on December 25th beginning at 1:00 p.m. and continuing
until December 29th at 6:00 p.m.
(d) During tho summer months, father shall
have temporary physical custody beginning on the Friday
following the first full week after echool lets out and
continuing until the last Friday, allowing a full week of return
of the child to mother prior to the beginning of the school
year. This arrangement contemplates allowing mother at least
one full week after the close of school and prior to the
beginning of school for preparation for the new school year.
During the Bummer, mother shall have temporary phys.1.caJ. custody
on an alternating weekend basis, beginning Friday at 5:00 p.m.
and continuing until sunday at 6:00 p.m. However, with respect
to the period covered by the shutdown of father's employer,
which encompasse~ a lO-day period, beginning the w~ekend before
shutdown through the weekend after shutdown, mother shall not
exercise alternating weekenda during that period. A lO-day
period of temporary physical custody during the summer months is
also reserved to the mother up 011 30 days written notioe to
tatherl however, said J.O-day period .hall not be during the time
ot shutdown as previously described.
'j. During 1995, the child has been enrolled in a
camp known as Camp l'ocono. 'fhe dates of enrollment are believed
to bOIl August 2nd through August 9th, 1995. .'or the year 1995,
father oonsents that time can be spent at Camp Pocono hut that
no future reservations should be made without prior consultation
with him.
4. At no time shall Danielle R. Bankes be in the
presence of the stepfather, Peter Soler.
5. The party who is about to obtain temporary
physical custody of the child shall be responsible for picking
up ths child to begin their period of custody. For example, on
alternating weekends, father will he responsible for picking up
at mother's home and mother will be responsible for picking up
at father's home.
6. During the tim~s of exchanges, the parties
are not to engage in disparaging comments or any activities in
front of the child that lnay cause disruption or which would
exhibit a bad display of judgment in front of the child.
7. with regard to phone contact, the child may
contact either parent that she is not presently with at any time
she wishes to call. Mr. Bankes agrees that he will accept
collect phone calls from Danielle while she is with her mother.
