l PlaintifTseeks custody of the children, Michael Drake Boone. who was born on July
4,1984. and Nicholas Andrew Boone, who was bt)rn on Febmary 20. 1987.
The children were not born out of wedlock
Since the children's birth, the children huvc resided with the following persons at the
following addresses f(lr the following pcriods of time
Since their births, the children lived with Plaintitr and Delendantuntilthe parties separated.
From that time and to the prcsent, Dcfendant has hud primary physical custody with Plaintiff having
partial physical custody ptlr the Marital Settlement Agreement with the pertinent portions pertaining

1. This Court's prior Order dated AU<Just 23, 1994 incorporating
the terms of the parties' Mari tal Settlement Agreement is replaced by this
Order only with respect to paragrsph 12 of the Agreement pertaining to
Child custody.
2. The pather, Darold E. Boone, and the Mother, Christine Y.
Boone (a/k/a Christine ,1. Yelovich) shall have shared legal custody of
Michael Drake Boone, born July 4, 1984, and Nicholas Andrew Boone, born
February 20, 1987.
3. The Mother shall have primary physical c1Jstody of the
Children.
4. During the school year, the Fsther ehall have partial custody
of the Children up to two weekends per month on weekends the Father does
not work on both Saturday and Sunday. The periods of weekend custody shall
begin on Friday at 7:00 p.m. and end on Sunday at 5100 p.m.
5. During the surmlElr school vacat.ion, the Father shall have
partial custody of the Children for an uninterrupted three week period
beginning on the last Sunday in June. At the conclusion of the Father's
three week period of cus'.:ody, the Mother shc:ll have custody of the Children
for a one week period before ret.urning the Children to the .'ather' s custody
for a second uninterrupted three week period, For purposes of this
paragraph, each one week peroiod of custody shall begin on Sunday at 5:00
p.m. and end on the following Saturday at 5:00 r.m,
6. The Father shall have custody of the Children on holidays
when the Fathet' does nCJt work (Christmas, New Years, Edster, Thanksgiving)
BlJ long as the .'ather does not have custody of the Children on both
Christmas snd Thanksgiving in the ssme year. The Father's periods of
holiday custody shall begin at 7:00 p.m. on the last day of school prior to
the vacation and shall end at 5:00 p.m. on the last day of the Father's
work vacation or at 5100 p.m. on the day before school resumes, whichever
is later.

I, Father lives at 7376 Woodstone ('ourt, Warrenton, Fauquier County, Virginia20lR7,

3, A Custody Order was issued hy the Cumherland ('oanty ('ourt on Fehruary 12, 1997,
which is stili in full t(lIce and effect. A copy is ll\lached hereto and llIarked Exhibit "A",
4, A ('onciliation Conference hetween the parties and their respective counscland Dawn
S, Sunday, Esquire occurred on January 28, 1997, at which lime Ihe ('ustody Order was agreed upon

5, Father is a police oftjcer in Fairtllx ('ouuty, Virginia, and works II revolving,

9. According to Ihe schedule, the weekend of September 27 - 2H was a weekend when
Father had off work and a weekend when he was supposed 10 have custody of his children. In
speakinl! with MOlher by tclepholle on or about Septcmber 24, 1997 10 coordinate the transportlltion,
Father was adviscd by Molher thai she would not permil visitation with the childrcll on that weekend.
She stated this was on advice of counsel.
10. On September 25, 1997, counsel for Mother adviscd counsel fi)r Father that the reason
that he had advised his clicnt (Molhcr) not to permit visitation on the wt'ekend of September 27 - 2H,
1997 was becausc Father had not provided sixty (60) days notice of this weekend as required by the
Order; instead, he stated that Father's actual notice was only two or lbree weeks, and so, under his
interpretation of the Order, Motber was relieved of any obligation to have the children see thcir father
on that weekend.
11. Mother was aware, at least as of April, 1997, of Father's weekends.
12. Mother has violated her obligations under the Cust()dy Order, Exhibit "A".
WHEREFORE, Father, Darold E. Boone, prays YOUI' !Ionurablt: Court to hold Mother,
Christine J. Yelovich, in contempt and to impose the ti)lIowing penalties:
1. Reimbursement to Father till' his expenses, including counsel fees, in enforcing the
Order;
2. Make-up lime fill' all of the visitation time missed dUt: to Mother's failure to honor her
responsibilities under the Custody Order;
3. A warning to Mother that a further violation of the Custody Order will result in a flne
or other punishment; Ilnd
4. Such other and further relief as the Court may deem just and proper under the
circumstances.
