COMPLAINT
1. The Plaintiff is IIARRIS SAVINGS DANI<, which formerly was
Harris SaVings Association and formerly thereto The Harris Savings
Association, a corporation organized and existing under the laws
of the State of Pennsylvania and having its principal place of
business at Second and Pine Streets, lIarrisburg I Pennsylvania,
17101.
2. The Carlisle Building and l,oan Association was merged
with lIarris Savings Association which is now lIarris Savings Dank,
the Plaintiff herein.
3. The Defendants are JAMES M. I<OST, an adult individual,
rssiding at 59-61 West 1.outher Street, Dorough of Carlisle,
Cumberland County, Pennsylvania, 17013; and TERESA 1.. I<OST, an
adult individual, residing at 219 South York Street, Borough of
Mechanicsburg, Cumberland County, Pennsylvania, 17055.
4. Defendants I on February 28, 1986, entered into a mortgage
loan indenture with Carlisle Building and Loan Association, now by
merger HARRIS SAVINGS BANK, in the principal amount of SEVENTY-
EIGHT 'f/lOUUANlJ IlOI.LA'W and OO/lOO ($78,000.00), the terma of which
loan are mure Bpeoifically evidenced and Bet forth in the mortgaCJe
indenture dated February 26, 1966, and reoorded February 26, 1966,
in the Cumberland County Recordllr I s Office in MurtCJaCJe Book 604,
PaCJe 888, a copy of which is attached hereto, marked Exhibit "A",
and made a pllrt hereof by reference, which mort,uage contains and
is a lien upon the property situate at 59-61 West Louther Street,
Borough of Carlisle, Cumberland County, Pennsylvania, 17013, being
improved upon with a dwelling.
5. Said loan was further ev i.denced and bllcureel by a note
which accompanied oaid mortgage elated February 28, 1966, a copy of
which is attached hereto, marked Bxhibit "B", and made a part
hereof by reference.
6. Carlisle Building and Loan Association, now b}' merger
lIarris Savings Bank, in consideration of the said mortgage and
accompanying note, advanced to James M. Kost and Teresa L. Kost,
hiB wife, the surn of Seventy-Bight Thousand Dollars and 00/100
($78,000.00).
7. 'l'he premises subject
specifically set forth in Exhibit "A",
part hereof by reference.
8. James M. Kost and Teresa L. Kost, his wife, are the sole
ownera of the said premises contained in said mortgage.
9. Said mortgage and note have not been asnigned in whole
or in part by the Plaintiff herein.

record owners in fee tllmple of said promisoR by virtue of a Deed
dated FebruaJ'Y 28, 1986 and recorded ln the Cumberland County
Recorder's Office in lleed Ilook ______, Page ____.
11. No judgment has previously been entered on said mortgage
or note in any jurisdiction, and said instruments are less than
twenty (20) years old.
12. 'l'he said mortgage is in default because Defendants herein
have failed to pay the partial monthly payment of $615.22 that was
due and owlng for August, L993 and monthly payments of $911.19 each
that were due and owing for the months of September, October,
November and December, 1993.
13. The Plaintiff has given to the Defendants written notice
of intention to foreclose on said mortgage as required by law under
Act 6, dated November 4, 1993, copips of which are marked Exhibits
"C" and "0", respectively, and attached hereto and made a part
hereof by reference.
14. The Plaintiff hafl given written notice of default as
required by tho Homeowner's Emergency Assistance Act of 1983, dated
November 4, 1993, copies of which are marked Exhibits "E" and "F"
and attached hereto and made a part hereof by reference.
15. The entire principa 1 amount of Seventy-Eight Thousand
Dollars and 00/100 ($78,000.00) has become due and payable,
together with interest at the rate of 11.5% per annum, reasonable
legal fees for collection of said sum in accordance with the terms
of said mortgage les8 such sums as have been paid on account of
principal of the said mortgage and costs.
