Heather V Flick is an adult individual of the County of Cumberland, Commonwealth of Pennsylvania, whose mailing address is 915 Wil/cliff Drive, Mechanicsburg, Pennsylvania 1 7055 2 John Sopensky is an adult Individual of the County of Cumberland, Commonwealth of Pennsylvania, whose mailing address is 30 East Maplewood Avenue, Mechanicsburg, Pennsylvania 17055. 3 At aI/lime relevant hereto, ,John Sopensky was the le9altitle holder of a proporty located at 108 Second Street, West Falrvlew, Pennsylvania 4 On October 5, 1993, Plaintiff gave Delendant $100 towards the security deposit lor the rental 01108 Second Street, Unit A, West Falrview, Pennsylvania (" Premises"). 5. At the time that Plaintiff paid the $100 porllon of the security deposit, Defend!1nt understood and agreed that Plaintiff needed to take possession of the Premises on November 1, 1993. A true and correct copy 01 the receipt IS attached as hereto as Exhibit "A". 6. On October 13, 1993, Plaintiff paid Defendant the remaining $195 of security deposit for rental of the Premises A trua and correct copy of the receipt is attached as hereto as Exhibit "B". 7 On October 13, 1993, Plaintiff entered into a residential lease agreement ("Lease") with Defendant for lease of the Premises. A true and correct copy of the Leue is attached aa hereto as Extublt "C", and Incorrxlrated herein 8. With The Landlord and Tenant Acl 01 1951, as amended 9. Pursuant to 11 2 01 the Lease, and in accordance with Plaintiff's and Delendant's agreement on October 5, 1993, the lease term was to commence on November 1, 1993 and end on October 31, 1994. 10. On November 1, 1993, Plaintiff and her mother arrived at the Premises In order to take possession of the Premises pursuant to the Lease. 11. At that time, Defendant informed Plainlilt that he could not deliver possession of the Premises to Plaintiff because a third party had possession of the Premises. 12. Plaintiff demanded that Defendant return the $295 security deposit. 13. Defendant refused to return the security depOSit to Plaintiff. 14. On December 7, 1993, Plaint!1f obtained a Judgment against Defendant in front of District Justice Ronald Klalr , CV-321.93, lor $295 plus $34.50 In court costs. 15. On January 5, 1994, Defendant filed a Notice 01 Appeal from the aforementioned District Justice judgment 16. Defendant has neither returned the security depe)sit nor paid the court costs from the District Justice decision 17. Both before and after the District Justice judgment, Plaintiff, and Plaintiff's former counsel, have demanded that Defendant return the security deposit 18.
