her attorneye, Stone LaFaver , Stone, and files this oomplaint against
the defendant, Billie ~'. Bowman, and avers as follows,
1. The plaintiff, Gertrude D. Bender, is an adult individual
with a prinoipal residenoe at 299 Allendale Way, Camp Hill, Cumberland
County, Pennsylvania 17011.
2. The defendant, Billie F. Bowman, is an adult individual with
a prinoipal residence at 39 Kensington Drive, Camp Hill, Cumberland
County, Pennsylvania 17011.
3. At all times relevant hereto plaintiff owned along with her
husband, Charles J. Bender, now deceased, real property known and
numbered as 217 Fourth Street, New Cumberland, Cumberland County,
Pennsylvania.
4. At all times relevant hereto defendant leased from the
plaintiff the said real property pursuant to an Agreement of Lease,
said Agreement being attaohed hereto and made a part hereof as Bxhibit
itA",

5. By notioe dated July 31, 1993, defendant notified plaintiff
of her intention not to renew the eaid lease. A true and oorrect oopy
of 8aid nctioe is attaohed hereto and made a pact hereof as Exhibit
I'BU.
6. By notioll dated September 7, 1993, from plaintiff to the
defendant, said notice being attaohed hereto and made a part hereof as
Exhibit "CO, plaintiff provided a partial liating of mattecs which
defendant needed to repaic and/or replace upon her vacation of said
premises.
7. Defendant vaoated the premiues on or before September 30,
1994.
8. Defendant failed to surrender the premises in as good a
oondition as they were in at the time "the first lease was put into
place (8/1/90)" as required under paragraph 7 of the lease.
9. An entimate of the cost.e to repair eaid damages caused by the
defendant to the premiees include as followsl
A. $4,849.00 as per Wildman Home Product.s, Inc., proposal
attached hereto and made a part. hereof as Exhibit "0".
B. $93.00 as pee Roy Fritz invoice for electrical work
attached hereto and made a part hereof as Exhibit "E".
C. $106.00 as per TerminLx invoice for initial service
together with 12 months at $52.88 or $634.56 as per Commercial Pest
Control Agreement and repoct attached heceto and made a part hereof as
Exhibit "F".

1. The lessor hereby leases to the le8see the property
at 217 4th St New Cumberland, Cumberland County, Pa. For a
term be,inning on 1st day of October 1992 and ending nn
September 3Q, 1993 for the sum of Five Hundred Thirty Three
Dollar. and fifty cents (533.50) per month, with each monthly
payment of (533.50) Five Hundred Thirty Three Dollars and
fifty cents being due in advance on the first dBY of each
calendar month of the term.
2. The lessor has on deposit, the sum of (533.50)
( Five Hundred Thirty Three dollar" and fifty cents ) which
is being held aB a security depoBit. Upon the termination of
this lease, the security deposit will be returned to the
leBsee, less any monieB due leBsor for damage to property I
other than fair wear and tear. The lessee shall not use the
security deposit as payment of any rents due leBsor.
3. The Lessee shall have the option to renew this lease
for one year at the expiration of this agreement.

10.Should the premises be rendered untenable by the

immoral activity in or about the demieed premises, and ahall
not carryon any activity which will endanger the buildin.

further right in said event to forfeit snd terminate thi.

14. The said lessee hereby accept notice to quit,

demised premieeR to the said lessor, their successor& and
assigns, at the expiration of the "aid term, whenever it may
be determined, weather by forfeiture or otherwise, without
any further notice to that effect, all further notice being
hereby waived. And on the failure to pay rent due, for the
space of ten days or upon breach of any other condition of
this lease the lessee shall be non-tenant, subject to
dispoRsession by the said leasor either further notice or
process of law, with release of error and of damages, and the
said lessor may re-enter the premises and disposses.

customers to make any disturbin, nolses n r to do any thin,

20. The lessee shall not drive nails, screw., tacks or
eimilar ltems into walls or woodwork.
21. The lessee shall not obstruct the sidewalks, halls,
passages and Btairways, nor UBe them for any other purpose
other than for egress and ingress to and from thelr property.
22. No kerosene or electric heaters will be allowed on,
in or about the property.

others that may be dam8~ed.

6. Fix windows that were used for waste ducks, and those used
for the oven,
7, Repair the Willi lnlllde and olltslde where the oven unit was
installed.
8. Repair tile on wall over the bllthtub, and where ever eise
it 18 needed,
9. Bathtub is badly backed up, all was the kitchen a short
time ..0. We would expect that a plumber clean all drains
of ~rea.e and dirt, ae was done in the kltchen.
10. The cellar needs cleanin~ and the removal of all debris,
and other items not belongin~ to us.
11. Tbe Btorm door in the kitchen needs new glallB.
12. On 6/17/93 we were forced to sign a contract with
Terminix, for one year, This was caused by neglect on the
part of the people that worked at your place of busineaa.
The contract cost were' 106,00 plus' 48,00 per month,
We would expect to negotiate B reimbursement from YOU,
We have enclosed a copy of tbe report on the condltions
found in your place of business by 'l'ermlnix.
After the completion of your repair", we then will be
able to atart the necessary work that would be neceBsary
