Dear Sir/Madam:
My name l.s captain Joseph R. Perlak and I have recently been
consulted by corporal Gary M. Cassel in my capacity as a Marine
corps Legal Assistance attor.ney. In that capacity I have
furnished him with advice and preliminary lsgal counseling, to
include assistance in drafting correspondence such as this.
Corporal. Cassel recently presented me with documentation in the
form of An appeal to a judgment he had won in December, 1993.
I have enclosed a certified true copy of the envelope
containing the notification of corporal cassel of this appeal.
ThiH reveals misrouting to Florida and california before arrival
here.
Please be advised that this Marine and his command wer'e
participating in Combined Arms Exercise (CAX) in 29 Palms,
California from January 12 to February 6, 1994, returning to
Beaufort, BC on February 7, 1994.
Unable to decipher the "legalese" on the notice, he consulted
my legal assistance office. As we are many hundreds of miles
away, a fact surely considered by the appellant, we are unable to
access a form to file a complaint against this appeal. However,
please accept this letter as corporal Cassel's challenge to the
appeal and complaint against it. The original judgment entered
reflected a full hearing on the sJ,tuation and the reasoned
decision rendered In your honorable court after due
consideration. There has been no change In facts or
circumstances since the original judgment was entered.
Therefore, the appeal should be denied. corporal Cassel took
military leave to go to Pennsylvania to pursue this action quite
some distance away. The Appellant is certainly taking advantage
of the fact that he is an active duty servicemember in South
Carolina and unable to defend this appeal.
If your honorable court 1s g1ving any credence to this appeal
at all, please be advised that corporal Cassel'~ inability to
more fully defend this action is based ~~lY on his military
