oonveyed by Plaintiff and his wife to Duane A. Beard and
Defendant. The value of the land at the time of its conveyanoe
was $25,000. Duane A. Beard and Defendant subsequently commenoed
building a home on the property and were later married September
26, 1987. After marital diffioulties arose between them, they
sold the property on September 17, 1992. This aotion was
oommenced by Plaintiff against Defendant to recover from her one-
half of the value of the property ($12,500) pursuant to the
agreement reached in July or August of 1986.
~ STATEMENT OF FACTS CONCERNING DAMAGES.
As indicated above, the terms of the agreement between
Plaintiff and Ouane A. Beard and Defendant required payment to
Plaintiff of $25,000 in the event the land was ever sold by them.
Duane A. Beard has paid Plaintiff the sum of $5,000 toward this
obligation. Although Duane A. Beard and Defendant are considered
jointly and severally liable on the total debt claimed since the
land in question was sold in conjunction with obtaining a
divorce, Plaintiff ie claiming damages of Defendant in the amount
of $12,500 - representing one-halt of the total amount due upon
the sale of the propsrty.

III. STATEMENT OF-Ia~UES CONC~RNING LIAQJLITY AND DAMA~.
The primary issue in this case is whether an oral agreement
existed between Plaintiff, his son and Defendant as set. forth
above. Defendant claims 110 such agreement existed and that the
land was given to her and her husband-to-be as a weddinq gift.
Defendant also claims that the agreement alleged violates the
statute of Frauds.

At this time, Plaintiff is unaware of any unusual
evidentiary matters which require particular resolution by the
Court.

complained oE by the Plaintiff in this case,
Claudette first received notice of Plaintiff's claim by way of
a letter she received from PlaintIff on March 17, 1992. Disturbed
by this claim, ehe contact.ed her now ex-husband, Duane, to inquire
as to his knowledge of PlaintiEE's claim. Duane assured Claudette
that the property was given to both of them a8 a wedding gift, and
that Plaintiff was mistaken.
Notwithstanding this assurance by Plaintiff's son, Plaintiff
assert8 that an oral agreement was entered into at some point prior
to the land conveyance of January 7, 1987. This purported oral
agreement oblig,3.ted Duane and Claudette to pay a sum of money to
Plaintiff equal to the fair market value of the property at the
time of the conveyance, i.n the event that Duane and Claudette ever
sold that tract of land, Claudette G, Kreiser denies being a party
to any such oral agreement and furthermore denies that such an
agreement ever existed.
In September of 1992, Duane and Claudet te conveyed their
interest in the property to Jesse J. and Julie M. overgord, On
January 6, 1994, Plaintiff filed this action in the Court of Common
Pleas of Cumberland County, Pennsylvania, demanding $12,500.00.
This amount allegedly rept'esents one-half of the fair market value
of the property conveyed to Claudette and Duane in January, 1987,

II. STATIMINT OP THI BASIC PACTa AS TO DAMAGIS,
Plaintiff cla ims that his damages total $12,500.00. Plaintiff
measures these damages by way of the alleged fair market value of
the land conveyed to Def'Jndant and her husband in 1987, Plaintiff
contends that Defendant is liable for one-half of the alleged fair
market value of the land conveyed, (Le, $25,000.00).
III. STATBMINT AS TO PRINCIPA~ ISSUBS OP LIABILITY AND DAMAGBS.
The principal issues of these proceedings are as follows:
(1) Whether a valid oral agreement was entered into prior to
the 1987 conveyance of land from Plaintiff to Defendant and
Plaintiff's son; and
(2) If there was a valid oral agreement, whether Defendant
was a party to Buch agreement,
IV. SUMMARY OF LEGAL ISSUES.
The sole legal issue involved is whether there existed a valid
oral contract between the parties.
The elements necessary to give rise to an enforceable contract
are offer, acceptance, consideration, and mutual meeting of the
minds. Schreiber v. alan Mills, 426 Pa. Super 537, 627 A.2d 806
(1993). The offer must be clear and definite, fahrinaer v.
.s.trlne's Estat.e, 420 PA 48, 16 A.2d 82 (1966), and the acceptanGe
must be conveyed on the exact and precise t.erms offered, Groskin
v. Bookmver, 310 PA 588, 166 A 233 (1933),

(1933). Finally, the Court must find that both parties' promises
were supported by consideration, which, however, is not at issue in
theRe proceedings.
Claudette Kreiser knew nothing of the purported offer until
March 1992, over five years after the purported offer was made to
her. Thus, she could not have conveyed an acceptance of
Plaintiff's of fer to the Plaint i. ff if she knew nothing of such
offer, Although silence on the part of an individual can at times
consti tute an acceptance by that individual, it only does so if the
law implies a duty upon that indivi.dual to speak. Solis-Cohen v,
Phoenix Mutual Life j:nsuran~..J&.., <113 PA 633, 198 A.2d 55<1 (1964).
However, no duty was imposed upon the Defendant, Claudette Kreiser
to speak under these facts where she believed what she recelved was
a gift,

way of further answer, Defendant admits that she has refused to
make any payment to Plaintiff, but this refusal is due to the non-
existence of any agreement on the part of Defendant to ever make
payment to Plaintiff as Plaintiff sets forth in his complaint.

13. Denied. DefendAnt is without sufficient information or

following reasonable investigation, to either affirm or deny this
allegation and, therefore, same is denied and strict proof thereof
is demanded at time of trial, By way of further answer, if Duane
A. Beard is making payments to Plaintiff pursuant to an agreement,
it is pursuant to an agreement made solely between Duane A. Beard
and the Plaintiff and to which aqroement Defendant was never a
party.
15. Denied. It is specifically denied that there was ever
any agreement between the parties as Bet forth in the Plaintiff's
Compla lnt, and, there fore, there exists no conditions precedent
which would give riae to Defendant's obligation to make payment to
Plaintiff.
WHEREFORE, Defendant prays that this Honorable Court will
enter judgment in favor of the Defendant and against the Plaintiff,
together with costs.

incorporated herein as if set forth at length.
17. Plaintiff's Complaint seeks to have Defendant make
payment upon an agreement for the sale of land.
18. The statute of F'rauds under Pennsy 1 vania l,~w requires
that the terms of an agreemunt for the sale of real estate bo in
writing and signed by the party to be oharged.
19. Plaintiffls Complaint is not. based upon a writ.ten
dooument which evidences an agreement for the sale of land, nor
does it refer to or aver that there exists such an written
document.
20. The statue of Frauds precludes the Plaintiff from
recovering any judgment against this Defendant on the basis of the
claim set forth in his Complaint.
WHEREFORE, Defendant prays that this Honorable Court will
dismiss Plaintiff's cause of action with prejudice as falling
within the statue of Frauds.

22. The Defendant was married to the Plaintiff's son, Duane
A. Beard, but the partiea obtained a divorce on February 20, 1992.
23. On an unknown date, but prior to the entry of the divorce
decree between Defendant and Duane A, Beard, the Defendant and
Duane A. Beard enter into a Property settlement Agreement whereby
they agreed on the distribution of all marital assets and marital
debts.
24. No where in the Settlement Agreement is there any
indication of the existence of the dsbt complained of by the
Plaintiff in this case.

AND NOW, comes the Plaintiff, George W. Beardl Jr'l by his

1. Plaintiff George W. Beard, Jr., is an adult individual
residing at 80 Beard Road, Enola, Cumberland CountYI Pennsylvania
17025.
2. Defendant Claudette G. Beard (nee Claudia C. Gepfer) is
an adult individual residing at 5113 Ridgeview Drive, HarriSburg,
Dauphin county, Pennsylvania, 17112.
3. On or about July or August, 1986, Plaintiffl with full
oonsent and approval of his wife, Blanche M. Beard, entered into
an oral agreement with his son, Duane A. Beard and Defendant,

whereby Plaintiff would permit the subdivision of his and his
wifels land in Silver Spring Township, Cumberland County and give
by deed, fee simple title to two and one-half aores of same to
Defendant and Duane A. Beard, with the understanding that if the
subdivided property so given was ever sold by Defendant and Duane

A. Beard, t.hen in such event, Duane A. Beard and Defendant would
pay to Pia IntIff the value of the unimproved land established as
of the time of the conveyance to Defendant and Duane A. Beard.
4. At the time of the aforementioned agreement I Defendant
and Duane A. Beard were contemplatl.ng mal'riage and desit'ed
property upon which to build a home and resIde.
5. In furtherance of the partiesl undorstanding and
agreement, Plaintif f' s property was pl'operly subdi vidod, thereby
creating, inter li.i.lI., a tract of land containing approximately
2.507 acres, which tract bocamo commonly known and numbered ae 79
Beard Road, Enola, ponnsylvania (hereinafter referred to as "79
Beard Road").
6. In keeping with the partl.esl understanding and
agreement, Plaintiff and his wife, Blanche M. Beard, by Deed
dated January 7, 1987 and recorded in the Office of the Recorder
of Deeds in and for Cumklerland county, pennsylvania, in Deed Book
"0", Volume 32, Page 1090, granted and conveyed 79 Beard Road to
Defendant and their son, Duane A. Beard. A true and correct copy
of this deed of conveyance is attached hereto and incorporated by
reference herein as "Exhibit A".
7. Subsequent to the aforementionod conveyance, Defendant
and Duane A. Beard had constructed a residential dwelling on 79
Beard Road.
8. On september 26, 1987, Defendant and Duane A. Beard were

9. On or about September 17, 1992, Defendant and Duane A.
Beard settled on the sale of 79 Beard Road to Jesse J. Overgord
and Julie M. Overqord. A true and oorrect oopy of the Deed from
Defendant and Duane A. Beard to Jesse J. overgord and JUlie M.
Overgord, dated September 17, 1992 and reoorded September 23,
1992 in the offioe of the Reoorder of Deeds in and for Cumberland
County, Penn~ylvania in Deed Book "W", Volume 35, Page 1176, ie
attached hereto and incorporated by reference herein as "Exhibit
B".
10. Prior to the eettlement on the sale of 79 Beard Road,
Plaintiff's counsel notified Defendant's coun~el of Plaintiff's
interest in the sale of 79 Beard Road.
11. In spite of Defendant's knowledge of Plaintiffls claim
arising from the parties I agreement and subsequent sale of 79
Beard Road, Defendant has failed and refused to make any payment
to Plaintiff pursuant to the partiesl agreement.
12" Defendant's fai lure and refusal to make payment to
Plaintiff as a result of the settlement on the sale of 79 Beard
Road is a material breaoh of the parties' agreement.
13. On or about January 7, 1987, at the time ot the
conveyanoe of property by Plaintiff and Blanche M. Beard to
Defendant and Duane A. Beard, the fair market value ot 79 Beard
Road was $25,000.00. (See Exhibit A.)
