4, Since approximately 1989, tha defendant ha. attempted to
cau.e and ha. intentionally, knowingly, or reckle..ly cau.ed
bodily injury to the plaintiff and her children, and by phy.ioal
menaoe ha. placed the plaintiff and her ohildren in fear of
imminent .eriou. bodily injury, Thi. ha. inoluded but i. not
limited to the following .peoific inetanoe. of abu.e,
a, On or about December 31, 1993, the defendant became
angry that the two year old waB crying about a diaper change,
grabbed her by the arm., forc.fully eat her on the table, end

b. On or .bout D.oemb.r 20, 1993, whi1. the two year old
wa. cryinq b.caue. .he didn't want a b.th, the d.t.nd.nt b.aam.
.ngry, toroetu11y grabbed the ohild and .at h.r down an~ roughly
undr....d her, Th. d.t.ndant again torc.tu11y gr.bb.d the ohi1d
and thr.w hel' into the tub. The child wa. afraid, crying
hyat.rioa11y, and re.ching out tor her moth.r.
c, On or .bout Dec.mb.r 7, 1993, the d.tendant b.cam. up.et
b.cau.e the two chi1dr.n had be.n arguing, ran into the kitohen,
grabbed the thirteen y..r old by her throat with both handa and
.hook h.r. The d.f.lldant th.n picked up the child by the neck,
holding her above the floor and put h.r down roughly, causing her
to tall to the t100r, The defendant grabbed her off of the floor
by the throat, carrying her to the door and thr.w her out the
door, kioking h.r i~ the .ide with hi. toot, Th. plaintiff
ca11.d 911, grabbed the two y.ar old, ran out the back dcor, got
into the car, and picked up the thirt..n year old who wa. walking
down the .tr.et, Th. p1aintitt dropp.d the children off at her
par.nt. home and returned to tho marital re.id.nce to q.t clothes
tor har.alt and her two children. When ahe walked up to the
door, the detandant told her to qet away/ threateninq her aayinq
that he had a qun, Plaintiff left and went to a neighbor" houae
tQ call the pelice. While calling the polic., ahe heard a
gunahot outeide, The police arrived, arreeted the defendant,
oontieeated hi. weapone/ and admitted him to Holy Spirt
Hoepital'e peychiatric ward, The child euffered eorene.. to her
throat and neck and bruiainq to her. eide, When the plaintiff waa
able to go into the houae/ ahe eaw that the defendant had left
full cartridqea of bulleta on the floor of each child'a room.
d. In or around Auquet 199~, while the plaintiff wae tryinq
to give the two year old medicine, ehe aaked the defendant to
hold the child, The defendant qrabbed the child'e leq and ueed
exceaeive force to hold the child down on the bed, He had been
holding the child down with euch force that he became red in the
face. When the plaintift wae able to qet the detendant'. hand
off the child, she eaw that the defendant had left a red mark on
the child'e leq.
e, In or around May 1992, while the plaintiff and defendant
were arquing, and the plaintift was holding the baby, the
detendant came at the plaintift and punched her in the cheek,
caueing the p1aintitt to haVe a black and blue tace,
~. On approximately December 31/ 1993, the plaintiff and
her two children left their reeidence at 1333 Zimmerman Road,
Carli.le, cumberland county I Pennsylvania in order to avoid
turther abu...
