This action art..s out of a slip and faU accident which
occurred on the Defendant'e property on March 19, 1993. Plaintiff
.uffered a back injury with as.ociatad pain and suttering.

p.ycholoqical iniury~ Accordingly, Plaintiff's psycholoqiaal
condition has not been made an is.ue in thie case and Plaintiff
doe. not seek damaq.s beyond his claim of pain anet Buttering
resulting from the back injury suatained in the accident.

Plaintiff, Dr. stewart Hartman, a. part of a pain management
prograll, raterred Plaintiff to e p.ychologiet who, in turn,
provided Dr. Hartman with psychologioal evaluation.. Both ooun..l

advanoe of hie July 26, 1994 depo.ition. Dr. Hartman did not
