In regards to the above mentioneQ, the facts concernin~ this ~roperty are that Mr. Roth installed a nel/ sewage disjXllJal system without first obtaining the proper permit, and that he installed this system in a soil ty~ which is unsuitable for an on-lot system, and he placed it in a location which was I/i thin 50 ft. of a sj)r1ng. Title 25, CH. 72.22 (b) states that a permit is required by the loc~l agency for alterations to an exi$ting individual or community on-lot eewa~e system when the alteration requires the repair, replacement or enlar~sment of a treatment tank, subsurface absorj)tion area or retention tank. Mr. Roth did not obtain a permit from North Newton Township. Title 25. CH 73.14 (b) states that when the examination of the soil profile reveals a limiting zone within 20 inches of the minoral 80il surface, percolation tests may not be conducted and a permit shall be denied. A eoil probe was dug directly beside the system Mr. Roth installed, and I observed soil mottling at 6 inches. Any horizon or condition in the soil ~rofile or underlying strata which will interfere in any way with the renovation of sewage effluent before enterin~ the ground water table is callsd a li~iting zone. Limiting zones can consist of the presence of a water table condition SUfficiently close to the .urface that sewage effluent could be introduced to the ground water table beforl being renovated by ~assage through suitable soi1e. Soil mottling is the most common indicator of a watsr table condltion because it is evidence that the loils have been saturated SUfficiently long enough to cause a chemical or phYlical chan~e. Soil mottling is identified in the soil by irregularly marked spots of different colors that very in nwnber and size. The CWI\l:)erland County Soil Survey confirms what I have found on this site. Thil lite consists of the Melvin Silt Loam. This is a nearly level, deep, poorly drained soil on flood plains. Typically, the surface layer is grayish brown lilt loam 9 inches thicf:. The subsoil is mottled, grayish brown silt loam 17 inches thick. Permeability is moderate, and available water capacity i8 high. Surface runoff is slow or ponded. The high water table is at the lurface or within 1 foot. This soil is occasionally flooded. In molt areas this soil is usod as pasture or woodland. North Newton TOlnl.hip employs me to issue all sewa~e disposal permits, and do all of the Ailproprl,ate soil tllsting prior to permit issuance. The Supervillorli did not give their consent to install a system without a permit, nor have they evor done this in the past. Mr. Roth did not obtain a permit from me. 3. Mr. Roth denies the averments of fact contained in paragraph six (6) of the complaint. Mr. Roth did install a nel; septic dosing tanf:, and tr.en connected this to a new absorption bed area. Mr. Roth admitted to me tl~t he did this because the original system for this house discharged directly into the Green Sprin>;, and he felt this lias a bette~ way. As my ro:x>rt shows, mottling is an indication that the water table was within six (6) inches of the surfac~ on this site. I did not r.eport this to be four (4) inches. Also, I did not say anythin~ about the water level bein& so lhallow, I .aid that the loil mottling indicates that during the wet season the vater table was at the depth indicated by the mottling. 4. Mr. Roth does hllve kno\rladge that sellaye fran his system eventually ends up in tho Green Spring. I have previously explained to Mr. Roth the same info~ation that I stated in my report. Mr. Roth doesn't 3e~ to understand, nor d08s he oven try. I also have previoualy ex~lained to Mr. Roth that If he felt my conclusion of the soil conditions on his ~roperty were wrong, he could have the 80ils re-checlced by a Profllssional Soil Scientist. 5. Mr. Roth denied the averments of fact contained in paragraph eight (8) of the complaint. DER usually sends all partiea involved with a malfUnction a copy of their letter. I thought DER sent them a copy. 6. Mr. Roth denied part of tho averments of fact contained in paragraph nino (9). Mr. Roth was informed of the solutions to replace his illegal system, I told him to 8i ther sul:mi t plans from an Engineer for an 8lr,,-arimental system, or that he coul~ install a sealed holding tank. I also indicated to him that 80il testing could be done on the land he olms above tho flood plain. Mr. Roth denies the avermento of fact contained in paragraph four (4) of the complaint.
