Plaintiff, Ray Ritchie, t/d/b/a Ritchie Logging' Trucking ("Ritohie"), ie an adult individual with a busin.sa addresa of 3060 camp Swatara Road, Bethel, Berks county/ Pennsylvania 19507. 2. Defendant 11, Arbour Resource Reoovery, Inc. ("Arbour Reoovery"), ia a busine.s corporation with a principal bu.ine.. addre.. of P.O. Box 67, Me~ick, Michigan 49668. 3. Defendant 12, Equipment Finance, Inc. ("Equipment Finance"), is a corporation organized and operating under the lawa of the COmMonwealth of Pennsylvania with a principal bueine.a addr..a of 118 We.t Airport Road, suite A, Lititz, Lancaster County, Penn.ylvania 17543. 4. At all times mentioned herein it i. believed and therefore averred that John s. Sherman ("John Sherman") waa acting within the .oope of his employment ae an authorized agent of Arbour ~ t .. R'QOVer~. e. In or about January, 1993, Ritchie contaoted Equipment Finance attar learning that the company had been involved in the .ala of equipment to a third party, unrelated to thi. action. 6. A repre.entativa of Equipment Finance informed Ritchie about an available John Deere Grapple Skidder, Model No. 640! Seri.l No. 35n65 ("Skidder") owned by Arbour Reoovery, qiving Ritchie the telephone number of John Sherman. 7. The repre.entative ot Equipment Finanoe told Ritchie that the Skidder wa. in good working condition and was being .old .olely beoau.e Arbour Reoovery wa. no longer performing olear ~utting. 8. It i. believed and therefore averred that Equipment rinance i. a financing company having an ownership interest in the Skidder. 9. Baaed upon representations from both Defendanta that the equipment waa in running oondition, Ritchie made arrangement. to puroha.e the Skidder, uaing a low boy trailer belonging to Equipment Finance to tranaport the Skidder from Michigan. 10. On or about February 17, 1993, relying on Defendant.' repre.entationl and without examination, Ritchie paicl '25,000.00 to Ilquipment rinance for the Skidder. 11. On February 23, 1993, when the truok arrived at Arbour'. plaoe of bUlinesa to piok up the Bkidder, the skidder would not .tart and had to be towed onto the low boy. 12. It ia believed and therefore averred that John Sherman, 2 I' . . fal1ael to eli.enqage the tranlmi..ion when towinq the Skidder onto the low boy. 13. It il believed and therefore averred that John Sherman utilized a bulldozer to tow the Skidder to the low boy for tran.port to Ritchie'. place of bUline.. in Bethel, Lehiqh county, Penn.ylvania. 14. A.. re~ult of John Sh.rman" failure to di.enqaqe the tran.mi..ion when the motor wa. inoperative, it i. believeel and therefore averred that the transmieeion qears of the skidder were .hreelded, r"ulting in metal shavinqe beinq lodqed in the tran.mi..lon oaling. 15. Only upon receipt ol the Skidder did Ritohie learn that Arbour Recovery had towed the Skidder onto the truck he had .ent. 16. Ritohie was then informed that the Skielder had to be towed onto the low boy beoause it would not start, owinq to alleqedlY minor motor problems. 17. Immediately upon receivinq the skiddsr, Ritchie noted that a winoh drive line, whioh was a part of the Skidder and promi..d by the Seller, was not included. 18. Upon receipt ol the Skidder, Ritchie determined that it ooulel not be etarted, and after .everal unsuccee.lul attempt. to contaot John Sherman, finally called Equipment Finance with regard to the .ituation. 19. Equipment Finance advised Ritchie that it would oontact John Sherman .0 that the Skidder oould be placed in working oondition. 3 I ' I 4 . . 3Q. John Sherman, a. agent for Arbour Recovery, adv1.ed he would come to Ritchie'. place of bu.ine.. to repair the Skidder. 31. At a later time, John Sherman .t,ted that he would bring in the winch drive line when he came to Bethel to perform work on the Skidder. 32. At all time., both Defendant. a..ured Ritchie that the Skidder would be placed in 900d, operating oondition. 33. Ritchie aqreed to accept the skidder rather then rejeot it, or revoke the a9reement, based solely upon the representation. of both Defendante that they would repair it and make it operable. 24. A. a re8ult of the involvement of ~quipment Finane., John Sherman came to plaintiff's place of busine.s to repair the Skidder and remained there from March 2, 1993 to March 13, 1993. 2S. It is believed and therefore averred that ~quipment rinance provided John Sherman with funda to come to Bethel, penn.ylvania and to repair the Skidder. 26. John Sherman finally got the motor to start on the Skidder on March 13, 1993. 27. John Sh$rman was aware when he left that he had not repaired the motor problem. 28. John Sherman failed to discover or ignored the main bearing problem with the motor, which caused the motor's shaft to be worn, further reaulting in damage to new bearings installed by Defendants. 29. Defendants failed to repair the motor 80 that other, latent damage could be diagnosed during motor operation. 4 <f . , 30. After having to repl~c. the motor, Ritchie diecovered the trane.i..ion problem. 31. At no time until after the motor wae running could Ritchie have determined that the skidder had a damaged transmieeio~. 32. The following waa diacoveredr a) En9ine mounte worn out, b) Radiator fan e~roud mieeing, c) En9ine mounting bolt. miSlling, d) Air cleaner damaged and mounts miuinq, and e) I9nition inoperative, requirin9 new wiring. 33. Ritchie has expended the following sums, initially to repair and replace the motor and related parts, and subsequently to repair the transmission I a) Motor (see Schedule "A" attached hereto) Tranemiseion (See Schedule "B" attached hereto) TOTALt $ 20,710.24 b) 6 13.360.98 $ 34,071.22 34. In addition, eince the date of purchase on rebruary 17, 1993, Ritchie did not have the use of the subject skidder throuqh October 1, 199j, his loet use having a reasonable value of $49,000.00. 35. In addition, the winch drive line has never been fUrniehed, the replacement cost being approximately $700.00, and the winch neede repaire, which have been estimated to be approximately U,500.00. 36. Neither of the above could have bean discovered until the .ubject 8kidder: wal lIacSe Qperable. 37. In addition to the aUIIs already expended for motor end tranalli..iQn repairs, the following futur.e repairs are needed, a) Missing winch drive line - $700.001 b) Repaire to winch - approximately $1, '100.001 c) Severe oil leak on qrapple control valve - $425.00 parts and labor, and cS) Severe oil leak on front differentilll - approximately $2,000.00 parts and labor. 38. Both Defendants made POBt-Durchase ~romise. to repair the ekidder and place it in good working condition, and Ritchie relied on the.e to refrain from rejeoting or revokinq hie acceptance. 39. The subject repair problems were latent in nature and could not even be fully di.covered by simple inspection or until the motor etartecS and was operatinq in goar. 40. At all time., both Defendant., by their authorized agent., minimi.zecS the nature, cost and extent of the repairs needed to place the SkicScSer in operating condition. 41. Until after: delivery and examination by hie own ex- pert., Ritchie OQuld not have become aware of thes. latent defect. 6 " .( pr..ent in the Skidder. 42. Ba.ed upon the Agreement of Sale between the partiee and the nature of the repair problem. and latent defect. in the equipment, Defendante had a duty to repair the Skidder. COUNT .1. - AISUMPSIT 46. Ritchie incorporates the alleqations in Parag~aph. 1 through 45 as if tUlly set forth herein. 47. Subsequent to the purchase of the Skidder, both Arbour Recovery and ~quipment Finance, through their representation. and aotione took an active role in attempting to fix and repair the equipment. 48. Ritchie relied on Defendants' promises of a qood, operlting pieoe of equipment and sub.equently upon their promiee. of repair. 49. Ritchie's reliance on the representations of the Defendants was justifiable, owing to his reasonable expectation. that the equipment would be delivered to him or ultimately plaoed in I good, operable condition. ~O. COUNT II - 1'llAV.D ~1. Ritchie incorporate. the allegations in Paragraphe 1 through 50 as if fully set forth herein. 52. Prior to the delivery of the Skidder, Ritchie waf informed by a representative of Equipment Finance and John Sherman of Arbour Recovery that the equipment was workinq and in qood oondition. 53. It is believed and therefor~ averred that both Defendant. were aware or should have been aware that the equipment we. not in 900d operating condition prior to delivery or that Sherman wes capable of repairin9 the equipment probleme. 54. Defendant knew that Ritchie waa unable to inspect thl Skidder prior to it. delivery. 55. The equipment wa. delivered subsequent to Ritchie's payment of the purchase price ot $25,000.00. 56. Prior to Ritchie's purohase of the equipment, both Defendant. made material representations as to the good condition and workinq ability of the Skidder. 57. These representations were fftlee, and Defendant. were e , , , aware Qr .hould have been aware of said falsity. 58. Ritchie rea.onably relied upon Defendants' fraudulent .tat.m~nt. in hi. purcha.e of the Skidder, and ha. .ub.equently b.en harmld by that reliance. 59. Had the 6kidder been a. represented, it. fair Market value would have been $40,000. 60. In it. delivered .tate, the Skidder wa. worth $5,000. 61. By virtue of Defendant.' misrepre.entation, Plaintiff lo.t $35,000.
