2. The Defendants are Michael L. Lear and Tracy A. Lear, his wife, who are
adult individuals resldlnll at 105 Butler Street, Mt. Holly Sprlnlls, Cumberland County,
Pennsylvania 17065.
3. By Installment Sales Contract ("Contract") dated January 31,1992, Robert O.
Helser conveyed the premises described in the contact, Exhibit "A" attached hereto and
made a part hereof, to Michael L. Lear and Tracy A. Lear, his wife. this Contract wa.~
recorded In Cumberland County Misc. Book 411 Poge 370 et. seq., all of which pages Ilre
Incorporated herein by reference and made a part hereof.
4. Defendants defaulted under the terms and conditions of the Contract by
falling to make monthly payments and pay taxes.

SERIOUS DEFAL'L T because YllU have nm made the puyments for the following: May,
1993 . lute charge of 5:0.5:: June. [9'13 . 5410.36 (late charge of 520.52): July, 1993 .
5410.36 (late churge of 5:0.5:); and. 19'13 County and Tllwnship Tuxes. 5200.70: The toml
amount now reljuired 10 cure this defuult. llr in other words. get caught up in your payments,

his right to accelertlle the installment payments. This means that whatever is owing on the
orillina! amount borrowed will be considered due immediately and you may lose the chane.
to payoff the original amount In monthly installments. If full payment of the amount of
default is not made within thirty (30) days. Mr. Heiser also intends to instruct this office to
starl a lawsuit to foreclose your mOrtguged property. If the mOrlgage is foreclosed. your
property will be sold by the Sheriff to puy off the mortgage debt. If Mr. Heiser refers your
cuse to this office. but you cure the defuult before we begin legul proceedings against you.
you will still huve to pay the reasonable attorney's fees actuully incurred. up to 550.00.
However, if legul proceedings ure sturted uguinst you. you will have to pay the reQ.5onable
attorney's fees even if they are llver 550.00. Any attorney's fees will be added to whatever
