COMPLAINT IN MORTGAGE FORECLOSURE
1. Plaintiff, PLATTE VALLEY FUNDING,L.P. is the corporation designated as Plaintiff
in the above caption. It has an office for the c~nduct of business at the address set forth in
the caption. Plaintiff; brings this action to foreclose on a mortgage dated August 06, 1990
between GMAC Mortgage Corporation ofPa. and Mark S. Briner which was recorded in
the Office of the Recorder of Deeds of CUMBERLAND county in Mortgage Book 986
page 003 on August 07, 1990.
(a). By written assignment dated GMAC Mortgage Corporation of Pa. assigned said
mortgage to plaintiff herein PLATTE VALLEY FUNDING,L.P. . Said assignment is
being recorded in the office of the recorder of deeds of CUMBERLAND County
simultaneously herewith.
2. Each defendant is an individual whose name and last residence is stated in the caption
and the interest of each is as Mortgagor and real owner. The infonnation regarding the
Mortgage is as follows:

The legal description of the mortgaged premises is attached hereto as ExhibIt" A ".
3. The mortgage secures Defendant(s) certain Note dated August 06, 1990 in the amount
ofS64,350.00 with interest at the rate of 10.00% per annum payable in monthly payments
of S564.72. A copy of the Mortgage and Note is attached hereto as Exhibit "B".
If the United States of America is named as a defendant then th United States of America
claims a federal tax lien against the mortgage premises as set forth in Exhibit "F" attached
hereto.
4. The Mortgage is in default because of defendant(s) failure to make the payment due
September 01, 1993 and the following amounts are due on the Mortgage:

and Pennsylvania law, and wiD be collected in the event judgment is entered against the
defendants. If the Mortgage is reinstated prior to judgment being entered, reasonable
attorney's fee will be charged.
6. Notice of Intention to Foreclose has been sent to Defendant(s) by Certified Mail as
required by Act 6 of 1974 of the Commonwealth of Pennsylvania on the date set forth in
the true and correct copy of such notice attached hereto as Fxhibit "C".
7. Notice required by Pennsylvania Act 91 has been sent to each defendant and is attached
hereto and marked Exhibit "D" and each Defendant has either failed to proceed thereunder
within the prescribed time limit, or has been determined ineligible or Plaintiff has not be.:n
notified of Defendant's eligibility in a timely manner. If this Mortgage is insured by the
Federal Housing Administration (FHA) under Title n of the National Housing Act, by the
FHA as above described, then the notice described in this paragraph is not required and
has not been sent and therefore no copy is attached.
WHEREFORE, the Plaintiff demands judgment against each defendant herein, jointly,
severally in the total sum stated in paragraph 4 plus interest from August 0 I, 1993 at the
rate ofS17.00 to the date of judgment and other costs and charges collectible under the
Mortgage and for the foreclosure and sale of the mortgaged property.

ALL THAT CERTAIN lot or parcel of ground situate in the Borough
of lemoyne, County of Cumberland and State of Pennsylvania, more
particularly bounded and described as follows:
BEGINNING at a point on the southern line of Hummel Avenue at the
distance of 145 feet measured in an easterly direction from the
southeast corner of Ninth Street and Hummel Avenue; thence in a
southerly direction along the Une of Lot No. 18, Section "E", on the
Plan of Lots here~after mentioned, 150 feet to Peach Alley; thence in
a westerly direction along the northern line of Peach Alley 17.5 feet,
more or less, to a point; thence in a northerly direction along the
line running through the center of the partition wall of the double
two and one-half story brick and frame dwelling house erected on Lot
No. 19, Section "E", on said Plan, 150 feet to a point on the southern
line of Hummel Avenue; thence in an easterly direction along the
southern line of Hummel Avenue 17.5 feet, more or less, to the point

TAKE NOTICE that on 12/7/94 at 10:00 AM (prevailing local
time); the Sheriff of CUMBERLAND County, Pennsylvania will sell the real propeny,
together with any home and all other improvements thereon, that is located at 830
HUMMEL AVENUE. The real propeny is more fully described in the attached legal
description, which is incorporated herein by reference. This sale will take place at
CUMBERLAND COUNTY COURTHOUSE,CARLISLE,PA. The owner or reputed
owner of the real propeny is as follows: MARK S. BRINER

The sale is being held pursuant to a writ of execution issued on the JUDGMENT
entered in favor of the above Plaintiff and against the above Defendant, which judgment is
indexed to the above docket number in the above coun of Common Pleas.
A SCHEDULE OF DISTRIBUTION showing who will receive the proceeds of
the sale will be posted in The Sheriff's Office within thiny (30) days after the sale date, and
distribution of the sale proceeds will be made in accordance with the Schedule unless you

ALL THAT CERTAIN lot or parcel of ground situste in the Borough
of lemoyne, County of Cumberland and State of Pennsylvania, more
particularly bounded and described aa follows:
BEGINNING st a point on the southern line of Hummel Avenue at the
distance of 145 feet measured in an easterly direction from the
southeast corner of Ninth Street and Hummel Avenue; thence in a
southerly direction slong the line of Lot No. 18, Section "E", on the
Plan of Lots here~nafter mentioned, 150 feet to Peach Alley; thence in

a westerly direction along the northern line of Peach Alley 17.5 feet,
more or less, to a point, thence in a northerly direction along the
line running through the center of the partition wall of the double
two and one-half story brick and frame dwelling house erected on Lot
