'" 4, Plaintiff does not allege the essential elements necessary to establish an oral contract existed between Plaintiff and Defendant. 5, Plaintiff does not disclose if the liability asserted as to these two defendants is joint, joint and several, or separate, 6. Plaintiff does not set forth the period of time the alleged electrical service was provided to Sterrells Gap. 7. Plaintiff does not allege the specific periods of time wherein service was provided to Sterrells Gap, but not paid for by the party responsible for such payment. 8, Plaintiff does not allege any relationship which makes Defendant liable for the service provided to Sterrells Gap prior to the alleged August, 1993 transfer. 9, Plaintiff does not set forth any material facts that Defendant Brian Chronister failed to pay for services provided between August of 1993 and December of 1993, the period that Plaintiff alleges the account was in his name, 10, Plaintiff does not allege or set forth any material facts that by tranSferring the account, the Defendant became liable for the delinquencies existing on the account prior to said alleged transfer. 11, Plaintiff alleges only a "belief' that Defendant is responsible for the bill which Plaintiff states is "in Defendant Barker's name", and Plaintiff fails to set forth material facts giving rise to such belief, WHEREFORE, Defendant Brian Chronister, respectfully requests this Court to dismiss the complaint because of the legal insufficiency of the Pleading or, in the alternative, to order amendment of the Pleadings to provide sufficient clarity so as to enable the Defendant to state definite answers, ~,~~::::'~:..
