COMPLMNT
AND NOW, come Plaintiffs, Michael Hoffman and Cheryl Hoffman, by
their undersigned counsel, and respectfully brings this Complaint
setting forth in support thereof as follows:
1. Plaintiffs Michael Hoffman and Cheryl Hoffman are adult
individuals, husband and wife, residing at 5 Robert Paul Drive,
Etters, York County, Pennsylvania.
2. Defendant Rosemary Z. Holbert is an adult individual residing
at 1900 Kent Drive, Camp Hill, Cumberland County, Pennsylvania.
3. Defendants Emidio E. Zaccarelli and Esther G. Zaccarelli are
adult individuals, husband and wife, who reside now or formerly at
1465 Hillcrest Court, Apartment 605, Camp Hill, Cumberland County,
Pennsylvania.
4. At all times and circumstances pertinent hereto, Defendant
Rosemary Z. Holbert was the attorney in fact for Defendants Emidio
E. Zaccarelli and Esther G. Zaccarelli.

5. On or about October 12, 1993, Plaintiffs and Defendant
Rosemary Z. Holbert, as attorney in fact for Defendants Emidio E.
Zeccarelli and Esther G. Zaccarelli, entered into a certain
Agreement for the purchase of real estate owned by Plaintiffs
situate at 5 Robert Paul Drive, Etters, York County, Pennsylvania.
A copy of that Agreement is attached hereto as Exhibit A and
incorporated by reference herein.
6. Under the terms of paragraph 6. (b) of the said Agreement of
Sale, Defendants Emidio E. Zaccarelli and Esther G. Zaccarelli were
to make an application with a responsible lending institution
within ten (10) days of Sellers' acceptance of the Agreement.
7. The parties had agreed on the terms as set forth in Exhibit
A no later than October 14, 1993, when Defendant Holbert, as agent
for Defendants Emidio E. Zaccarelii and Esther G. Zaccarelli,
agreed to the modifications as noted in paragraphs 4, 6. (a), 6.
(e), 9, and 11.
8. On or about October 12, 1993, Defendant Rosemary Z. Holbert
tendered to RE/MAX, Realty Associates, Inc., as escrow agent, a
check in the amount of $2,000.00 as the down payment on the
Agreement.
9. The check issued by Defendant Holbert as down payment was
deposited by RE/MAX on the next business day after the aforesaid
modifications to the Agreement of Sale were agreed to by
Defendants. On October 19, 1993, that check was presented for
payment to Defendant Holbert's bank, and was dishonored because

payment was stopped. A copy of the face of that check is attached
hereto, labeled Exhibit "B", and incorporated by reference herein.
10. Defendants Emidio E, Zaccarelli and Esther G. Zaccarelli did
not apply for a loan with any responsible lending institution
within ten (10) days of the date of the Agreement.
NEW MATTER
COUNT I
Michael Hoftman and Cheryl Hoffman v.
Emidio E. Zaccarelli and Esther G. Zaccarelli
11. Paragraphs 1 through 10 above are incorporated by reference
herein.
12. Defendants Emidio E, Zaccarelli and Esther G. Zaccarelli are
in default of the Agreement because:
A. They have failed to apply for financing within the ten (10)
day period required under the Agreement;
B. They fai led to tender the down payment of $2, 000. 00 as
required by the Agreement.
13. Plaintiffs have made a timely Notice of Default and demand
for relief.
14. Defendants have failed to make a deposit and have failed to
pay over liquidated damages.
15. Under the terms of the Agreement, Plaintiffs are entitled to
$2,000.00 liquidated damages.
WHEREFORE, Plaintiffs respectfully request judgment against
Defendants in the amount of $2,000.00 together with interest and

costs of suit.
COUNT II
Michael Hoffman and cheryl Hoffman v.
Rosemary Z. Holbert
16. Paragraphs 1 through 15 above are incorporated by reference
herein.
17. Alternative to paragraph 4 above, Defendant Holbert entered
into the Agreement and tendered monies without the authority of
Defendants Emidio E. Zaccarelli and Esther G. Zaccarelli.
18. Defendant Holbert is personally liable to Plaintiffs for
damages under the terms of the Agreement because she acted in
excess of her agency authority.
WHEREFORE, Plaintiffs respectfully request judgment against
Defendant in the amount of $2,000.00 together with interest and
costs of suit.
COUNT III
Michael Hoffman and cheryl Hoffman v. Rosemary Z. Holbert,
Emidio E. Zaccarelli and Esther G. Zaccarelli
19. Paragraphs 1 through 18 above are incorporated by reference
herein.
20. As per the terms of the Agreement, Defendants were to place
in escrow the sum of $2,000.00.
21. Defendants failed to place in escrow $2,000.00. In reliance

on the check tendered, Plaintiffs took their home off the market
and lost valuable marketing time for at least three weeks.
22. Under the circumstances of this case, Plaintiffs are entitled
to specific performance.
WHEREFORE, Plaintiffs respectfully request that Defendants and
each of them be directed to pay into escrow $2,000.00. Plaintiffs
further request a constructive trust on the bank account of
Defendant Rosemary Holbert to trade some monies that she urgently
tendered in the check which was dishonored upon presentment.
Plaintiffs further request reasonable attorneys fees and costs of
suit.

NOW COME the Defendants, ROSEMARY HOLBERT and EMIDO and ESTHER
ZACCARELLI, by their attorney, Charles E. Petrie, and respectfully
represent as follows:
1. That Plaintiff are MICHAEL HOFFMAN and CHERYL HOFFMAN,
his wife, who currently reside at 5 Robert Paul Drive, Etters,
County of York, Pennsylvania.
2. That Defendants are ROSEMARY HOLBERT, EMIDO ZACCARELLI
and ESTHER ZACCARELI, who currently reside at 1900 Kent Drive,
Camp Hill, County of Cumberland, Pennsylvania.
3. That District Justice Charles A. Clement, Jr., at a
heariny on December 21, 1993, found in favor of Plaintiffs
pursuant to their civil complaint docketed to CV-0000394-93 in the
amount of $2,000.00 plus costs.
4. That the undersigned appeared personally at the
Cumberland County Courthouse to file an appeal on behalf of the
defendants on January 19, 1994, at 3:30 P.M. but he was informed
that the Courthouse was closed.
5. That the Cumberland County Courthouse was closed for the
entire day on January 20, 1994.
6. That the appeal was filed in the Office of the
Prothonotary on January 21, 1994, docketed to Number 240 CIVIL
1994.
7. That on January 21, 1994, the District Justice entered
jUdgment against Defendants in the amount of $2,051.50, and said
jud~ment was entered in the Office of the Prthonotary of
Cumberland County on January 25, 1994, docketed to Number 319
CIVIL 1994.
WHEREFORE, Defendants respectfully request that YOur
Honorable Court enter a Rule upon Plaintiffs to show cause, if any
