COMPLAINT
AND NOW, comes Farmers Trust Company, through its attorney,
William A. Duncan, Esquire, and files this Complaint in
Mortgage Foreclosure, of which the following is a statement:
1. Plaintiff is Farmers Trust Company, a corporation
organized and existing under the laws of the Commonwealth of
Pennsylvania with its main office and principal place of
business located at 1 West High street, Carlisle, Cumberland
County, Pennsylvania 17013.
2. Defendant, Danny L. Turner, an adult individual, and
Carol L. Turner, an adult individual, are husband and wife and
reside at 210 Big Pond Road, Shippensburg, Cumberland County,
Pennsylvania 17257.
3. On or about May 28, 1992, Defendant Danny L. Turner
made, executed and delivered to Plaintiff a note and a real
estate mortgage financing Forty-five Thousand and no/loa
Dollars ($45,000.00), a copy of said note and said real estate
mortgage being attached hereto as Exhibits "A" and liB",
respectively, and are incorporated herein by reference as
though fully set forth.

4. On or about May 28, 1992, Defendant Carol L, Turner
made, executed and delivered to Plaintiff a guaranty of said
mortgage and note in the amount of $45,000.00, more
specifically set forth in Exhibit "C", attached hereto and made
a part hereof by reference..
5. Said note and real estate mortgage have not been
assigned.
6. Danny L. Turner is the sole record owner in fee simple
of said premises subject to said mortgage, by virtue of a Deed
dated and recorded on October 29, 1984, and recorded in the
Cumberland county Recorder's Office in Deed Book "Y", Volume
30, Page 589, more specifically set forth in Exhibit "0",
attached hereto and made a part hereof by reference.
7. Said note and said real estate mortgage are in default
because Defendants herein have failed to pay the payments that
were due and owing for the months of October, 1993 to December
1993.
8. The Plaintiff has given to the Defendants written
notice of intention to foreclose on said mortgage as required
by law under Act 6, dated November 4, 1993, a copy of which is
marked Exhibits "E" and "F", and attached hereto and made a
part hereof by reference.
9. The Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 1983,
dated November 4, 1993, a copy of which is marked Exhibits "G"
and "H", and attached hereto and made a part hereof by
reference.

10. By reason of the aforesaid default, the entire
principal balance of Forty-three Thousand Eight Hundred
Thirty-nine and 98/100($43,839,98) Dollars, with interest
thereon at the rate of nine and 25/100 (9.25) percent per annum
computed from October 28, 1993 totalling Nine Hundred
Twenty-five and 51/100 (925.51) Dollars, charges in the amount
of Two Hundred sixteen and 27/100 ($216,27) Dollars, accruing
insurance premiums, attorney's fees in the amount of six
Thousand Five Hundred Seventy-six ($6,576.00) Dollars are now
due and payable.
11. The Defendants are liable to the Plaintiff for the
following on said mortgage loan:
A. Principal amount and interest
due through December 28, 1993: $ 44,765.49
B. Interest at 9.25% from 12/28/93
to date ($9.74/day) 204.54
C. Late Charges: $ 216.27
D. Attorney's Collection fee: $ 2,259.32
TOTAL: $ 47,445.62
WHEREFORE, Plaintiff prays the Court enter judgment in
favor of Plaintiff and order the foreclosure and sale of the
mortgaged property and for the amount of Forty-seven Thousand
Four Hundred Forty-five and 62/100 ($47,445.62) Dollars
together with interest thereon, costs and all other amounts
advanced by Plaintiff.
