NOTICE TO DEFEND AND CLAIM RIGHTS
You have been sued in court. If you wish to defend against
the claims set forth in the following pages, you must take prompt
action. You are warned that if you fail to do so, the case may
proceed without you and a decree of divorce or annulment may be
entered against you by the Court. A judgment may also be entered
against you for any other claim or relief requested in these
papers by the Plaintiff. You may lose money or property or other
rights important to you, including custody or visitation of your
children.
When the ground for divorce is indignities or irretrievable
breakdown of the marriage, you may request that the court require
you and your spouse to attend marriage counseling prior to a
divorce decree being handed down by the court. A list of
marriage counselors is available in the Office of the
Prothonotary at the Cumberland County Court House, Carlisle. You
are advised that this list is kept as a convenience to you and
you are not bound to choose a counselor from the list. All
necessary arrangements and the cost of counseling sessions are to
be borne by you and your spouse.

COMPLAINT
COUNT I GROUNDS FOR DIVORCE

The Plaintiff in this action is KAY D. HOFFMAN, an adult
individual, who resides at 1056 Tunberry Court, Mechanicsburg,
(Hampden Township), Cumberland county, Pennsylvania 17055.
2.
The Defendant in this action is LANTZ A. HOFFMAN, an adult
individual, who resides at 1041 Pennsylvania Ave~ue, Harrisburg,
(Lower Swatara Township), Dauphin County, Pennsylvania 17111.
3.
Both the Plaintiff and Defendant have been bona fide
residents of the Commonwealth of Pennsylvania for at least six
(6) months immediately previous to the filing of this complaint.
4.
The Plaintiff and Defendant were lawfully joined in marriage
on January 22, 1957, in Lewistown, Mifflin County, Pennsylvania.

There have been no prior actions of divorce or for annulment
between the parties except for a 1957 Divorce action in Mifflin

County, Pennsylvania in which Lantz A. Hoffman is the Plaintiff.
The case is docketed to No. 39, August Term, 1957. The file
consists of a Complaint, a Praecipe for entry of appearance by
defense counsel and a Rule issued on the 7th day of June, 1957.
No activity has occurred in this case since June of 1957,
according to information provided to Kay D. Hoffman.
6.
Neither party is a member of the armed forces of the United
states of America.
7.
The Plaintiff avers as the grounds upon which this action is
based is that the marriage between the parties hereto is
irretrievably broken.
8.
The Plaintiff has been advised that counseling is available
and that Plaintiff may have the right to request that the court
require the parties to participate in counseling.
9.
The Plaintiff requests the court to enter a decree of
divorce.

acquired property both real and personal during their marriage
from January 22, 1957.

The Plaintiff requests the court to equitably divide all
marital property pursuant to Section 3502 of the Pennsylvania
Divorce Code.
WHEREFORE, the Plaintiff, KAY D. HOFFMAN, prays your
Honorable Court to:
(a) enter a decree of divorce, divorcing the Plaintiff
from the bonds of matrimony heretofore existing between
the Plaintiff and the Defendant;
(b) order equitable distribution of marital property;
(c) order such other relief as the Court deems just
and reasonable.

By order of Court of President Judge George E. Hoffer
dated January 12, 1998, the full-time Master has been appointed
in the above referenced divorce proceedings.
A divorce complaint was filed on January 24, 1994,
raising grounds for divorce of irretrievable breakdown of the
marriage. The complaint also raised the economic claim of
equitable distribution.
The motion for appointment of Master indicates that the
statutory ground is under section 3301(d). I assume that
counsel are going to file an affidavit averring the separation
in excess of two years since apparently the Defendant is not
willing to execute an affidavit of consent.
In accordance with P.R.C.P. 1920.33(b) I am directing
each counsel to file a pre-trial statement on or before Monday,
February 9, 1998. Upon receipt of the pre-trial statements, I
will immediately schedule a pre-hearing conference with counsel

1. The Defendant, Lantz A. HolTman (hcreinafter rcferred to as "Member") is a member of
the Commonwealth of Pennsylvania, State Employes' Retirement System (hereinafter referred to
as "SERS").
2. SERS, as a creature of statute, is controlled by the State Employes' Retirement Code,
24 Pa. C.S. ~~5l01 et seq ("Retirement Code").
3. Member's date of birth is January 24, 1936, and his Social Security number is 185-26-
4802.
4. The Plain tilT, Kay D. HolTman (hereinafter referred to as "Alternate Payee") is the
former spouse of Member. Alternate Payee's date of birth is July 4, 1938, and her Social Security
number is 177-30-4331.

It is the responsibility of Alternate Payee to keep a current mailing address on file with

7. The Alternate Payee's share (also known as the equitable distribution portion) of the
Member's retirement benefit is as follows:
(a) A lump sum amount equal to $15,000.00 together with interest at the rate of 4%
per year, compounded annually, from the date of entry to this DRO until the date of payment,
plus
(b) A monthly benefit of $575.00 (together with any scheduled or ad hoc increases) for
as long as the Member lives followed by a monthly survivor benefit of$l,105.00 (together with any
scheduled or ad hoc increases) for as long as the Alternate Payee lives after the death of the
Mernber.
8. Member's retirement benefit is defined as all monies paid to or on behalf of Member by
SERS, including any lump sum withdrawals or scheduled or ad hoc increases, but excluding the
disability portion of any disability annuities paid to Member by SERS or any deferred
compensation benefits paid to Member by SERS. Payments to Alternate Payee shall commence as
soon as administratively feasible on or about the date the Member actually enters pay status and
SERS approves a Domestic Relations Order incorporating this Stipulation and Agreernent,
whichever is later.
9. Member hereby nominates Alternate Payee as an irrevocable beneficiary for the
following death benefit ifthe Member dies before his benefits commence:
$15,000.00 together with interest at the rate of 4% per year, compounded annually,
from the date of entry of this DRO until the date of payment plus the death benefit associated
with the monthly benefit of $575.00 (together with any scheduled or ad hoc increases) for as long
as the Member lives followed by a monthly survivor benefit of $1,105.00 (together with any

This nomination shall become elTective upon approval by the Secretary of the
Retirement Board, or his authorized representative, of any Domestic Relations Order
incorporating this Stipulation and Agreement. The balance of any death benefit remaining after
the allocation of Alternate Payee's share (in accordance with this Paragraph 9) shaH be paid to the
beneficiaries named by Member on the last Nornination of Beneficiaries Form filed with the
Retirernent Board prior to Member's death.
(a) If the last Nomination of Beneficiaries Form filed by Member prior to Member's
death (a) predates any approved Domestic RelatilJns Order incorporating this Stipulation and
Agreement, and (b) names Alternate Payee as a beneficiary, then: (1) the terms of the Domestic
Relations Order shall alone govern Alternate Payee's share of any death benefit, and (2) for
purposes of paying the balance via the last Nomination of Beneficiaries Form filed with the
Retirement Board prior to Mernber's death, Alternate Payee shall be treated as if Alternate Payee
predeceased Member. No portion of the balance shaH be payable to Alternate Payee's estate.
(b) In addition, Member shall execute and deliver to Alternate Payee an authorization
in a form acceptable to SERS, which will authorize SERS to release to Alternate Payee all
relevant information concerning Member's retirernent account. Alternate Payee shall deliver the
authorization to SERS which will allow the Alternate Payee to check that she has been and
continues to be properly nominated under this paragraph.
10. The term and amounts of Member's retirernent benefits payable to the Alternate Payee
after SERS approves a Domestic Relations Order incorporating this Stipulation and Agreernent is
dependent upon which option(s) is (are) selected by Member upon retiremento Member and
Alternate Payee expressly agree that the Member shaH select the following retirement option(s)
upon filing an Application for Retirement Allowance with SERS:

Special Option 4 under which:
a. Member shall elect to receive a refund of his contributions in an amount of at least
equal to $15,000.00 together with interest at the rate of 4% per year compounded annually, from
the date of entry of this DRO until the date of payment, and
b. Member shall elect ajoint and survivor annuity with the Alternate Payee as the
survivor annuitant under which, upon the death of the Member, $1,105.00 (together with any
scheduled or ad hoc increases) per month shall be payable to the Alternate Payee during her
Iifetimeo
The intent of this Special Option 4 is that the Alternate Payee shall be paid a lump sum
in accordance with Paragraph 7(a) and, also, that she shall be paid a monthly benefit of $575.00
(together with any scheduled or ad hoc increases) for as long as the Member lives followed by a
monthly survivor benefit of $1,105000 (together with any scheduled or ad hoc increases) for as long
as she lives after the death of the Member.
11. Alternate Payee may not exercise any right, privilege or option olTered by SERS. SERS
shall issue individual tax forms to Member and Alternate Payee for amounts paid to each.
12. In the event of the death of Alternate Payee prior to receipt of all of her payments
payable to her from SERS under this Order, any death benefit or retirement benefit payable to
Alternate Payee by SERS shall be paid to Alternate Payee's estate to the extent of Alternate
Payee's equitable distribution portion of Member's retirernent benefit as set forth in Paragraph 7.
13. In no event shall Alternate Payee have greater benefits or rights other than those
which are available to Member. Alternate Payee is not entitled to any benefit not otherwise
provided by SERS. The Alternate Payee is only entitled to the specific benefits offered by SERS as
provided in this Order. All other rights, privileges and options offered by SERS not granted to
Alternate Payee by this Order are preserved for Member.

14. It is specifically intended and agreed by the parties hereto that this Order:
(a) Does not require SERS to provide any type or form of benefit, or any option not
otherwise provided under the Retirement Code;
(b) Does not require SERS to provide increased benefits (determined on the basis of
actuarial value) unless increased benefits are paid to Member based upon cost of living or
increases based on other than actuarial values.
15. The parties intend and agree that the terms ofthis Stipulation and Agreement shall be
approved, adopted and entered as a Domestic Relations Order.
16. The Court ofCornmon Pleas of Cumberland County, Pennsylvania, shall retain
jurisdiction to amend any Domestic Relations Order incorporating this Stipulation and
Agreement, but only for the purposes of establishing it or maintaining it as a Domestic Relations
Order; provided, however, that no such amendment shall require SERS to provide any type or
form of benefit, or any option not otherwise provided by SERS, and further provided that no such
amendment or right of the Court to so amend will invalidate this existing Order,
17. Upon entry as a Domestic Relations Order, a certified copy ofthe Domestic Relations
Order and this Stipulation and Agreement and any attendant documents shall be served upon
SERS immediately. The Domestic Relations Order shall take elTect immediately upon SERS
approval and SERS approval of any attendant documents and then shall remain in elTect until
further Order ofthe Court.
WHEREFORE, the parties, intending to be legally bound by the terms of this Stipulation
and Agreement, do hereunto place their hands and seals.

You provided me with the following information concerning Lantz A. HolTman:
1. Date of birth - January 24, 1936.
2. Date married - January 22, 1957.
3. Date separated - January 6, 1994.
4. A statement as of December 3l, 1993, prepared by the State Employes' Retirement
System showing the following information for Mr. Hoffman:
a. Years of service - 21.91.
b. Accumulated contributions plus interest - $47,464.
c. If Mr. HolTman had retired on that date, he could have elected to receive a
monthly full pension of $1,708.01 or he could have elected to receive a refund of
his accumulated contributions plus interest and a reduced monthly full
pension of $1,429.86.
d. Final average salary - $53,087.
Currently, Mr. HolTman is 6l years of age (age nearest birthday).
The State Employes' Retirement System is a defined benefit pension plan. The pension
benefit provided upon retirement is based upon the fmal three-year average salary and the
years of service. Normal retirement is age 60 or after 35 years of service, if earlier.
Since Mr. Hoffman had cornpleted at least 10 years of service on December 31, 1993, he could
have retired on that date. If he continues to work. the benefits earned as of December 31.
1993. will be increased actuarially until his normal retirement age. His normal retirement
age under the Slate Employes' Retirement Systern was age 60,

Lantz A. HolTman was hired in 1972 and therefore, his entire pension as of December 3l,
1993, was earned during the marriage. I did not take into account the six days of service
from December 3l, 1993 (the date of the SERS information) to January 6, 1994 (the date of
separation). These six days of service are inconsequential.
The present value calculations are based upon the assumptions promulgated by the Pension
Benefit Guaranty Corporation for annuity valuations except that mortality was not taken
into account prior to the commencement of the pension. The interest is 6.3% per year for 20
years followed by 4.75% per year. The mortality is in accordance with the 1983 Group
Annuity Mortality Table.
In my opinion, the assumptions promulgated by the Pension Benefit Guaranty Corporation
for annuity valuations are appropriate for the purpose of determining the present values.

2. Date married - January 22, 1957.
3. Date separated. January 6, 1994.
4. A statement as of December 31, 1993, prepared by the State Employes' Retirement
System showing the following information for Mr. Hoffman:
a. Years of service - 21.91.
b. Accumulated contributions plus interest - $47,464.
c. If Mr. Hoffman had retired on that date. he could have elected to receive a
monthly full pension of $l,708.01 or he could have elected to receive a refund of
his accumulated contributions plus interest and a reduced monthly full
pension of $l,429.86.
d. Final average salary - $53,087.

The State Employes' Retirement System is a defmed benefit pension plan. The pension

Lantz A. HolTman was hired in 1972 and therefore, his entire pension as of December 3l,
1993, was earned during the marriage. I did not take into account the six days of service
from December 31. 1993 (the date of the SERS information) to January 6, 1994 (the date of
separation). These six days of service are inconsequential.
The present value calculations are based upon the assumptions promulgated by the Pension
Benefit Guaranty Corporation for annuity valuations except that mortality was not taken
into account prior to the commencement of the pension. The interest is 6.3% per year for 20
years fol1owed by 4.75% per year. The mortality is in accordance with the 1983 Group
Annuity Mortality Table.

In my opinion. the assumptions promulgated by the Pension Benefit Guaranty Corporation
for annuity valuations are appropriate for the purpose of determining the present values.

Husband was born January 24, 1936, and currently works
for the Pennsylvania state Game commission earning approximately
$55,000.00 per year.
Wife was born July 4, 1938, and currently works for
Health America earning approximately $55,000.00 per year.

made by husband.
In addition, husband replaced the roof on the home
for $3,500.00 and driveway for $2,100.00.

The wife's pension through her place of employment
at Carlisle Hospital is $46,957.08 and husband's
as of separation from SERS is $258,276.00.

WHEREAS, the panics hereto are desirous of settling fully and finally their respective
financial and propeny rights and obligations as between each other, including, without limitation,
the settling of all matters between them relating to the ownership of real and personal propeny,
the support and maintenance of one another and, in general, the settling of any and all claims and
possible claims by one against the othcr or against their respective estates.
MARITAL SETTLEMENT AGREEMENT
THIS AGREEMENT is made this~dayof laN-'~/-! ./,1998, by and
between KAY D. HOFFMAN, of Dauphin County, Pennsylvania, and LANTZ A. HOFFMAN,
of Dauphin County. Pennsylvania.
WITNESSETH:
WHEREAS, Lantz A. Hoffman (hereinafter referred to as "Husband"), social security
number 185.26.4802, was born on January 24, 1936, and presently resides at 1041 Pennsylvania
Avenue, Harrisburg, Dauphin County, Pennsylvania, 17110.
WHEREAS, Kay D. Hoffman (hereinafter referred to as "Wife"), social security number
177.30-4331, was born on July 4, 1938, and presently resides at 2865 Oakwood Drive,
Harrisburg, Dauphin County, Pennsylvania, 17110.
WHEREAS, the panies hereto arc husband and wife, having been lawfully married on
January 22.1957 in Lewistown, Mifflin County, Pennsylvania;
WHEREAS, the panies have lived separate and apan since on or about January 6,1994;
WHEREAS, three children were born of the marriage, all of whom are now emancipated
adults;

NOW, THEREFORE, in consideration of these premises, and of the mutual promises,
covenants and undertakings hereinafter set forth, and for other good and valuable consideration,
the receipt and sufficiency of which is hereby acknowledged by each of the parties hereto,
Husband and Wife, each intending to be legally bound hereby, covenant and agree as follows:
I. ADVICE OF COUNSEL The provisions of this Agreement and their
legal effect have been fully explained to the parties by their respective counsel, P. Richard
Wagner, Esquire, for Husband, and Donald T. Kissinger, Esquire, for Wife, Each party
acknowledges that he or she has received independent legal ad\'ice from counsel of his or her
selection, and that each fully understands the facts and has been fully infonned as to his or her
legal rights and obligations, and each party acknowledges and accepts that this Agreement is, in
the circumstances, fair and equitable, and that it is being entered into freely and voluntarily, after
having received such advice and with such knowledge, and that the execution of this Agreement
is not the result of any duress or undue influence, and that it is not the result of any improper or
illegal agreement or agreements. In addition, each party hereto acknowledges that he or she has
been fully advised by his or her respective altomey of the impact of the Pennsylvania Divorce
Code, whereby the court has the right and duty to detennine all marital rights of the parties
including divorce, alimony, alimony pelldellle Ii/e, equitable distribution of all marital property
or property owned or possessed individually by the other, counsel fees and costs of litigation and,
fully knowing the same and being fully advised of his or her rights thereunder, each party hereto
still desires to execute this Agreement, acknowledging that the tenns and conditions set forth
herein are fair, just and equitable to each of the parties, and waives his and her respective righlto
have the Court of Common Pleas of Cumberland County, or any other court of competent
jurisdiction, make any detennination or order affecting the respective parties' rights to alimony.

2. DISCLOSURE OF ASSETS. Each of the parties hereto acknowledges
that he or she is aware of his or her right to seek discovery, including but not limited to, wrillen
interrogatories, motions for production of documents, the taking of oral depositions, the filing of
inventories, and all other means of discovery pennilled under the Pennsylvania Divorce Code or
the Pennsylvania Rules of Civil Procedure. Each of the parties further acknowledges that he or
she has discussed with counsel the concept of marital property under Pennsylvania law and eaeh
is aware of his or her right to have the real and/or personal property, estate and assets, earnings
and income of the other assessed or evaluated by the courts of this commonwealth or any other
court of competent jurisdiction. The parties do hereby acknowledge that there has been full and
fair disclosure to the other of his or her respective income, assets and liabilities, whether such are
held jointly or in the name of one party alone. Each party agrees that any right to further
disclosure, valuation, enumeration or statement hereof in this Agreement is hereby specifically
waived, and the parties do not wish to make or append hereto any further enumeration or
statement. The parties hereby acknowledge and agree that the division of assets as set forth in
this Agreement is fair, reasonable and equitable, and is satisfactory to them. Each of the parties
hereto further covenants and agrees for himself and herself and his or her heirs, executors,
administrators or assigns, that he or she will never at any time hereafter sue the other party or his
or her heirs, executors, administrators or assigns in any action of contention, direct or indirect,
and allege therein that there was a denial of any rights to full disclosure, or that there was any,
duress, undue influence or that there was a failure to have available full, proper and independent
representation by legal counsel.

3. PERSONAL RIGHTS. Husband and Wife may, at all times hereafter,
live separate and apart. Each shall be free from all control, restraint, interference and authority,
direct or indirect. by the other. Each may reside at such place or places as he or she may select.
Each may. for his or her separate use or benefit, conduct, carry on or engage in any business,
occupation, profession or employment which to him or her may seem advisable. Husband and
Wife shall not molest, harass, disturb or malign each other or the respective families of each
other, nor compel or attempt to compel the other to cohabit or dwell by any means or in any
manner whatsoever with him or her. Neither party will interfere with the use, ownership,
enjoyment or disposition of any property now owned by or hereafter acquired by the other.
4. MUTUAL CONSENT DIVORCE. The parties acknowledge that on or
about January 24, 1994, Wife initiated a di\'orce action under the no-fault provisions of the
Divorce Code in the Cumberland County Court of Common Pleas docketed at No. 270 Civil
1994. It is the intention of the parties, and the parties agree, that by this Agreement they have
resolved all ancillary economic issues related to their divorce and, thus, this or any other divorce
action with respect to these parties shall be limited to a claim for divorce only. The parties
acknowledge that the ninety (90) day waiting period provided for under ~3301(c) of the Divorce
Code has expired and they therefore agree that, contemporaneously with the execution of this
Agreement, each will sign an Affidavit of Consent to Divorce and Waiver of Notice ofIntention
to Request Entry of Divorce Decree and deli\'er same to counsel for Wife, who shall promptly
submit said affidavits and waivers to the court, along with a Praecipe to Transmit Record, Vital
Statistics Fonn and any and all other documents necessary to precipitate the prompt entry of a
divorce decree.

S. EOUIT ABLE DISTRIBUTION.
(a) Marital Residence. The parties acknowledge that they are the
owners of that certain house and lot and all improvements thereupon situated at 1041
Pennsylvania Avenue, Harrisburg, Dauphin County. Pennsylvania, 17110 (hereinafterreferred to
as the "Marital Residence"). The parties agree as follows with respect to the Marital Residence:
(I) Contemporaneously with the execution of this Agreement,
Husband and Wife shall execute an appropriate deed, to be prepared by Husband's counsel in a
form satisfactory to Wife, conveying to Husband all of the parties' right, title, claim and interest
in and to the Marital Residence. Counsel for Wife shall hold the deed in escrow until Husband
pays to Wife the additional lump sum as set forth in subparagraph 5(g) of this Agreement, after
which time Wife's counsel shall deliver said deed to Husband's counsel. Thereafter, Husband
shall be the sole owner of the Marital Residence and shall be entitled to record said deed and take
any action with respect thereto that he deems appropriate.
(2) Upon delivery of the deed to Husband, any and all
homeowners policies, title policies, and any other policy of insurance with respect to the Marital
Residence shall be deemed to be endorsed to reflect Husband as sole owner thereof and Wife
further agrees that Husband shall be entitled to receive any payments then or thereafter due under
any such insurance policy.
(3) Commencing on the execution date of this Agreement,
Husband shall be solely responsible for all costs, expenses and liabilities associated with or
allributable to the Marital Residence, regardless of when such cost or liability arose, including,
but not limited to, the existing mortgage in favor of Fulton Bank, the home equity line of credit
with Fulton Bank, any other mortgages or equity loans or credit lines, taxes, insurance premiums,

utilities, maintenance and repairs, and Husband shall keep Wife and her successors, assigns,
heirs, executors and administrators indemnified and held hannless from any liability, cost or
expense, including actual attorneys fees, which may be incurred in connection with such
liabilities and expenses or resulting from Wife's ownership interest in the Marital Residence.
(4) Husband shall, within ninety (90) days from the execution
date of this Agreement, take all steps necessary to have Wife's name removed from the first
mortgage and home equity line of credit on the Marital Residence, even if refinancing is
necessary to accomplish removal of Wife from these liabilities, any such refinancing to be at
Husband's sole expense. Wife agrees to cooperate, at Husband's request, in any such refinancing
necessary to release her from the obligations associated with the Marital Residence.
(b) Furnlshln!!s and Personaltv. The parties agree that they have
divided by agreement between themselves all furnishings and personalty located in the Marital
Residence, including all furniture, furnishings, antiques, jewelry, rugs, carpets, household
appliances, personalty and equipment. Any personalty or furnishings remaining in the Marital
Residence as of the execution date of this Agreement shall be and remain Husband's sole and
separate property. free of any and all right, title, claim or interest of Wife. Any personalty or
furnishings now located in Wife's current residence as of the execution date of this Agreement
shall be and remain Wife's sole and separate property, free of any and all right, title, claim or
interest of Husband. Notwithstanding the foregoing, the parties acknowledge and agree that the
family photographs currently in the possession of Husband shall be equally divided with each
party to receive an equal amount of original photographs. Said division of photographs shall be
completed within thirty (30) days from the date of execution hereof.

(e) Motor Vehicles.
(I) Husband agrees that Wife shall retain possession of and
receive as her sole and separate property the 1996 Buick Regal automobile currently titled in
Wife's name, along with all rights under any insurance policies thereon and with all
responsibility for payment of any outstanding indebtedness pertaining thereto and insurance
thereon, free of any and all right, title, claim or interest of Husband.
(2) Wife agrees that Husband shall retain possession of and
receive as his sole and separate property the 1988 Chevrolet Caprice and the 1996 Ford Explorer
automobiles currently titled in Husband's name, along with all rights under any insurance
policies thereon and with all responsibility for payment of any outstanding indebtedness
pertaining thereto and insurance thereon, free of any and all right, title, claim or interest of Wife.
(3) Husband and Wife agree that they will cooperate with one
another and execute any and all documents necessary to effectuate the transfer of automobiles
and insurance coverage pursuant to the terms of this subparagraph.
(4) Each party shall indemnify and hold the other and his or her
property hannless from any and all liability, cost or expense, including actual attorney's fees,
incurred in connection with the vehicles awarded to that party under the terms of this
subparagraph.
Cd) Life Insurance. The parties acknowledge that each owns certain
Prudential Life Insurance policies. Wife and Husband each hereby specifically releases and
waives any and all right, title. claim or interest that he or she may have in and to any and all
policies of insurance owned by or insuring the life of the other, including cash surrender value, if
any, and also specifically to include a waiver of any beneficiary designation thereunder.

(e) Pension and Retirement Benef1ts.
(1) The parties acknowledge that Husband has acquired benefit
rights as a participant in the Commonwealth of Pennsylvania State Employes' Retirement
System ("SERS") and he has and will immediately make application for retirement. The parties
agree as follows with respect to Husband's SERS account:
(i) Husband shall elect to make a complete withdrawal
of his accumulated deductions and interest of which Fifteen Thousand Dollars (515,000), plus
four percent (4%) interest from the date of entry of the DRO to the date of distribution, shall be
paid to Wife.
(ii) Husband shall select an annuity which would result
in a total annuity payable to Wife Five Hundred Seventy-Five Dollars (5575) per month during
his lifetime and a survivor benefit payable to Wife of One Thousand One Hundred Five Dollars
(51,105) per month for Wife's life. Said sums shall be paid directly by SERS to Wife.
(iii) Wife shall be maintained as pre-retirement death
beneficiary with regard to death benefits paid to the extent of Wife's distributive share as created
in this paragraph.
(iv) Husband shall name Wife as the designated
survivor, such that she will receive the full survivor's benefit should he predecease her after
retirement.
(v) The parties acknowledge that a Domestic Relations
Order ("DRO") will be required in order for SERS to pay the pension benefit directly to Wife.
Therefore, the parties agree that a DRO shall be prepared by Harry M. Leister, Jr., F.S.A. of
Conrad M. Siegel, Inc., with the cost of Mr. Leister's services to be borne equally.

(x) Wife's portion of Husband's Commonwealth of
Pennsylvania State Employes' Retirement System
account as calculated in subparagraph (1) above.
Husband hereby specifically waives any and all past, present or future interest in and to the assets
listed above.
(3) The parties agree that Husband shall retain, as his sole and
separate property, the assets set forth below:
(ii) Commonweallh of Pennsylvania Deferred
Compensation Program;

(4) The partics agree that they shall execute any documents
pursuant to the Rctirement Equity Act or any simi lar act that may be required from time to time
to accomplish the purposes of this subparagraph.
(I) Cash Accounts. Stocks and In\'cstments.
(1) Wife agrees that Husband shall retain as his sole and
separate property, free from any and all right, title, claim or interest of Wife, any and all stocks,
bonds, investments, sums of cash in savings or checking accounts, mutual funds, stock accounts,
or any other assets of a similar nature which now are titled in Husband's name alone, including,
but not limited to his Fulton Fund (1618-34165) and his Fulton Statement Savings (216-000390).
(2) Husband agrees that Wife shall retain as her sole and
separate property, free from any and all right, title, claim or interest of Husband, any and all
stocks, bonds, investments, sums of cash in savings or checking accounts, mutual funds, stock
accounts, or any other assets of a similar nature which now are titled in Wife's name alone,
including. but not limited to Wife's Fanner's Trust account (001-386493), her Fulton checking
account (1618-34160) and her Fulton Statement Savings account (116-933155).
(g) Lump Sum to Wife. The parties agree that, as part of the
equitable distribution of their marital property, Husband shall pay to Wife the sum of Five
Thousand Dollars (55,000) contemporaneous with the date of execution hereof by check payable
to Howell, Kissinger & Miles. P.C. as counsel for Wife. The partics further agree that, as part of
the equitable distribution of their marital property, Husband shall pay to Wife the additional sum
(iii) Providenmutal Life and Annuity Co. annuity.
Wife hereby specifically waives any and all past, present or future interest in and to the assets
listed above.

of Twenty.Five Thousand Dollars ($25,000) within len (10) days from Ihe receipt by Husband of
the lump sum dislribution from his SERS. The parties agree that no interest shall accrue on said
additional lump sum ifpaid in full within ten (10) days from the receipt by Husband of the lump
sum distribution from his SERS pension. However, commencing on the eleventh (11m) day after
said lump sum distribution, interesl will accrue on any unpaid portion of the said additional lump
sum at the rate of eight percent (8%) per year. The parties agree that the lump sums paid by
Husband to Wife pursuant to the tenns of this subparagraph are in the nature ofa property
distribution and thus shall not be ineludeable in Wife's income nor deductible by Husband for
tax purposes.
(b) Miscellaneous Pronert\', As of the execution dale of this
Agreement, any and 011 property not specifically addressed herein shall be owned by the party to
whom the property is titled; and ifunlitled, the party in possession. This Agreement shall
constitute a sufficient bill of sale to evidence the transfer of any and 011 rights in such property
from each to the other.
(i) Pronerr.' to Wife. The parties agree Ihat Wife shall own, possess,
and enjoy, free from any claim of Husband, the property awarded to her by the lenns of this
Agreement. Husband hereby quitclaims, assigns and conveys to Wife all such property, and
waives and relinquishes any and all rights thereto, together with any insurance policies covering
that property, and any escrow accounts relating to that property. This Agreement shall conslitute
a sufficient bill of sale to evidence the transfer of any and all rights in such property from
Husband 10 Wife.
(j) Pronerh' to Husband. The parties agree that Husband shall own,
possess, and enjoy, free from any claim of Wife, the property awarded to him by the tenns of this
Agreement. Wife hereby quitclaims, assigns and conveys 10 Husband all such property, and

waives and relinquishes any and all rights thereto, together with any insurance policies covering
that property, and any escrow accounts relating to that property. This Agreement shall constitute
a sufficient bill of sale to evidence the transfer of any and all rights in such property from Wife to
Husband.
(k) Assumlltlon of Encumbrances.
(I) In addition to the other liabilities assumed by Husband
pursuant to this Agreement, Husband shall be solely responsible for any and all liabilities he has
incurred in his name alone, specifically to include any obligations to issuers of credit cards in his
name alone.
(2) Wife shall be solely responsible for any and all liabilities
she has incurred in her name alone, specifically to include any obligations to issuers of credit
cards in her name alone.
(3) Unless otherwise provided herein, each party hereby
assumes the debts, encumbrances, taxes and liens on all the property each will hold subsequent to
the effective date of this Agreement. Each party agrees to indemnify and hold hannless the other
party and his or her property from any claim or liability that the other party will suffer or may be
required to pay because of the debts, encumbrances or liens assumed by the other pursuant to this
Agreement.
(I) Liabilltv Not Listed. Each party represents and warrants to the
other that he or she has not incurred any debt, obligation or other liability, other than those
described in this Agreement. on which the other party is or may be liable. A liability not
disclosed in this Agreement will be the sole responsibility of the party who has incurred or may
hereafter incur it, and such party agrees to pay it as the same shall become due, and to indemnify

(m) Indemnification of Wife. If any claim, action or proceeding is
hereafter initiated seeking to hold Wife liable for the debts or obligations assumed by Husband
under this Agreement, Husband will. at his sole expense, defend Wife against any such claim,
action or proceeding, whether or not well-founded, and indel11nify her and her property against
any damages or loss resulting therefrom, including, but not limited to, costs of court and actual
attorney's fees incurred by Wife in connection therewith.
(n) Indemnification of Husband. If any claim, action or proceeding
is hereafter initiated seeking to hold Husband liable for the debts or obligations assumed by Wife
under this Agreement, Wife will, at her sole expense, defend Husband against any such claim.
action or proceeding, whether or not well-founded, and indemnify him and his property against
any damages or loss resulting therefrom. including, but not limited to, costs of court and actual
attorney's fees incurred by Husband in connection therewith.
(0) Warrant\' as to Future Oblil!ations. Husband and Wife each
represents and warrants to the other that he or she will not at any time in the future incur or
contract any debt, charge or liability for which the other, the other's legal representatives,
property or estate may be responsible. From the date of execution of this Agreement, each party
shall use only those credit cards and accounts for which that party is individually liable and the
parties agree to cooperate in closing any remaining accounts which provide for joint liability.
Each party hereby agrees to indemnify, save and hold the other and his or her property hannless
from any liability, loss, cost or expense whatsoever, including attorneys fees, incurred in the
event of breach hereof.

6. W AIVER OF ALIMONY. Husband and Wife hereby expressly waive.
discharge and release any and all rights and claims which he or she may have now or hereafter by
reason of the parties' marriage to alimony, alimony pendente lite, support and/or maintenance or
other like benefits resulting from the parties' status as husband and wife. The parties further
release and waive any rights they may have to seek modification of the tenns of this paragraph in
a court oflaw or equity, it being understood that the foregoing constitutes a final detennination
for all time of either party's obligation to contribute to the support and maintenance of the other.
7. COUNSEL FEES. COSTS AND EXPENSES. Each party shall be
solely responsible for his or her own legal fees, costs and expenses incurred in connection with
their separation and/or the dissolution of their marriage, and the preparation and execution of this
Agreement.
8. WAIVER OF INHERITANCE RIGHTS. Unless otherwise specifically
provided in this Agreement, as of the execution date of this Agreement, Husband and Wife each
waives all rights of inheritance in the estate of the other, any right to elect to take against the will
or any trust of the other or in which the other has an interest, and each of the parties waives any
additional rights which said party has or may ha\'e by reason of their marriage, except the rights
saved or created by the tenns of this Agreement. This waiver shall be construed generally and
shall include, but not be limited to, a waiver of all rights provided under the laws of
Pennsylvania, or any other jurisdiction, and shall include all rights under the Pennsylvania
Divorce Code.
9. WAIVER OF BENEFICIARY DESIGNATION. Unless otherwise
specifically set forth in this Agreement, each party hereto spccifically waives any and all
beneficiary rights and any and all rights as a surviving spouse in and to any asset, bcncfit or like
program carrying a beneficiary designation which bclongs to thc othcr party undcr the tem1S of

this Agreement, including, but not limited to, pensions and retirement plans of any sort or nature,
deferred compensation plans, life insurance policies, annuities, stock accounts, bank accounts,
final pay checks or any other post-death distribution scheme, and each party expressly states that
it is his and her intention to revoke by the terms of this Agreement any beneficiary designations
naming the other which are in effect as of the date of execution of this Agreement. If and in the
event the other party continues to be named as beneficiary and no alternate beneficiary is
otherwise designated, the beneficiary shall be deemed to be the estate of the deceased party.
10. RELEASE OF CLAIMS.
(a) Wife and Husband acknowledge and agree that the property
dispositions provided for herein constitute an equitable distribution of their assets and liabilities
pursuant to S3502 of the Divorce Code, and Wife and Husband hereby waive any right to
division of their property except as provided for in this Agreement. Furthermore, except as
otherwise provided for in this Agreement, each of the parties hereby specifically waives,
releases, renounces and forever abandons any claim, right, title or interest whatsoever he or she
may have in property transferred to the other party pursuant to this Agreement or identified in
this Agreement as belonging to the other party, and each party agrees never to assert any claim to
said property or proceeds in the future. However, neither party is released or discharged from
any obligation under this Agreement or any instrument or document executed pursuant to this
Agreement. Husband and Wife shall hereafter own and enjoy independently of any claim or
right of the other, all items of personal property, tangible or intangible, acquired by him or her
from the execution date of this Agreement with full power in him or her to dispose of the same
fully and effectively for all purposes.
(b) Each party hereby absolutely and unconditionally releases and
forever discharges the other and the estate of the other for all purposes from any and all rights

and obligations which either party may have at any time hereafter for future support or
maintenance, alimony pelldellle Iile, alimony, cquitable distribution, counsel fees, costs,
expenses, and any other right or obligation, economic or otherwise, whether arising out of the
marital relationship or otherwise, including all rights and benefits under the Pcnnsylvania
Divorce Code of 1980, its supplements and amendments, as well as under any other law of any
other jurisdiction, except and only except all rights and obligations arising under this Agreement
or for the breach of any of its provisions. Neither party shall have any obligation to the other not
expressly set forth herein.
(c) Except as set forth in this Agreement, each party hereby absolutely
and unconditionally releases and forever discharges the other and his or her heirs, executors,
administrators, assigns, property and estate from any and all rights, claims, demands or
obligations arising out of or by virtue of the marital relationship of the parties whether now
existing or hereafter arising. The above release shall be effective regardless of whether such
claims arise out of any fonner or future acts, contracts, engagements or liabilities of the other or
by way of dower, curtesy, widow's or widower's rights, family exemption or similar allowance,
or under the intestate laws or the right to take against the spouse's will, or the right to treat a
lifetime conveyance by the other as testamentary or all other rights of a surviving spouse to
participate in a deceased spouse's estate, whether arising under the laws of Pennsylvania, any
state, commonwealth or territory of the United States, or any other country.
(d) Except for the obligations of the parties contained in this
Agreement and such rights as are expressly reserved herein, each party gives to the other by the
execution of this Agreement an absolute and unconditional release and discharge from all causes
of action, claims, rights or demands whatsoever in law or in equity, which either party ever had
or now has against the other.

11. PRESERV A TION OF RECORDS. Each party wi\1 keep and preserve
for a period of four (4) years from the date of their divorce decree all financial records relating to
the marital estate, and each party wi\1 allow the other party access to those records in the event of
tax audits.
12. )\10DlFICA TION. No modification, rescission, or amendment to this
Agreement shall be effective unless in writing signed by each of the parties hereto.
13. ~EVERABILlTY. If any provision ofthis Agreement is held by a court
of competent jurisdiction to be void, invalid or unenforceable, the remaining provisions hereof
shall nevertheless survive and continue in full force and effect without being impaired or
invalidated in any way.
14. BREACH. If either party hereto breaches any provision hereof, the other
party shall have the right, at his or her election, to sue for damages for such breach, or seek such
other remedies or relief as may be available to him or her. The non-breaching party shall be
entitled to recover from the breaching party all costs, expenses and legal fees actually incurred in
the enforcement of the rights of the non-breaching party.
15. WAIVER OF BREACH. The waiver by one party of any breach of this
Agreement by the other party will not be deemed a waiver of any other breach or any provision
of this Agreement.
16. NOTICE. Any notice to be given under this Agreement by either party to
the other shall be in writing and may be effected by registered or certified mail, retum receipt
requested. Notice to Husband will be sufficient ifmade or addressed to the following:

Notice shall be deemed to have occurred upon the date received by the recipient. Each party may
change the address for notice to him or her by giving notice of that change in accordance with the
provisions of this paragraph.
17. APPLICABLE LAW. All acts contemplated by this Agreement shall be
construed and enforced under the substantive laws of the Commonwealth of Pennsylvania
(without regard to the conflict of law rules applicable in Pennsylvania) in effect as of the date of
execution of this Agreement.
18. DATE OF EXECUTION. The "date of execution" or "execution date" of

this Agreement shall be defined as the date upon which the parties signed the Agreement if they
do so on the same date, or ifnot on the same date, then the date on which the Agreement was
signed by the last party to execute this Agreement.
19. EFFECTIVE DATE. This Agreement shall become effective and
binding upon both parties on the execution date.
20. EFFECT OF RECONCILlA TION. COHABITATION OR
DIVORCE. This Agreement shall remain in full force and effect and shall not be abrogated
even if the parties effect a reconciliation, cohabit as husband and wife or attempt to effect a
reconciliation. This Agreement also shall continue in full force and effect in the event of the
parties'divorce. There shall be no modification or waiver ofany of the tenns hereof unless the
parties in writing execute a statement declaring this Agreement or any ternl of this Agreement to
be null and void.
21. HEADINGS NOT PART OF AGREEMENT. Any headings preceding
the text of the several paragraphs and subparagraphs hereof are inserted solely for convenience of
referenee and shall not constitute a part of this Agreement nor shall they affect its meaning,
construction or effect.
22. AGREEMENT BINDING ON PARTIES AND HEIRS. This
Agreement shall bind the panies hereto and their respective heirs, executors, administrators, legal
representatives, assigns, and successors in any interest of the parties.
23. ENTIRE AGREEMENT. Each pany acknowledges that he or she has
carefully read this Agreement, including any and all other documents to which it refers, such
other documents being incorporated herein by reference; that he or she has discussed its
provisions with an attorney of his or her 0\\11 choice, and has executed it voluntarily and in
relianee upon his or her own attorney; and that this instrument expresses the entire agreement
between the parties concerning the subjects it purports to cover and supersedes any and all prior
agreements between the parties. This Agreement should be interpreted fairly and simply, and not
strictly for or against either of the parties.
24. MUTUAL COOPERATION. Each party shall, on demand, execute and
deliver to the other any deeds, bills of sale, assignments, consents to change of beneficiary
designations, tax returns, and other documents, and shall do or cause to be done every other act
or thing that may be necessary or desirable to effectuate the provisions and purposes of this
Agreement. If either party unreasonably fails on demand to comply with these provisions, that
party shall pay to the other pany all attorney's fees, costs, and other expenses actually incurred as
a result of such failure.
25. AGREEl\IENT NOT TO BE MERGED. This Agreement may be
incorporated into a decree of divorce for purposes of enforcement only, but otherwise shall not

be merged into said decree. The parties shall have the right to enforce this Agreement under the
Divorce Code of 1980, as amended. and in addition, shall retain any remedies in law or in equity
under this Agreement as an independent contract. Such remedies in law or equity are specifically
not waived or released.
