COMPLAINT
AND NOW, comes Farmers Trust Company, through its attorney,
William A. Duncan, Esquire, and files this Complaint in
Mortgage ForeClosure, of which the following is a statement:
1. Plaintiff is Farmers Trust Company, a corporation
organized and existing under the laws of the Commonwealth of
Pennsylvania with its main office and principal place of
business located at 1 West High Street, Carlisle, Cumberland
County, Pennsylvania 17013.
2. Defendant, Douglas L. Gibb, an adult individual, and
Defendant, Catherine M. Gibb, an adult individual, are husband
and wife, and reside at 480 Centerville Road, Newville,
Cumberland County, Pennsylvania 17065.
3. On or about August 19, 1988, Defendants made, executed
and delivered to Plaintiff a note and a real estate mortgage
financing Fifty-eight Thousand and 00/100 Dollars ($58,000.00),
a copy of said note and said real estate mortgage being
attached hereto as Exhibits "A" and "B", respectively, and are
incorporated herein by reference as though fully set forth.
4. Said note and said real estate mortgage have not been
assigned.
5. Douglas L. Gibb and Catherine H. Gibb are the sole
record owners in fee simple of said premises subject to said
mortgage, by virtue of a Deed dated August 19, 1988 and
recorded in the Cumberland County Recorder's Office in Deed
Book "N", Volume 33, Page 498, a copy of which is marked
Exhibits "c and attached hereto and made a part hereof by
reference.
6. Said note and said real estate mortgage are in default
because Defendants herein have failed to pay the payments that
were due and owing for the months of August, 1993 to December
1993.
7. The Plaintiff has given to the Defendants written
notice of intention to foreclose on said mortgage as required
by law under Act 6, dated October 20. 1993, a copy of which is
marked Exhibits "D" and "E", and attached hereto and made a
part hereof by reference.
8. The Plaintiff has given written notice of default as
required by the Homeowner's Emergency Assistance Act of 1983,
dated October 20, 1993, a copy of which is marked Exhibits "F"
and "G", and attached hereto and made a part hereof by
reference.
9. By reason of the aforesaid default, the entire
principal balance of Fifty-one Thousand Five Hundred

Fifty-three and 89/100($51,553.29) Dollars, with interest
thereon at the rate of seven (7.0) percent per annum computed
from August 29, 1993 totalling One Thousand Thirty-three and
21/100 ($1,033.21) Dollars, charges in the amount of One
Thousand Four Hundred Thirty-seven and 25/100 ($1,437.25)
accruing insurance premiums, attorney's fees in the amount of
Eight Thousand One Hundred Three and 55/100 (8,103.55) Dollars
are now due and payable.
10. The Defendants are liable to the plaintiff for the
following on said mortgage loan:
A. Principal amount and interest
due through December 19, 1993: $52,586.50
B. Interest at 7.0% from 12/19/93
to date ($9.31/day) 214.13
C. Late Charges: $ 1,437.25
D. Attorney's Collection fee: $ 8,103.55
TOTAL: $ 62,341.43
WHEREFORE, Plaintiff prays the Court enter judgment in
favor of Plaintiff and order the foreclosure and sale of the
mortgaged property and for the amount of Sixty-two Thousand
Three Hundred Forty-one and 43/100 ($62,341.43) Dollars
together with interest thereon, costs and all other amounts
advanced by Plaintiff.
