Accordingly, the
Recorder of Deeds for Cumberland County is hereby directed to
enter satisfaction of the mortgage from Allen L. Schoffstall
and his wife, Gladys B. Schoffstall to Aquilla J. Drayer and
his wife, Maude C. Crayer entered of record in the Recorder
of Deeds of Cumberland County, PA in Mortgage Book 175, Page
90 upon tender to the Recorder of the proper satisfaction fee
for said mortgage.

TO THE PROTHONOTARY:
Please enter Final Judgment in the above captioned matter
in favor of Thomas A. Kanaskie and against James E. Snyder and
his wife, Gladys B. Snyder for failure of the said defendants
to initiate action to enforce the lien of the mortgage held
by them and recorded in the Recorder of Deeds Office of Cumberland
County in Mortgage Book 175, Page 90, and direct the Recorder
of Deeds of Cumberland County to enter satisfaction of said
mortgage upon tender to the Recorder of the proper satisfaction
fee. The affidavit of plaintiff's counsel, attesting to the
failure of the defendants to initiate action and proofs of
publication of Notice of the Entry of Order of this Court, dated
March 30, 1994, are attached hereto as Exhibits "A" and "B",
respectively.

Robert Sullivan, Jr., Esq., attorney for the plaintiff
in the above captioned action, being duly sworn according to
law, deposes and says that he has not been served with nor does
he have any knowledge of any action being commenced in the Court
of Common Pleas of Cumberland County or any other jurisdiction
by or on behalf of James E. Snyder and his wife, Gladys B. Snyder,
their heirs and assigns seeking to enforce the lien of the
mortgage described in a Complaint To Quiet Title filed in the
above captioned actionl that this affidavit is made on May 25,
1994, said date being in excess of 30 days following the date
of publication of the Final Order entered in this matter as

MOTION FOR SERVICE OF FINAL ORDER BY
PUBLICATION PURSUANT TO RULE 430 OF THE
PENNSYLVANIA RULES OF CIVIL PROCEDURE
AND NOW, comes the plaintiff above named, by his
attorneys, Sullivan and Sullivan, and moves your Honorable Court
as follows:
1. A Complaint to Quiet Title was filed in the above
captioned action January 24, 1994.
2. Accompanying said Complaint was a Motion requesting
service of said Complaint by publication pursuant to Rule 430
of the Pennsylvania Rules of civil Procedure.
3. An Order of Court was entered January 25, 1994,
authorizing service of the Complaint in this action by
publication.
4. Plaintiff's counsel avers that to the best of
his knowledge there has been no change in circumstances or any
additional information made available to plaintiff or plaintiff's
counsel which would allow plaintiff to serve any further
pleadings or Order in this matter in any manner other than
publication.

MOTION FOR ENTRY OF FINAL ORDER
AND HOW, comes Thomas A. Kanaski, plaintiff above
named, by his attorneys Sullivan and Sullivan, and moves your
Honorable Court as follows:
1. A Complaint was filed in the above captioned action
to docket number 277 Civil 1994, the allegations of which
Complaint are incorporated herein by reference as if textually
set forth in full.
2. Thereafter, pursuant to this Court I s Order, said
Complaint was served by publication once in the Cumberland Law
Journal on February 18, 1994, and in the Carlisle Sentinel on
February 11, 1994.
Proofs of Publication in said newspapers
are attached hereto, made a part hereof and marked Exhibits
A and B respectively.
3. Since the date of publication of said notices
plaintiff I S counsel has received no notice of the filing of
any responsive pleading or the entry of an appearance by anyone
on behalf of the above noted defendants.
4. Attached hereto is the Affidavit of plaintiff I s
counsel attesting to the publication of the aforesaid notices
and the failure of any of the above named defendants to file
an Answer with said Affidavit being attached hereto, made a
part hereof and marked Exhibit C.
5. Pursuant to Rule 1066 of the Pennsylvania Rules
of Civil Procedure plaintiff requests that final judgment be
entered in accordance with the prayer of plaintiff's Complaint.
WHEREPORE, plaintiff moves your Honorable Court that
final judgment be entered directing the Recorder of Deeds of
Cumberland County to enter satisfaction of the mortgage from
Allen L. Schoffstall, et ux to Aquilla J. Drayer, et ux with
said mortgage being recorded in the Recorder of Deeds Office
of Cumberland County in Mortgage Book 175, Page 90.

to docket number 277 Civil 1994, the allegations of which
Complaint are incorporated herein by reference as if textually

MOTION FOR ENTRY OF FINAL ORDER
AND NOW, comes Thomas A. Kanaski, plaintiff above
named, by his attorneys Sullivan and Sullivan, and moves your
Honorable Court as follows:
1. A Complaint was filed in the above captioned action
to docket number 277 Civil 1994, the allegations of which
Complaint are incorporated herein by reference as if textually
set forth in full.
2. Thereafter, pursuant to this Court's Order, said
Complaint was served by publication once in the Cumberland Law
Journal on Februilry 18, 1994, and in the Carlisle Sentinel on
February 11, 1994.
Proofs of Publication in said newspapers
are attached hereto, made a part hereof and marked Exhibits
A and B respectively.
3. Since the date of publication of said notices
plaintiff's counsel has received no notice of the filing of
any responsive pleading or the entry of an appearance by anyone
on behalf of the above noted defendants.
4. Attached hereto is the Affidavit of plaintiff's
counsel attesting to the publication of the aforesaid notices
and the failure of any of the above named defendants to file
an Answer with said Affidavit being attached hereto, made a
part hereof and marked Exhibit C.
5. Pursuant to Rule 1066 of the pennsylvania Rules
of Civil Procedure plaintiff requests that final judgment be
entered in accordance with the prayer of plaintiff's Complaint.
WHEREFORE, plaintiff moves your Honorable Court that
final judgment be entered directing the Recorder of Deeds of
Cumberland County to enter satisfaction of the mortgage from
Allen L. Schoffstall, et ux to Aquilla J. Drayer, et ux with
said mortgage being recorded in the Recorder of Deeds Office
of Cumberland County in Mortgage Book 175, Page 90.

2. Attached hereto as Exhibit "A" is the affidavit
of plaintiff's counsel as to the nature and extent of counsel's
inquiry regarding the whereabouts of the defendants.
3. After diligent inquiry as noted on the affidavit
of plaintiff's counsel, plaintiff has no knowledge as to the
whereabouts of the defendants in this action or whether sai
defendants are living or dead.
WHEREFORE, plaintiff moves your Honorable Court tha
an Order Issue allowing service of the complaint filed in thi
action by publication once in the Cumberland Law Journal an

IN QUIET TITLE
COMPLAINT
1. Plaintiff is Thomas A. Kanaskie, a sui juris
individual who resides at 319 Geary Street, New Cumberland,
Cumberland County, Pennsylvania 17070.
2. The defendants are James E. Snyder and his wife,
Gladys B. Snyder, their heirs and assigns, whose whereabouts
are unknown, but whose last known place of residence is
Elizabethville, Dauphin County, Pennsylvania.
3. Plaintiff is the owner of premises situate a
319 Geary Street, New Cumberland, Cumberland County, PA, bounde
and described as follows:
BEGINNING at a point on the eastern line of Gear
Avenue, twenty-seven (27) feet in a southerly directio
from the intersection of the eastern line of Gear
Avenue with the southern line of Ruby Alley; thenc
in a southerly direction along the eastern line of
Geary Avenue thirty (30) feet to a point thence i
an easterly direction along land now or late of Samue
G. and Sarah Baum, one hundred sixty-five (165) fee
to Cherry Alley; thence in a northerly direction
along the western line of cherry Alley, thirty (30)
feet to a point; thence in a westerly direction along
land now or late of Charles Z. Brubaker one hundred
sixty-five (165) feet to the place of BEGINNING.
Being improved with a two and one-half story frame
dwelling house and out buildings.
4. Plaintiff acquired title to the aforesaid premises
on November 30, 1993, by virtue of a deed from Allen M.
Schoffstall and his wife, Carole Schoffstall conveying to
plaintiff Fee Simple Title to said premises.
5. In the chain of title to said premises, Allen
L. Schoffstall and his wife, Gladys M. Schoffstall, the parents
of grantors and predecessors in title of said premises to
plaintiff herein, executed and delivered a mortgage encumbering
said premises to Aquilla J. Drayer and his wife, Maude C. Drayer,
wi th said mortgage being dated February 2, 1942, and recorded
in the Recorder of Deeds Office of Cumberland County on February
3, 1942, in Mortgage Book 175, Page 90 in the principal amount
of $2,900.00.
A true and correct copy of said mortgage is
attached hereto, made a part hereof and marked Exhibit "A".
6. Thereafter, on March 5, 1942, Aquilla J. Drayer
and his wife, Maude C. Drayer assigned said mortgage to James
E, Snyder and his wife, Gladys B. Snyder, by assignment dated
March 5, 1942 with said assignment being recorded in the Recorder
of Deeds Office of Cumberland County on March 6, 1942 in Misc.
Book 75, Page 308. A true and correct copy of said assignment
is attached hereto, made a part hereof and marked Exhibit "B".
7. The aforesaid Allen L. Schoffstall and his wife,
Gladys M. Schoffstall have died and there are no records available
regarding the status of the above noted mortgage.
8. The whereabouts of James E. Snyder and his wife,
Gladys B. Snyder or their heirs and assigns is unknown and
plaintiff has no knowledge as to whether or not said mortgage
has been paid in full.
9. A period in excess of 21 years has passed from
the date of the execution and recording of said mortgage, and
it is presumed that said mortgage is paid in full.
10. The existence of said unsatisfied mortgage and
assignment in the indices of the Recorder of Deeds Office of
Cumberland County creates a cloud on plaintiff's title which
must be removed.
WHEREFORE, Plaintiff prays your Honorable Court that
an Order Issue granting the following relief:
1. Ordering and directing that the Recorder of Deeds
of Cumberland County enter satisfaction of the mortgage recorded
in the Recorder of Deeds Office of Cumberland County as set
forth in the above complaint and found at Mortgage Book 175,
page 90.
2. Granting to plaintiff such other relief as is
necessary and proper in order to remove the cloud from plaintiff's
title.
