COMPLAINT
COME NOW the Plaintiffs Aaron Moats nd Michelle D. Moats by
and through their attorney, Gregory R. Reed, Esquire and for their
causes of action allege:
1. Plaintiffs, Aaron Moats and Michelle D. Moats, husband and
wife, are adult individuals residing at 3107 Roxbury Road,
Pennsylvania
(hereinafter
as
referred
to
Shippensburg,
"Plaintiffs").
2. The Defendant Fleet Real Estate Funding corporation, is a
corporation doing business within Cumberland County, Pennsylvania,
with offices at 324 West Evans street, Florence, South Carolina
(hereinafter referred to as "Defendant").
3. On or about April 29, 1993 Defendant PNC held a mortgage
on property located at 27 Pinetree Drive, Upper Allen TownShip,
Cumberland County, Pennsylvania in the amount of $105,030.23.
4. Plaintiffs on the aforesaid date owned the property at 27
Pinetree Drive, Upper Allen TownShip, Cumberland County,
Pennsylvania.
5. On or about April 29, 1993 Plaintiffs delivered a check to
Fleet Real Estate Funding Corporation in the amount of $105,030.23
as payment in full of said indebtedness (a copy of the cover
letter and cancelled check are attached hereto, marked Exhibit itA"
and incorporated herein by reference).
6. On August 4, 1993, 1993 the mortgage had not been
satisfied of record so Plaintiffs' counsel wrote to Defendant, by
first class mail, asking Defendant to immediately satisfy the
mortgage (a copy of said letter is attached hereto, marked Exhibit
"Bit and incorporated herein by reference).
7. On October 25, 1993 Plaintiffs' counsel corresponded with
Defendant by certified mail requesting that the mortgage be
satisfied immediately (a copy of said letter and the return receipt
are attached hereto, marked Exhibit ItC" and incorporated herein by
reference).
8. Fleet Real Estate Funding Corporation has and continues to
refuse to satisfy said mortgage.
9, Fleet's refusal to satisfy the mortgage within 45 days of
Plaintiffs' request is capricious, spiteful and done with malice
and ill-will.

WHEREFORE, Plaintiffs respectfully request that jUdgment be
entered for Plaintiffs and against Defendant in the amount of
$105,030.23 plus attorneys fees and costs.

satisfy the above referred to account. The mortgage securing this
account is recorded in Mortgage Book 1114, Page 1096 of the
cumberland County Records in Carlisle, pennsylvania. I have
checked the records on two occasions during the last four months
and found that the mortgage is still not satisfied of record. The
law in Pennsylvania requires you to satisfy the mortgage within
thirty (30) days. If this mortgage is not satisfied within the
next thirty (30) days I will file an action against you which will
carry severe penalties.
