3. Thoma. C. Bruck1aoker (hereinafter II Brucklaoker" ) 11
an adult individual re.iding at 527 Davi. Drive, New Cumberland,
penn.ylnnia.

6. Since 1979 CCNB and Diehl have entered into variou.
financing agreemente for the purcha.e and developlllent of

7. In or about January of 1989, Diehl entered into an
agreement in re.pect to the purch..e and development of a tract of
land ln Mlddl..ex Town.hlp, Cumberland County, Penn.ylvanla
(h.relnafter ref.rred to a. the "Roadway property").
8. Du. to the fallure of CCNB to provlde the proml..d
con.trucUon Unancinq the Dlehll were placed ln a poliUon of
extreme flnanclal herdlhlp.
9. On or about Novelllber 4, 1990, Dlehl met wlth 'rom
Brucklacker to dllcuII hll Unanclal dUUculUe. and po..lbl.
lnabl11ty to meet the mortgaq. requlrem.nt. of the Roadway
Property.
10. At thl. meetlng Brucklacker indlcated h. would not
take thl. matter to the bank committee due to the pre.enoe of bank
exulner..

condition of providing further financing on the Roadway project.
1e. On or a~out March 21, 1991, Diehl entered into a
commitment. with Commerce Bank to group all out. tanding not.e. and
loan. except. for the Roadway loan.. Said commitment wa. entered
into on the advice and urQing of CCNS.
16. In or about Augu.t of 1991, Diehl took out a .econd
mortgage on the warehou.e property at 10 Long Lane, Mechanic.burg,
'enn.y1vania for Two Hundred ThQulAnd ($200,000.00) DoUar.. The.e
fund. were u.ed to pay arrearage. on the CCNS loan..
17. In or about Augu.t of 1991, CCNS reneged on it'.
promhe to provide con.truction financing for the Roadway p1;'operty.
18. Diehl .ub.equently .old .tock., equipment and other
property to obtain fundI to operate hil bu.ine.. and Vllmerate
perlonal income to lupport hil family.
19. Due to the actionl of CCNS a. aUeged in thh
Complaint the DJehle have been forced into Hling for bankruptcy
under Chapter 11 of the U.S. Sankruptcy Code.

tract of land, known a. the Roadway prop.rty. Said dev.lopment was
to consi.t of a warehouse and distribution c.nter.
23. Tom Bruoklacker, as Senior Vio.-Prel1dent, expr....d
an inter..t in said development.
24. Brucklacker indicated a .eoondary sourc. of funding
would be included in the deal.
25. On or about January of 1989, CCNB illu.d a
commitment letter to Diehl for the purpose of puroha.ing the land.
Said commitment was originally in the amount of Thre. Hundr.d fifty
Thou.and ($350,000.00) Dollan. The commitment was lat.r incr.a..d
by Two Hundred ThoulAnd ($200,000.00) Dollars to a total oommitment
of ,ive Hundred fifty Thousand ($550,000.00) Dollar. for puroha.e
and pr.liminary d.v.lopment.
26. Bruoklaoker indioated to Diehl that a l.tter of
commitment for the purpose of construotion funds WQuld b. illu.d in
a .hort time ono. the neoessary work by the out. ide .ouroe of fund.

27. At all time. Diehl expre..ed hi. intention that the
entire buline.. tran.action wu conditioned on the approval of both
the purcha.e and development loan..
28. Diehl entered into the commitment for purcha.e fund.
on the repre.entation. of Defendant. that full development fund.
would al.o be provided.
29. Said reliance by Diehl wa. rea.onable due to the
repre.entation. of Brucklacker and the put practice. between Diehl
and CCNI.
30. On or about June 26, 1989, the commitment letter we.
.ivned for the amount of rive Hundred Fifty Thou.and ($550,000.00)
Dollar.. (See attached IxhibJ.t "A")
31. Due to the belief that con.truction fund. would be
forthcolllinv, Diehl .ettled on the Roadway property on or about July
18, 1989.

with CCNB whereby commitment letter. for con.truction financinV
were not provided until after the initial purcha.e had occurred.
33. In or about Augu.t of 1991, after repeated
a..urance. that the lank would work with the Diehh to obtain
con.truction financing, CCNB infol'llled the Diehla that they would no
lonver con.ider providing .aid financing. (See attached Ixhibit

34. Due to CCNI'. failure to fulfill their obligationa

wife, (hereinafter "Dlehl" of "Diehl.,,) are adult individual.
re.iding at 14 Nancy Lane, Inola, PA 17025.
2. PNC Bank Corporation (hereinafter "PNC") i. a
Penn.ylvania corporation with an addrell for doing buline.. at
4242 Carli.le Pike, Camp Hill, Penn.ylvania 17011.
3. Thoma. C. Brucklacker (hereinafter "Brucklacker") 11
an adult indlvidual re.iding at 627 Davi. Drive, New Cumberland,
Penn.y1vania.
4. At all tlme. indlcated in thi. Complaint Brucklacker
wa. employed by CCNB Bank a. Senior Vice-Pre.ident.
5. PNC Bank ha. acquired CcNB Bank, N.A. (hereinafter
"CCNB") and itl intere.U and obligaUon..
6. Since 1979 CCNB and Diehl have entered into variou.
financinq agreement. for the purch..e and development of
properUe. .
7. In or about January of 1989, Diehl entered into an
agreement in re.pect to the purcha.e and development of a tract of
land in Mlddlelex Town.hip, Cumberland County, penn.ylvania
(h.reinafter referred to 48 the "Roadway Property").
8. Dlle to the fal1ure of CCNO to provide the promis.d
con.tructlon financing the Diehls were placed in a polition of
extr.m. flnancial hardship.
9. On or about November 4, 1990, Piehl met with Tom
Bruckhoker to dllculS his financial difUculties and po..ibl.
inabUlty to meet the mortgage requirement. of the Roadway
prop.rty.
10. At thls meeting Brucklacker indlcated he would not
take thi. matter to the bank committee due to the pre.ence of bank
examiner..
11. On or about January 3, 1991, Diehl aCjJaln met with
Brucklack.r to di.cu88 his financial difUculUe.. Dlehl expre...d
hi. int.re.t to brinCjJ this matter to the attention of the banking
committ.e. Thll requelt was denied by Brucklacker due to the
continu.d pre.ence of bank t'lxaminers.
12. On or about January 17, 1991, Diehl met with Tom
Compton of CCNB. Compton reiterated Brucklacker'. decl.lon not to
.ubmit Di.hl. portfolio and financial problem. to the bank
committe. until after the bank examiners left.
13. On or about March 15, 1991, CCNB pre..nted .
propo'4l to grollp all outstanding commercial note. and loan..

co_itment, however, CCNB .tronllly urCjJed Diehl to do .0 a. a

15. On or about March 21, 1991, Diehl enterad into a
commitment with CCNB to qroup all out.tandinCjJ note. and loan.
except for the Roadway loan.. Said commitment wa. entered lnto on
the advice and urqinCjJ of CCNB.
16. In or about Augu.t of 1991, Diehl took out a .econd
mortqage on the warehou.e property at 10 Long Lane, Meahanlc.burCjJ,
Penn.ylvania for Two Hundred Thou.and ($200,000.00) Dollar.. Th..e
fund. were u.ed to pay arrearage. on the CcNB loan..
17. In or about Augult of 1991, CCNB ~eneged on it'.
promlle to provlde conltruction Unancing for the Roadway prope~ty.
18. Diehl .ub.equently lold .tock., equipment and other
property to obtain fund. to operate h1l bUlinell and venerate
per.onal lncom. to lupport hie family.
19 . Due to the action. of ccNB al alleqed ln thi.
Complaint the Diehl. have been forced into filinq for bankruptcy
under Chapter 11 of the U.S. Bankruptcy Code.

mortgage owned by CcNB.

relatlon.hip with each agency.
82. Ho legitimate business or logal need was present to
necea.itate those actlons by eCHO, Witzig, or other agents.
83. Said actions wore taken with full knowledge that
thi. conduct presented a substantial risk of harm to the buslne.s
and financial lnterests of the Oiehls.
84. CCNO, by and through its willful, wanton, reckle..,
maliciou., intentlonal and negligent actions in making bad faith
inquiries and requestEl to local and state agencles, has damaqed

and would not have so relied but for those milrepre.entations. In
re..onable reliance on those misrepresentations, PlalntiU. entered

financing for that purchase from CCNB, as well ae entering into an
