The Plaintiff, Redco Associates, Inc., is a Pennsylvania corpol'lltlon dolnl business as Redco Realty, Inc., with 118 place of business at 11 Brenneman Circle, Mechanicsburg, Pennsylvania 110~~. 2. The Defendant, PNC Bank Corporation, (hereinafter "PNC") \., a Pennsylvania corpomtlon with an address for doing business at 4242 Carlisle Pike, Camp Hili, Pennsylvania 17011. 3. PNC Bank has acquired CCND Bank, N.A., (hereinafter "CCND") and its Interests and obligations. 4. Since 1979, CCNB and the principal of Redco Associates, Inc. doing business as Redco Realty, Inc., Robert B. Diehl, have had a continuing relationship for various financing agreements for Ihe purchase and development of real property, ~. In June of 1992, Ihe Defendant PNC foreclosed on property located at 17 Brenneman Circle and assumed management of the property. 6. The properties at 13 and 11 Brenneman Circle were owned by Plaintiff Robert B. Diehl. 1. In the course of the Defendant's management of the property, they have paid real estate commissions to both CIR Realty and landmArk Realty for having procured various tenants. 8. During the same time period from June 1992 to the present, the Defendant has refused to pay the same real estate cllllllnlssions to the Plaintiff Redco Associates, Inc., doing business as Redco Realty, Inc. 9. The Plaintiff has a demand to PNC fur the realeslate cmnmiuions which aJ'll due and owlnllln the total amount of $16,711.64 as J'llnecled in the invoice dated Auaust 26, 1993 which Is hoJ'llby allached as Exhibit" A". 10. Despite repeated demand for payment, the Defendant has failed to remit the commissions which are due and owlnlltu Plaintiff In the amount of $16,711.64, II. The Plaintiff has perfunned all cundltlons required (If lito receive the real eslllte commissions. 12, The Defendant Is liable 10 the Plaintiff In the amuunt of $16,711.64, plus pre- judllmentand post-judament Interesl costs and allumey's fees on theories of quantum mendt, breach of warranty. 13. (See paragraphs 1, 2, 5, 6, 7 and 8 of Plaintiff's Amended Complaint). Exhibit "A" attached to the Complaint is an invoice addressed to Defendant for real estate commissions apparently owed to Robert E. Diehl, Ino. dated August 26, 1993. A search of the records of the Department of state, corporation Bureau does not reflect either the incorporation of an entity known as Redco Realty, Inc. or the registration of the fictitious name, Redco Realty, Inc. Since 1979, CCNBand the principal of Redco Rcalty, Inc., RobertB, Diehl, have had a contlnulna relationship for various financing agreements for the purcha~e and development of real property, 5. In June of 1992, the Defendant PNC foreclosed on property located at 17 Brenneman Circle and assumed management of the property. 6. The properties at 13 and 17 Brenneman Circle were owned by Plaintiff Robert B. Diehl. 7. In the course of the Defendant's management of the property, they have paid real estate commissions to both CIR Realty and Landmark Realty for having procured various tenants. 8, During the same time period from June 1992 to the present, the Defendant has refused to pay the same real estate commissions to the Plalndff Redco Realty, Inc. 9, The Plaintiff has a demand to PNC for the real estate commissions which are due and owln, in the total amount of $16,711.64 as reflected In the Invoice dated Au,ust26, 1993 which Is hereby allached as Bxhlblt "A".
